RESOLUTION NO. 2001-168
RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE
200112002 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 986,
LANDSCAPING MAINTENANCE DISTRICT, RIALTO AVENUE AND MACY
STREET AREA.
WHEREAS, by Resolution No. 89-214 the Mayor and Common Council found that the
public interest, convenience, and necessity required the formation of a landscaping maintenance
district; and
WHEREAS, by said Resolution No. 89-214, the Mayor and Common Council formed
10 an assessment district known as Assessment District No. 986 for the purpose of providing
11 landscaping maintenance in the Rialto A venue and Macy Street area, pursuant to the provisions
12 of Chapter 12.90 of the San Bernardino Municipal Code; and
13 WHEREAS, by Resolution No. 89-143, the Mayor and Common Council declared that
14
all the land included within the boundaries of said district receive a special benefit by the
15
16

18 levied on all land within the district to provide funding for said landscaping maintenance and the
maintenance of said landscaping; and
WHEREAS, said Resolution No. 89-143 declared that an annual assessment shall be
19 administration thereof; and
20 WHEREAS, an Assessment Roll has been prepared totaling $15.379.70, which sets
21 forth the individual assessments to be levied on each of the parcels of land within Assessment
22
District No. 986 for the fiscal year 2001/2002; and
23
WHEREAS, Article XIII D of the California Constitution requires that any and all
24
Assessment Districts existing on the effective date of said Article XIII D shall comply with the
25
26 procedural and approval process as set forth in Section 4 of said Article XIII D, except as set
27 forth in Section 5 therein.

RESOLUTION CONFIRMING 2001/2002 ASSESSMENT ROLL NO. 986 (RIALTO AVENUE AND
MACY STREET AREA LANDSCAPING MAINTENANCE)
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION I. That the Mayor and Common Council do hereby find and determine that
provided for under Section 5(a) and S(b) of said Article XIII D, and that the assessment amounts
9 as set forth on said Assessment Roll are equal to or less than any prior approved assessments.

SECTION 2. That the Mayor and Common Council do hereby find and determine
that the proportionate costs to be levied against the parcels of land within Assessment District
12
No. 986 are correctly set forth on Assessment Roll No. 986, for the fiscal year 2001/2002, on
13
14
file in the office of the City Clerk of the City of San Bernardino, and do hereby confirm said
assessments.

16 SECTION 3. That the City Clerk is directed to cause a copy of this Resolution to be
17 transmitted to the Office of the Auditor-Controller for the County of San Bernardino with the
18 request that the individual assessments be placed on the subject 2001/2002 property tax bills
19 for collection together with all other property taxes.
