RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE
APPLICATION FOR BLOCK GRANT FUNDS UNDER THE PROVISIONS OF THE
ROBERTI-Z'BERG-HARRIS URBAN OPEN-SPACE AND RECREATION PROGRAM
FOR THE UPGRADING OF WALKWAYS AT SECCOMBE LAKE STATE URBAN
RECREATION AREA.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Recitals.
(a) The people of the State of California have
enacted the
ROberti-Z'Berg-Harris Urban
Open-Space and
Recreation Program Act (Public Resources Code Sections 5620,
et seq.) which provided funds to the State of California and
local agencies for acquiring lands and developing facilities
for public outdoor recreation purposes.
(b) The State Department of Parks and Recreation has
been delegated the responsibility to administer the program,
and to establish procedures governing application by local
agencies for funds.
(c) Procedures established by the State Department of
Parks and Recreation requires the applicant to authorize by
resolution the filing of applications for funding.
(d) Public Resources Code section 5626 requires grant
applicants to certify compliance with certain laws and
regulations.
(e) Adopted procedures require the applicant to have
adopted a plan showing parks and recreation lands and
facilities, existing and proposed.
(f) The City's General Plan was first adopted by the
Mayor and Common Council on October 3, 1964.

(g) The proposed project at Seccombe Lake State Urban
Recreation Area appears on the city's
General Plan. The
Plan is consistent with the
California Outdoor Recreation
Resources
and is in conformity with the
State
Plan
Environmental Goals and Policy Report.
(h) The project is compatible with the land use plans
of those jurisdictions immediately surrounding the project.
SECTION 2. The Mayor and Common Council approve the
filing of applications
for grant assistance under the
Roberti-Z'Berg-Harris Urban Open-Space and Recreation Program
Act.
SECTION 3. The Mayor and Common Council certify that
the City of San Bernardino understands the certifications
set forth in the application, and authorize the Director of
the Parks, Recreation and Community Services Department to
make the certifications, except those specifically required
to be made by legal counsel.
SECTION 4. The Mayor and Common Council certify that
the City of San Bernardino has or will have sufficient funds
to operate and maintain the project.
SECTION 5. The Mayor and Common Council certify that
the City of San Bernardino meets the planning requirements
and that the project is compatible with the land use plans of
those jurisdictions immediately surrounding the project.

SECTION 6.
The Director of Parks, Recreation and

Community Services Department of the city of San Bernardino
is authorized and directed to execute on behalf of the City

application for block grant funds under the provisions of the
Roberti-z'Berg-Harris Urban Open-Space and Recreation
Program, a copy of which is attached, marked Exhibit "A".
The Director of the Parks, Recreation and Community Services
Department is authorized to administer any grant funds which
12 may be received, and to provide to the State of California
13 such additional information as may be required.

GRANT APPLICATION
To apply. submit one copy each of the applicable documents listed below,

,. _ A completed application form signed by the person authorized in your resolution and by your attorney.
2._ The resolution from your governing body authorizing the application.
3._ Environmental Impact Report or Negative Declaration and a copy of the Notice of Determination showing the
county clerk's stamps, or, if applicable, a copy of the Notice of Exemption if the project is categorically exempt,
or the reason why CEQA does not apply. Clearinghouse response is required jf you have an EIR or Negative
Declaration for the project.
4._ A city or county street map showing the project location with sufficient detail to find the site.
5._lf property to be developed is not owned in fee, evidence of adequate land tenure. (Copies of leases, joint powers
agreements, permits, etc.)
6._A site plan for development projects. Map of the overall park showing location of project facilities, details of
access, water, power and sanitation.
7. _Cost estimate. A detailed estimate of all projects costs.
8. _Acquisition map and acquisition schedule listing number of parcels, size, approximate date of acquisition and cost
(acquisition projects only).
9. _Summary of comments made at a public hearing concerning any acquisition that impacts productive agricultural
lands (acquisition projects only).
10._Local match certification form.
11. _A list of all funds, over and above the grant requested, that will be used for the project.
12._Photos of the project site.
13._Cop;es of all permits, leases, agreements, etc., affecting project lands or operation and maintenance.

Assurances
The applicant hereby gives assurances and certifies with respect to the grant that:
It possesses legal authority to apply for the grant, and to finance, acquire and construct the proposed project; that a
resolution, motion or similar action has been duly adopted or passed as an official act of the applicant's governing body,
authorizing the filing of the application, including all understandings and assurances contained therein, and directing and
authorizing the person identified as the official representative of the applicant to act in connection with the application
and to provide such additional information as may be required.
Applicant will provide and maintain competent and adequate architectural engineering supervision and inspection at the
construction site to insure that the completed work conforms with the approved plans and specifications; that it will
furnish progress reports and such other information as the State may require.
Applicant will give the State's authorized representative access to and the right to examine all records, books, papers, or
document related to the grant.
Applicant will cause work on the project to be commenced within a reasonable time after receipt of notification from the
State that funds have been approved and that the project will be pursued to completion with reasonable diligence.
Applicant will not dispose of or encumber its title or other intrests in the site and facilities without permission from the
State Legislature.
Applicant will comply where applicable with provisions of the California Environmental Quality Act and any other State,
and/or local laws, rules and/or regulations.
In cases involving leased property, it agrees to maintain and operate the property and/or facilities acquired or developed
for an agreed to period commensurate with the type of project and the proportion of state grant funds and local funds
allocated to the capital costs of the project.
