AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF
THE CITY OF SAN BERNARDINO, CALIFORNIA
ESTABLISHING AND AMENDING CERTAIN LIMITATIONS
WITH RESPECT TO THE REDEVELOPMENT PLAN FOR THE
STATE COLLEGE REDEVELOPMENT PROJECT
WHEREAS, the Redevelopment Agency of the city of San
Bernardino (the "Agency"), has formulated, prepared and approved
the Redevelopment Plan for the State College Redevelopment
Project (the "Redevelopment Plan"); and
WHEREAS, the Mayor and Common Council of the city of
San Bernardino (the "City Council"), approved and adopted the
Redevelopment Plan pursuant to a duly enacted Ordinance on April
27, 1970; and
16 WHEREAS, section 33333.6 of the California Community
17 Redevelopment Law has established certain limitations on the
18 incurring and repaying of indebtedness and the duration of
19 redevelopment
plans,
which
limitations
to
every
apply
20 redevelopment plan adopted on or before December 31, 1993; and
21
22 WHEREAS, section 33333.6 further provides that unless
23 a redevelopment plan adopted prior to January 1, 1994, already
24 contains limitations which comply with that Section, the
25 legislative body shall adopt an ordinance on or before December
26 31, 1994, to amend the redevelopment plan either 1) to amend an
27 existing time limit that exceeds the applicable time limit

1 established by that section, or 2) to establish time limits that
2 do not exceed the provisions of that section.

4 BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
5 BERNARDINO, STATE OF CALIFORNIA, AS FOLLOWS:

7 section 1. The provisions of this Ordinance shall
8 supersede any prior amendments to the Redevelopment Plan.

10 section 2. A new section G is hereby added to the
11 Redevelopment Plan to read as follows:

13 The provisions of this Redevelopment Plan shall be
14 effective for forty (40) years from the date of adoption of this
15 Redevelopment Plan.

17 The Agency shall not pay indebtedness or receive
18 property tax increment revenues pursuant to Health and Safety
19 Code section 33670 after ten (10) years from the termination of
20 the effective date of the Redevelopment Plan.

22 section 3. The City Clerk is hereby directed to
23 send a certified copy of this Ordinance to the Agency.

25 section 4. Effective Date. This Ordinance shall be
26 in full force and effect thirty (30) days after its passage.

7 section 6. If any part of this Ordinance is held to
8 be invalid for any reason, such decision shall not affect the
9 validity of the remaining portion of this Ordinance and the City
10 council hereby declares that it would have passed the remainder
11 of this Ordinance, if such valid portion thereof had been
12 deleted.

section 5. Publication. The City Clerk is hereby
ordered and directed to certify to the passage of this Ordinance
and cause the same to be published once in the sun, a newspaper
of general circulation published and circulated in the City of
San Bernardino, California.
