MC-920 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA ESTABLISHING AND AMENDING CERTAIN LIMITATIONS WITH RESPECT TO THE REDEVELOPMENT PLAN FOR THE CENTRAL CITY NORTH REDEVELOPMENT PROJECT WHEREAS, the Redevelopment Agency of the City of San Bernardino (the "Agency"), has formulated, prepared and approved the Redevelopment Plan for the Central City North Redevelopment Project (the "Redevelopment Plan"); and WHEREAS, the Mayor and Common Council of the City of San Bernardino (the "City Council"), approved and adopted the Redevelopment Plan pursuant to a duly enacted Ordinance on August 6, 1973; and WHEREAS, section 33333.6 of the California Community Redevelopment Law has established certain limitations on the 18 incurring and repaying of indebtedness and the duration of 19 20 21 which limitations redevelopment plans, apply to every redevelopment plan adopted on or before December 31, 1993; and 22 WHEREAS, section 33333.6 further provides that unless 23 a redevelopment plan adopted prior to January 1, 1994, already 24 contains limitations which comply with that Section, the 25 legislative body shall adopt an ordinance on or before December 26 31, 1994, to amend the redevelopment plan either 1) to amend an 27 existing time limit that exceeds the applicable time limit 28 - 1 - Me-no 1 established by that Section, or 2) to establish time limits that 2 do not exceed the provisions of that section. 3 4 BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 5 BERNARDINO, STATE OF CALIFORNIA, AS FOLLOWS: 6 7 section 1. The provisions of this Ordinance shall 8 supersede any prior amendments to the Redevelopment Plan. 9 10 section 2. A new section H is hereby added to the 11 Redevelopment Plan to read as follows: 12 13 Section H. Limitations 14 The provisions of this Redevelopment Plan shall be 15 effective for forty (40) years from the date of adoption of this 16 Redevelopment Plan. 17 18 The Agency shall not pay indebtedness or receive 19 property tax increment revenues pursuant to Health and Safety 20 Code section 33670 after ten (10) years from the termination of 21 the effective date of the Redevelopment Plan. 22 23 section 3. The City Clerk is hereby directed to 24 send a Certified copy of this Ordinance to the Agency. 25 26 section 4. Effecti ve Date. If any part of this Ordinance is held to 8 be invalid for any reason, such decision shall not affect the 9 validity of the remaining portion of this Ordinance and the City 10 Council hereby declares that it would have passed the remainder 11 of this Ordinance, if such valid portion thereof had been 12 deleted. 13 I I I section 5. Publication.
