ORDINANCE NO. 1984
AN ORDINANCE OF THE CITY OF SAN BERNARDINO PRESCRIBING RULES
AND REGULATIONS GOVERNING THE PLATTING AND SUBDIVISION OF LAND;
PROVIDING PENALTIES FOR THE VIOLATIONS THEREOF; DESIGNATING THE
CITY PLANNING COMMISSION AS THE ADVISORY AGENCY; AND REPEALING
ORDINANCE NO. 1589 AND ALL AMENDMENTS THERETO AND OTHER
ORDINANCES IN CONFLICT HEREWITH.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN AS FOLLOWS:

AUTHORITY

AUTHORITY
The authority for these regulation is derived from an act of
the Legislature of the State of California know as the
Subdivision Map Act as set forth in the Business and Professions
Code of California.

ADVISORY AGENCY
The City Planning Commission is hereby designated as the
ADVISORY AGENCY to the Mayor and Council on all matters related
to the subdivision of land.
1.30
PRINCIPLES AND PURPOSES
This ordinance shall have as its purposes the establishment and
enforcement of the following principles in the interes of
protecting the health, safety and general welfare of the people
of San Bernardino:
A. Effectuatin the objectives established for the
development of the City in the Master Plan, and
the Precise Plans based thereon.
B. Establishing standards for lot area and dimensions,
and the creation of reasonable building sites.
C. Providing standards for the construction and installation
of streets, roads, alleys, highways, public utilities and
other facilities.
D. Providing uniformity in street widths, proper street
alignment, and adequate means of ingress and egress to property.

SECTION 6
VARIANGES
CO~IDITIO!!S: It is realized that there are certain parcels of
land of such size and snape and sabject to such title restrictions,
or so affected by physical conditions that strict conformity with
the standards herein set forth wo!'11,' constitute a taking of land
without just compensation. The Co=ission may, therefore, grant
a variance perl:!i t 'd,len 0.11 or the fo110\Jing condi ti ons obtain:
A. That an undue hardsl1ip ,-rill be L-.lposed if all of the
standards set forth herein are complied with and that
such compliance would thus be unreasonable.
B. That the granting of the variance vlill not set a
precedent in any \Jay for other land and unlike conditions.
C.
That SUCi1 nerni t for variance \ilill not be detrimental
to the int~rests of tae c oummi ty as set forth in the
I!~ster Plan arl'! this ordinance.
D. That no variance be siven waich in any way violates

ordinance is, for any reason hold to be invalid or unconstitutional
by the decision of the court of competent jurisdiction, such
decision shall not affect t ,e v3J,i~lity of the remaining portions

passed this ordinance and eaCn section, subsection, sentence,
