HomeMy WebLinkAbout2503 ORDINANCE NO . 2503 AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDINANCE NO. 1984 ENTITLED IN PART "AN ORDINANCE OF THE CITY OF SAN BERNARDINO PRESCRIBING RULES AND REGULATIONS GOVERNING THE PLATTING AND SUBDIVIDING OF LAND . . ." AND MODIFYING PROCEDURES RELATING TO LOT SPLITS. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 2 3 4 5 6 SECTION ONE: Ordinance No. 1984 Section 5.10 Procedure 7 8 is hereby amended to read as follows: 5.10 PROCEDURE: When an owner or subdivider desires to 9 split one or more 10ts into not more than four (4) new lots and does not wish to record a subdivision map as provided by State law or by other sections of this ordinance, and when no dedication of streets, alleys or other public ways or easements are involved, 10 11 12 13 it shall be done in the following manner: A. An application for a lot split shall be filed on forms provided by the City; shall contain the names of the owners and shall be signed by the applicant. A uniform fee of Fifteen Dollars ($15.00) shall be paid to the City upon 14 15 16 17 18 the filing of each application to defray the costs and 19 expenses involved. 20 B. Three copies of a map showing the proposed split shall 21 be prepared by a registered civil engineer or licensed 22 23 surveyor and such maps shall be filed with the Planning Commission. The map shall show the exact dimensions and all other applicable matters required by this ordinance pertaining to tentative maps. C. Notices of a hearing before the Planning Commission on said application shall be posted at ten separate locations within a minimum radius of three hundred (300) feet of the property under consideration at least ten (10) days prior to said hearing. D. The decision of the Planning Commission shall be final 24 25 26 27 28 29 30 31 32 8 unless an appeal is taken to the Common Council. A written report of the decision of the Commission shall be immediate- ly filed with the Common Council and mailed to the applic- ant at the address shown on the application. The Plan- ning Commission decision shall not become effective for ten (10) days, during which time an appeal may be taken to the Council by the applicant or any person aggrieved by the Commission's decision. The Council may cause any Commission decision to be appealed.
