AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 226 (LAFC 707).

WHEREAS, heretofore, proceedings were initiated by the Common
5
Council of the City of San Bernardino, on its own motion, to annex to the
6
City of San Bernardino certain contiguous uninhabited territory hereinafter
7
described; and
8
WHEREAS, on the 21st day of April, 1969, a resolution was adopted
9
by the aforesaid Common Council of the City of San Bernardino, California,
10
declaring that proceedings had been initiated by said Council, and proposing
11
the annexation, for the reasons therein stated, of the aforementioned
12
uninhaibted territory to the City of San Bernardino, and that said resolution
13
provided that the proposed annexation should be generally known and
14
identified as Annexation District No. 226; and
15
WHEREAS, said resolution set forth therein that all the property
16
included in the aforesaid territory should be taxed equally with the other
17
property within the City to pay the bonded indebtedness and any and all
18
general indebtedness and liability of the City of San Bernardino contracted
prior to or existing or outstanding at the time of the aforesaid proposed
annexation of the aforesaid property as provided in the hereinbefore mentioned
Government Code; and
WHEREAS, said resolution did fix, determine and declare that a
hearing be held on the 2nd day of June, 1969, at the hour of 9:30 o'clock A. M.
in the Council Chambers of the City Hall in the City of San Bernardino, and
the same was the day, hour and place designated where any person owning real
estate within such territory so proposed to be annexed, and having any
objections to the proposed annexation, might object before the Common Council
and show cause why such territory should not be annexed; furthermore, the
said resolution provided that at any time not later than the said hour set,
as mentioned hereinbefore for the said hearing, any owner of property within
the said territory proposed to be annexed might file written protest with
the City of San Bernardino against such annexation; and

1 WHEREAS, no written protest of any kind or nature whatsoever were
2 filed with the City Clerk of the City of San Bernardino prior to 9:30 o'clock
3 A. M. on the 2nd day of June, 1969, and thereafter on the 2nd day of June,
4
1969, Resolution No. '7' Y-5}'
was adopted by the Mayor and Cornmon Council
5
declaring that a majority protest has not been presented; and
6
WHEREAS, it appears to the Cornmon Council of the City of San

Bernardino that the aforesaid annexation proceedings have been completed and

everything performed at this time in accordance with said Government Code,
as mentioned hereinbefore, and any and all other laws in any way connected
with the said annexation procedure having been complied with; and
WHEREAS, the Cornmon Council of the City of San Bernardino desire
to approve at this time the annexation of the aforesaid territory.
NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
SECTION ONE: That said territory herein described as Annexation
District No. 226 is hereby annexed and incorporated in and made a part of
the City of San Bernardino.
SECTION TWO: The territory herein referred to as being annexed to
the City of San Bernardino is particularly described as follows, to wit:
Those portions of Tracts No. 4825 as per plat recorded in
Book 61 of Maps, pages 46 and 47, Tract 3177 as per plat
recorded in Book 45 of Maps, pages 59 and 60, Wiggins Tract
as per plat recorded in Book 3 of Maps, page 74, all of
records of the County Recorder of San Bernardino County,
State of California, and those portions of Sections 17, 18,
19 and 20, Township 1 North, Range 4 West, and Section 13,
Township 1 North, Range 5 West, San Bernardino Meridian,
if said Section lines were extended across the Rancho
Muscupiabe as per plat recorded in Book 7 of Maps, page 23,
records of the County Recorder of said County, and those
portions of the adjoining streets, described as follows:
Beginning at a point on the Present Corporate Limits of the
City of San Bernardino, said point being the intersection
of the centerline of State Highway 395 and the centerline
of State Street as described in the deed to San Bernardino
County Flood Control District recorded February 28, 1945
in Book 1735, page 358, Official Records of said County;
thence Northerly along said City Limit line and along the
centerline of said State Street, a distance of 3670.00
feet, more or less, to the intersection with the Westerly
prolongation of the South line of Lot 143, Tract 3485 as
per plat recorded in Book 45 of Maps, page 82, records of
the County Recorder of said County; thence leaving said

the Easterly prolongation thereof, a distance of 400.00 feet
to the Southeast corner of Melbourne Road, 60.00 feet wide;

the said City Limit line; thence along said City Limit line
the following courses and distances; thence South along the
Southerly prolongation of the East line of said Lot 64, a
distance of 220.00 feet, more or less, to the South line
of said Tract 3177; thence West along said South line of
Tract 3177, a distance of 1137.00 feet, more or less, to
the Northeast corner of Parcel No. 1 as contained in the
Deed to Roven-Spiegel Co., Inc., a California corporation,
recorded October 27, 1955 in Book 3774, page 312, Official
Records of said County; thence South 410 29' West, 516.00

Railway Company's Right of Way and the Northerly prolongation
of Rancho Muscupiabe course 38; thence Northwesterly along
said Northeasterly Right of Way line of the Atchison, Topeka
and Santa Fe Railroad and leaving said City Limit line, a
distance of 10,614 feet more or less to the Southeasterly
line of that certain parcel described in the deed recorded

SECTION THREE: That the above described property will be subject
to taxation equally with the property within such municipal corporation to
pay its proportion of the following bonded indebtedness of the City of San
Bernardino, which said bonded indebtedness was outstanding or theretofore
authorized and is outstanding at the time of said annexation, to wit:
A bonded indebtedness of $490,000.00 incurred for the acquisition
and construction of a public library, including additions to and enlargements
of the public library system of said City, the outstanding indebtedness
thereon being $290,000.00, bearing interest at the rates of 4 3/4%, 3 1/4%
and 3 1/2% per annum;
A bonded indebtedness of $1,116,000.00 incurred for the acquisition
and construction of additions to, relocations of and replacements of the
fire fighting system of said City, the outstanding indebtedness thereon
being $865,000.00, bearing interest at the rates of 4%, 3%, 2 3/4%, 2.9%
and 2 1/2% per annum.

SECTION FOUR: The property herein annexed is declared to be a part
of Ward 5 and the boundaries of Ward 5 are hereby altered to include said
annexed territory, with zoning classifications as shown on a map filed in

the office of the City Clerk titled, "Exhibit A", and 'described as follows:

R-1-7200 Single Family Residential District:

Portions of Tract 4825, Tract 3177, Wiggins Tract, Muscupiabe
Rancho Tract, and portions of Sections 17, 18, 19 and 20,
Township 1 North, Range 4 West described as follows: All
that property located within the proposed annexation boundary
lying northeasterly of centerline of State Highway 395.

C-3A Limited General Commercial District:
Portions of Sections 18 and 19, Township 1 North, Range 4
West, described as follows: Beginning at the intersection
of the north line of State College Parkway with the east
line of the A.T. & S.F. Railroad right of way; thence in a
northwesterly direction along the east right of way line
of the A.T. & S.F. Railroad right of way a distance of
1300 feet; thence north approximately 70 degrees East 996.95
feet, more or less, to an intersection with the north right
of way line of State College Parkway and point of beginning;
thence northeasterly along the north right of way line of
State College Parkway 550 feet, more or less, to the west
right of way line of State Highway 395 off-ramp; thence
generally in a northwesterly direction along the west right

College Parkway and the southerly line of State Highway 395
to a point in the east line of Section 19, said point
approximately 150 feet north of the point of beginning;

M-1A Limited Light Manufacturing Industrial District:
