2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 263 (LAFC 966).

WHEREAS, heretofore, proceedings were initiated by the Common
5 . Council of the City of San Bernardino, on its own motion, to annex to the
6 City of San Bernardino certain contiguous uninhabited territory hereinafter
7 described; and
8 WHEREAS, on the 8th day of March, 1971, a resolution was adopted
9 by the aforesaid Common Council of the City of San Bernardino, California,
10 Qeclaring that proceedings had been initiated by said Council, and proposing
11 the annexation, for the reasons therein stated, of the aforementioned
12 uninhabited territory to the City of San Bernardino, and that said resolution
13 provided that the proposed annexation should be generally known and identified
14 as Annexation District No. 263; and
15 WHEREAS, said resolution set forth therein that all the property
16 inc luded in the aforesaid territory should be taxed equally with the other
17 property within the City to pay the bonded indebtedness and any and all general
18 indebtedness and liab ility of the City of San Bernardino contracted prior to
19 or existing or outstanding at the time of the aforesaid proposed annexation
20 of the aforesaid property as provided in the hereinbefore mentioned Government
21 Code; and
22 WHEREAS, said resolution did fix, determine and declare that a
23 I hearing be held on the 19th day of April, 1971, at the hour of 9:30 o'clock
24 A. M., in the Council Chambers located in the Garner Building, 392 Court Street,
25 San Bernardino, California, and the same was the day, hour and place designated
26 where any person owning real estate within such territory so proposed to be
27 annexed and having any objections to the proposed annexation, might object
28 'before the Common Council and show cause why such territory should not be
29 annexed; furthermore, the said resolution provided that at any time not later
30 than the said hour set, as mentioned hereinbefore for the said hearing, any
31 owner of property within the said territory proposed to be annexed might file
32 written protest with the City of San Bernardino against such annexation; and

WHEREAS, there were ~~ritten protests filed with the City Clerk of
2 the City of San Bernardino prior to 9:30 o'clock A M., on April 19, 1971; and
3 thereafter, on the 19th day of April, 1971, Resolution No. /0 7/.y was
4 adopted by the Mayor and Common Council declaring that a majority protest has
5 not been presented; and
6 WHEREAS, it appears to the Common Council of the City of San
7 Bernardino that the aforesaid annexation proceedings have been completed and
8 everything performed at this time in accordance with said Government Code, as
9 mentioned hereinbefore, and any and all other laws in any way connected with
10 the said annexation procedure having been complied with; and
11 WHEREAS, the Common Council of the City of San Bernardino desires to
12 approve at this time the annexation of the aforesaid territory.
13 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
14 BERNARDINO DO ORDAIN AS FOLLOWS:

SECTION ONE: That said territory herein described as Annexation
16 I District No. 263 is hereby annexed and incorporated in and made a part of the
17 City of San Bernardino.
SECTION TWO: The territory herein referred to as being annexed to
19 the City of San Bernardino is particularly described as follows: to wit:

Lots 100, 101, 134, and those portions of Lots 135 and 136,
Tract No. 2243 as per plat thereof recorded in Book 32 of
Maps, Pages 21 and 22 records of the County Recorder of
San Bernardino County, State of California, and those por-
tions of the adjoining streets, described as follows:
Beginning at a point on the present corporate City Limit
Line of the City of San Bernardino, said point being at
the intersection of the center lines of California Avenue
and Porter Street as said streets are delineated on the
Map of said Tract No. 2243; thence westerly along said
center line of Porter Street, a distance of 289 feet more
or less to the Southerly prolongation of the West line of
said Lot 101; thence North along said Southerly prolonga-
tion and said West line of Lot 101 and the West line of
said Lot 134 and the Northerly prolongation thereof, 660
feet more or less to the center line of Mallory Street;
thence East along said center line of Mallory Street, a
distance of 54 feet more or less to the intersection with
the Southerly prolongation of the East line of that certain
parcel described in the deed to Earl E Aubrey et-ux
recorded March 30, 1956, Document No. 376 in Book 3899,
Page 289 Official Records of said County; thence North
along said Southerly prolongation and said East line of
Aubrey's property, a distance of 369.36 feet more or less

to the South line of that certain parcel described in the
deed to Alberta Dawson, an unmarried woman recorded Decem-
ber 19, 1967 in Book 6943, Page 902 Official Records of
said County; thence West along said South line, a distance
of 95 feet more or less to the West line of said Lot 136;
thence North along said West line, a distance of 290.64
feet more or less to the Northwest corner of said lot 136;
thence East along the North line of said lot 136 and the
Easterly prolongation thereof, a distance of 330 feet more
or less to said center line of California Avenue, said center
line being also the corporate City Limit Line of said City;
thence following said City Limit Line the following courses
and distances; South 890.00 feet more or less to an angle
point; thence West, a distance of 146 feet more or less to
an angle point; thence South 100 feet to an angle point;
thence East 146 feet to an angle point, said point being
on said center line of California Avenue; thence continuing
South along said center line, a distance of 330 feet more or
less to the Point of Beginning.

Containing approximately 8.30 acres.

SECTION THREE: That the above described property will be subject
13 to taxation equally with the property within such municipal corporation to
14 pay its proportion of the following bonded indebtedness of the City of San
15 Bernardino, which said bonded indebtedness was outstanding or theretofore
16 authorized and is outstanding at the time of said annexation, to wit:
17 A bonded indebtedness of $490,000.00 incurred for the acquisition
18 and construction of a public library, including additions to and enlargements
19 lof the public library system of said City, the outstanding indebtedness
20 thereon being $240,000.00, bearing interest at the rates of 4-3/4%, 3-1/2%
21 and 3-1/4% per annum;
22 A bonded indebtedness of $1,116,000.00 incurred for the acquisition
23 and construction of additions to, relocations of and replacements of the fire
24 fighting system of said City, the outstanding indebtedness thereon being
25 $765,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2%
26 per annum..

SECTION FOUR: The property herein annexed is declared to be a part
28 of Ward 6, and the boundaries of Ward 6 are hereby altered to include said
29 annexed territory, with zoning classification of R-1-7200 Single Family Resi-
dential zoning district.

SECTION FIVE:
That the area included in the above annexation is
32 hereby detached from County Service Area No. 70 and from the Muscoy Fire
II Protection District.
