HomeMy WebLinkAbout2323ORDINANCE NO. 2323 AN ORDINANCE OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION TO THE CITY OF SAN BERNARDINO OF CERTAIN INHABITED TERRITORY DESIGNATED AS "ANNEXA- TION DISTRICT NO. 129", UPON THE TERMS CONTAINED IN THE QUESTION SUBMITTED AT A SPECIAL ELECTION HELD IN SAID TERRITORY ON THE THIRTEENTH DAY OF SEPTEMBER, 1960. WHEREAS, pursuant to the provisions of an Act of the Legislature of the State of California, known as the "Annexation Act of 1913", and pursuant to Ordinance No. 2311, adopted by the Mayor and Common Council of the City of San Bernardino on the 25th day of July, 1960, a special election was held on the 13th day of September, 1960, in that certain inhabited territory contiguous to the City of San Bernardino designated as "Annexation District No. 129", and which is hereinafter more particularly described; and WHEREAS, at said special election the following question was submitted to the qualified electors residing in said territory: SHALL ANNEXATION DISTRICT NO. 129 BE ANNEXED TO, INCORPORATED IN AND MADE A PART OF THE CITY OF SAN BERNARDINO AND THE PROPERTY IN SUCH TERRITORY BE, AFTER SUCH ANNEXATION, SUBJECT TO TAXATION EQUALLY WITH THE PROPERTY WITHIN THE CITY OF SAN BERNARDINO, TO PAY ITS PRO-RATA PORTION, BASED UPON ASSESSED VALUATION OF ALL BONDED INDEBTEDNESS OF THE CITY OF SAN BERNARDINO OUTSTANDING AT THE DATE OF THE FIRST PUBLICATION OF THE NOTICE OF ELECTION FOR ANNEXATION? WHEREAS, it appears from the canvass of the returns of the votes cast at said special election that a majority of all votes cast in said territory on the question of said annexation and the assumption of said indebtedness favor annexation upon the terms contained in the question submitted; and WHEREAS, it appears that said special election and all proceedings relating thereto have been conducted strictly in accordance with law; NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAl N AS FOLLOWS: SECTION ONE: That the annexation of that certain inhabited territory 28 " 29 contiguous to the City of San Bernardino designated as "Annexation District /~ No. 129" be and the same is hereby approved upon the terms contained in the 30 aforesaid question which was submitted at the special election held on the 31 13th day of September, 1960. Said territory is described as follows: '; '.i h ~ , 32 ., , ., j ,. ~'l~,~,,,, 12 13 14 15 16 17 18 19 II 20 21 22 23 24 25 26 27 28 29 30 31 32 E~~~";I'l<""';'e; . . 2 All that portion of Lot 8, Block 58 of the Rancho San Bernardino, as per plat recorded in Book 7 of Maps at Page 2, Records of the County Recorder of San Bernardino County, described as follows: 3 4 Beginning at a point on the present corporate limits of the City of San Bernardino, said point being the Northwest corner of Lot 14, Tract No. 1711, Norton Little Farms, as per plat recorded in Book 25 of Maps at Page 27, Records of the County Recorder of San Bernardino County; thence Southerly along the West line and the Southerly prolongation of the West line of said Lot 14, being along the present corporate limits of the City of San Bernardino, to the center line of Nineteenth Street; thence Westerly along the center line of Nineteenth Street to the center line of California Street; thence Northerly along the center line of California Street to the center line of Highland Avenue; thence Easterly along the center line of Highland Avenue to the Northerly prolongation of the East line of that parcel of land conveyed to Charles S. Colquhoun and Alice L. Colquhoun by Deed recorded in Book 1950, page 329, Official Records of the County Recorder of San Bernardino County, said East line being 380 feet West of the East line of said Lot 8; thence Southerly along the Northerly prolongation of the East line and the East line of said Colquhoun parcel to the point of beginning. 5 6 7 8 9 10 II SECTION TI,O: The City Clerk shall certify to the adoption of this ordinance and cause the same to be published three consecutive days, exclusive of holidays, in the San Bernardino Evening Telegram, a newspaper of general circulation in the City of San Bernardino. SECTION THREE: The property herein annexed is declared to be a part of Ward 5 and the boundaries of Ward 5 are hereby altered to include said annexed territory; and said property is placed and declared to be in R-l Single Family Residential Zone, except of the following described area, which is to be admitted to the City in a C-3A General Limited Commercial Zone: Beginning at the intersection of the south line of Highland Avenue and the east line of California Street, thence east along the south line of Highland Avenue 883.45 feet, more or less, thence south parallel to the east line of California Street to the north line of 19th Street, thence west 218 feet, more or less, thence north to a point 299.48 feet, more or less, south of the south line of Highland Avenue, said point being on the north line of the proposed Highland Avenue Freeway, thence west along said line to the east line of California Street, thence north to the point of beginning, excepting that portion with the Highland Avenue Freeway Right-of-way.
