2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 265 (LAFC 980).

4 WHEREAS, heretofore, proceedings were initiated by the Common
5 Council of the City of San Bernardino, on its own motion, to annex to the
6 City of San Bernardino certain contiguous uninhabited territory hereinafter
7 described; and
8 WHEREAS, on the 5th day of April, 1971, a resolution was adopted
9 by the aforesaid Common Council of the City of San Bernardino, California,
10 declaring that proceedings had been initiated by said Council, and proposing
11 the annexation, for the reasons therein stated, of the aforementioned
12 uninhabited territory to the City of San Bernardino, and that said resolution
13 provided that the proposed annexation should be generally known and identified
14 as Annexation District No. 265; and
15 WHEREAS, said resolution set forth therein that all the property
16 included in the aforesaid territory should be taxed equally with the other
17 property within the City to pay the bonded indebtedness and any and all general
18 indebtedness and liability of the City of San Bernardino contracted prior to
19 or existing or outstanding at the time of the aforesaid proposed annexation
20 of the aforesaid property as provided in the hereinbefore mentioned Government
21 Code; and
22 WHEREAS, said resolution did fix, determine and declare that a
23 hearing be held on the 17th day of May, 1971, at the hour of 9:30 o'clock
24 A. M., in the Council Chambers located in the Garner Building, 392 Court Street,.
25 San Bernardino, California, and the same was the day, hour and place designated
26 where any person owning real estate within such territory so proposed to be
27 annexed and having any objections to the proposed annexation, might object
28 before the Common Council and show cause why such territory should not be
29 annexed; furthermore, the said resolution provided that at any time not later
30 than the said hour set, as mentioned hereinbefore for the said hearing, any
31 owner of property within the said territory proposed to be annexed might file
32 written protest with the City of San Bernardino against such annexation; and

6 WHEREAS, it appears to the Common Council of the City of San
7 Bernardino that the aforesaid annexation proceedings have been completed and
8 everything performed at this time in accordance with said Governme~ Code, as
9 mentioned hereinbefore, and any and all other laws in any way connected with
10 the said annexation procedure having been complied with; and
11 WHEREAS, the Common Council of the City of San Bernardino desires to
12 approve at this time the annexation of the aforesaid territory.
13 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
14 BERNARDINO DO ORDAIN, AS FOLLOWS:

SECTION ONE: That said territory herein described as Annexation
16 District No. 265 is hereby annexed and incorporated in and made a part of the
17 City of San Bernardino.

SECTION TWO: The territory herein referred to as being annexed to
19 the City of San Bernardino is particularly described as follows, to wit:
20 That portion of POPE TALBOT AND PIERCE ADDITION as per plat
thereof recorded in Book 11 of Maps, Page 38, records of the
21 County Recorder of San Bernardino County, State of California,
and that portion of Tract 2243 as per plat thereof recorded in
22 Book 32 of Maps, Pages 21 and 22, records of said County and
that portion of Tract 2353 as per plat thereof recorded in Book
23 33 of Maps, Pages 66 and 67, records of said County, described
as follows:

Beginning at a point on the corporate City Limit Line of the
City of San Bernardino, said point being the intersection of
the center lines of Highland Avenue and Macy Street; thence
North along said center line of Macy Street and along said City
Limit Line, a distance of 675 feet more or less to the Westerly
prolongation of the center line of Adams Street as said Street
is delineated on the plat of said Tract 2243; thence leaving
said City Limit line, Easterly along said Westerly prolongation
and said center line of Adams Street a distance of 431.89 feet
more or less to the Northerly prolongation of the West line of
Lot 13 of said Tract 2243; thence Southerly along said Northerly
prolongation and said West line, a distance of 272.34 feet more
or less to the Northeasterly line of said Lot 15 of said POPE
TALBOT AND PIERCE ADDITION; thence Southeasterly along said
Northeasterly line, a distance of 81.92 feet, to a point, said
point being also the Northwest corner of Lot 11 of said Tract

and 8 of said Tract 2243 and the Easterly prolongation thereof,
a distance of 850 feet more or less to the center line of State
Street; thence South along said center line of State Street, a
distance of 950 feet more or less to the Easterly prolongation
of the South line of State Highway as delineated on the right of
way map number 905523, on file in the Division of Highways, State
of California, District 8, Route 30, Post Miles 21.3-21.5 sheet
1 of 6; thence Westerly along said Easterly prolongation and said
South line, a distance of 1320 feet more or less to the center
line of said Macy Street; thence North along said center line of
Macy Street, a distance of 350 feet more or less to the Westerly
prolongation of the South line of that certain parcel described
in the deed to Gulf Oil Corporation recorded November 22, 1965,
Document No. 41 in Book 6517, Page 290 Official Records of said
County; thence East along said Westerly prolongation and said
South line, a distance of 180 feet more or less to the East line

SECTION THREE: That the above described property will be subject
to taxation equally with the property within such municipal corporation to
pay its proportion of the following bonded indebtedness of the City of San
Bernardino, which said bonded indebtedness was outstanding or theretofore
authorized and is outstanding at the time of said annexation, to wit:
A bonded indebtedness of $490,000.00 incurred for the acquisition
and construction of a public library, including additions to and enlargements
of the public library systems of said City, the outstanding indebtedness
thereon being $240,000.00, bearing interest at the rates of 4-3/4%, 3~1/2%
and 3-1/4% per annum;
A bonded indebtedness of $1,116,000.00 incurred for the acquisition
and construction of additions to, relocations of and replacements of the fire
fighting system of said City, the outstanding indebtedness thereon being
$765,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2%
per annum.
SECTION FOUR: The property herein annexed is declared to be a part
of Ward 6, and the boundaries of Ward 6 are hereby altered to include said
annexed territory, with zoning classification of C-3A Limited General
Commercial zoning district.
SECTION FIVE: That the area included in the above annexation is
