HomeMy WebLinkAbout2804 1 2 :3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 2.3 24 25 26 27 28 29 30 i I 31 I I I 32 i I I i II !I NOTICE OF ELECTION ORDINANCE NO. o1J''''~ AN ORDINANCE OF THE CITY OF SAN BERNARDINO CALLING A SPECIAL ELECTION TO BE HELD ON THE SECOND DAY OF MAY, 1967, PERTAINING TO THE ANNEXATION OF A DISTRICT CALLED: "ANNEXATION DISTRICT NO. 188" WHEREAS, by Resolution, the Mayor and Common Council of the City of San Bernardino declared its intention to calVac~pecial election to be held in certain inhabited territory contiguous to said City proposed to be annexed to said City, for the purpose of submitting to the qualified electors residing in said territory the question whether or not said territory shall be annexed to said City; and WHEREAS, a copy of said Resolution was published as required by law; and WHEREAS, at a time not later than the hour set by said Resolution for hearing objections to the proposed election, no written protests were made by the owners of one-half of the value of the territory proposed to be annexed, as shown by the last equalized assessment roll of the property within the territory proposed to be annexed; and WHEREAS, thereafter on the 27th day of February, 1967, Resolution No. 8560 was adopted by the Mayor and Common Council declaring that a majority protest has not been presented; and WHEREAS, all proceedings have been had in accordance with said Resolutions and the Annexation Act of 1913, reference thereto hereby being made for further particulars. NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION ONE: A special election hereby is called, to be held on the 2nd day of May, 1967, in the territory hereinafter described and proposed to be annexed to the City of San Bernardino, for the purpose of submitting to the qualified electors residing in said territory the question whether or not such territory shall be annexed to, incorporated in and made a part of said City of San Bernardino, and whether or not the property in said territory shall, after such annexation, be subject to taxation equally 1 2 :3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 2.3 24 25 26 27 28 29 30 31 , 32 I I with the property within the City of San Bernardino to pay the entire bonded indebtedness of the City of San Bernardino outstanding at the date of the first publication of the notice of election for annexation. Said territory is described as follows: Those portions of Lots 5 and 7, Block 47, Rancho San Bernardino as per plat thereof recorded in Book 7 of Maps, Page 2, and that portion of Tract No. 3309 as per plat thereof recorded in Book 44 of Maps, Page 100, records of the County Recorder of San Bernardino County, State of California, described as follows: Beginning at a point on the Present Corporate limits of the City of San Bernardino, said point being in the center line of Central Avenue, 82.50 feet wide and being a distance of 426.00 feet East of the centerline of Tippecanoe Avenue and also being the Southeast corner of Annexation No. 179 to the City of San Bernardino; thence along said City Limit line the following courses and distances; thence North along the East line of Lots 5, 6, 7, 8, 9, 10, and 11 and the Northerly prolongation thereof a distance of 794.41 feet, more or less, to the centerline of Sullivan Street 50.00 feet wide; thence West along the centerline of said Sullivan Street to the centerline of Tippecanoe Avenue; thence North along the centerline of Tippecanoe Avenue to its intersection with the Easterly prolongation of the North line of Lot 1, Block 46, said Rancho San Bernardino; thence West along said Easterly prolongation to the West line of Tippecanoe Avenue and the Southeast corner of Lot 14, Block 46, said Rancho San Bernardino; thence Northerly along the East line of said Lot 14 and the West line of Tippecanoe Avenue to the Northeast corner of Lot 14, Block 46, said Rancho San Bernardino; thence continuing Northerly to the Southeast corner of Lot 1, Block 45, said Rancho San Bernardino, said point also being on the North line of Mill Street; thence East along said North line and the South line of Lot 6, Block 48, said Rancho San Bernardino, to its intersection with the Northerly prolongation of the West line of Lot 8, said Block 47; thence South along said Northerly prolongation and the West line of Lot 8, said Block 47, to the Southwest corner thereof; thence East along the South line of said Lot 8 to the Southeast corner thereof, being also the Northwest corner of Lot 4, said Block 47; thence South along the West line of said Lot 4 to the Southwest corner thereof; being also on the North line of Central Avenue; thence leaving said City Limit line, South along the Southerly prolongation of said West line of Lot 4 to the centerline of Central Avenue 82.50 feet wide; thence West along the centerline of said Central Avenue to the point of beginning. SECTION TWO: TIME OF OPENING AND CLOSING OF POLLS. The polls at said election shall be opened at 7:00 o'clock A. M. of the day herein fixed for the holding of said election and shall be kept open until 7:00 o'clock P. M. of the same day, when the polls shall be closed. - 2 - 1 11 SECTION THREE: BALLOTS. Upon the ballots to be used at said 2 election there shall be printed the words: ;5 SHALL ANNEKATION DISTRICT NO. 188 BE ANNEKED TO, INCORPORATED IN 4 AND MADE A PART OF THE CITY OF SAN BERNARDINO AND THE 'l'IlflPER.'rYc. IN SUCH 5 TERRITORY BE, AFTER SUCH ANNEXATION, SUBJECT TO TAXATION EQUALLY WITH THE 6 PROPERTY WITHIN THE CITY OF SAN BERNARDINO, TO PAY ITS PRO-RATA PORTION, 7' BASED UPON ASSESSED VALUATION OF ALL BONDED INDEBTEDNESS OF THE CITY OF 8 SAN BERNARDINO OUTSTANDING AT THE DATE OF THE FIRST PUBLICATION OF THE 9 NOTICE OF ELECTION FOR ANNEKATION? 10 Opposite these words there shall be printed the words "YES" and 11 "NO", and to the right of each of these last two words there shall be a 12 voting square. If an elector shall stamp a cross (+) in the voting square 13 14 1511 I I, 16 17 18 19 20 after the printed word "YES", the vote of such elector shall be counted in favor of the annexation of said territory to the City of San Bernardino, and if an elector shall stamp a cross (+) in the voting square after the printed word "NO", the vote of such elector shall be counted against such annexation. In all particulars not herein recited, said election shall be held in conformity as near as may be with the laws of the State of California concerning general elections and with said Annexation Act of 1913. SECTION FOUR: For purpose of said election there hereby is 21 established in the territory described herein one (1) consolidated voting 23 22 precinct which shall include all of said territory.
