AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF 'mE CITY OF SAN
BERNARDINO, APPROVING 'mE ANNEXATION OF DISTRICT, NO. 118.
WHEREAS, heretofore a petition was filed with the Common Council of
the City of San Bernardino requestl'ng that certain uninhabited territory
contiguous to said City be annexed to the City of San Bernardino and which
said petition described said territory and the boundaries thereof proposed to
be annexed to the City; and
WHEREAS, said petition was filed by the owners of not less than
one-fourth of the area of land in suc~ territory and 'representing not less
than one-fourth of the assessed value of such territory according t>> the last
preceding equali~ed assessment roll of the County of San Bernardino, in which
said County the City of San Bernardino is situated; and
WHEREAS, said petition requested said territory to be annexed to
and included in the said muniCipal corporation, in accordance with the pro-
visions of the Government Code, Section 35300. et seq.; and
WHEREAS, on the 9th day of March, 1959, a Resolution was adopted by
the aforesaid Common Council of ,the City of San Bernardino, California~ pro-
posing the annexation of the aforesaid uninhabited territory to be generally
known as A~TION DISTRICT NO. 118 to the City of San Bernardino, and that
said Resolution provided therein that the proposed annexation Should be
generally known and identified as ANNEXATION DISTRICT NO. 118; and
WHEREAS, said Resolution set forth therein that all the property
included in the aforesaid territory should be taxed equally with the other
property within the said City to pay the bonded indebtedness and any audall
general indebtedness and liability of the City of San Bernardino, contracted
prior to or existing or outstanding at the time of the aforesaid proposed,
annexation of the aforesaid property, as provided in thll hereinbefore mentione
Government Code; and
WHEREAS, the saiu'Resolution ,did fix, determine and declare that a.
hearing be held on the 20th day of April, 1959, at the hour of 7:30 o'clock
P.M., in the Council Chambers of the, City Hall in ,tile City of San Bernardino,

and the same was the day, hour and place designated where any person owning

real estate within such territory so proposed to be annexed and having any
objections to the proposed annexation might object before the Common Council

and show cause why such territory should not be annexed, and furthermore, the
5
said Resolution provided that at any time not later than the said hour set,
6
as mentioned hereinbefore for the said hearing, any owner of property within
the said territory proposed to be: annexed might file written protest with the

City of San Bernardino against such annexation; and
9
WHEREAS, no objections or protests of any kind or nature whatsoever
were made or filed, either wr~tten or oral, wi th the said Ci ty of San Bernar~
dino, and no protests or objections of any nature whatsoever were made, either
written or oral, at the meeting of the_ Common Council on the 20th day of
April, 1959, as mentioned hllreinbefore, at which said meeting the said Common
Council publicly anilounce!i that any person,firnror corporation desiring to
protest or object ~O said annexation might do s~ at said meeting; and
WHEREAS, it appears to the Common C.ouncil oft.he. City of San Bernar~
dino that the aforesaid anllliul:lIt,ionproceedings have been completed and every-
thing performed at this time in accordance with said Government Code, as
mentioned hereinbefore, and any and all other laws in any way connected with
the said annexation procedure having been complied with: and
WHEREAS.. the Common Council of the City of San Bernardino desire to
approve at this time the annexation of the aforesaid territory.

SECTION ONE: That said territory as. herein describt/d as Annexation
Disttict No, 118 is hereby annexed and incorporated in and made a part of the
City of San Bernardino.
SECTION TWO: The territory ht/rein referred to as being annexed to
the City of San Bernardino isparticu1arly described as follows, to wit:
All that portion of Section 19, TownShip 1 North, .Range 3
West. San Bernardino Base andMeridian,and SectiOn 24,
Township 1 North, Range 4 West, San Bernardino Base and
Meridian described as follow.s:

Beginning at a point in the present corporate limits of
the City of.San Bernardino, said point being the North-
west corner of said Section 19; thence Easterly along the
North line of said Section 19 to the Northeast corner of
said Section 19: thence Southerly along the East line of
said Section 19 to the' South line of the Northeast quarter
of said Section 19; thence Westerly along the South line
of the Northeast quarter of said Section 19 to a point
lying 668.87 feet East of the center of said Section 19;
thence South 0004' East. 1522 feet. more or less, parallel
to and 1982.70 feet distant:. from the East line of said
Section 19; thence South 60012' East, 31.6 feet, more or
less, to the most Northerly Northeast corner of the prop~
erty deeded to Walter Nelson, et ux, by deed recorded
January 5. 1944 in Book 1644 of Official Records. page
488, Records of the County Recorder of San Bernardino
County; thence Westerly along the Northerly line of the
said deed the following courses and distances, South
73008', West 141 feet; thence North 83012' West 151 feet;
thence North 66032' West 343 feet; thence North 82032'
West, 133 feet torthe Northwest corner of the said prop-
erty described in said deed, being a point on the West
line of the Southeast quarter of said section 19; thence
Southerly along said line to the Southeast corner of Lot
1 of the Canterbury Subdivision of the Fractional South-
west Quarter of said Section 19,as per plat recorded in
Book 8 of Maps, page 80, Records of the County Recorder
of San Bernardino County; thence Northwesterly along the
South line of said Subdivision to Station M-33, as shown
on plat of the Muscupiabe Rancho, recorded in Book 7 of
Maps at page 23, Records of the County Recorder of San
Bernardino County; thence North 450 West along the North
line of the said Muscupiabe Rancho to a point on the
present corporate limits of said City of San Bernardino,
said point being on the West line of said Section 19;
thence North 450 West along the said MuscupiabeRancho
line, being along said present corporate limits. to
Station M~32 as shown on said plat of the Muscupiabe
Rancho; thence North 52030' West along the North line of
the said Muscupiabe Rancho being along the said present
corporate limits to the Southwest corner of Government
Lot 1 of said Section 24; thence Noriherly along the West
line of said Government Lot I, being along the said present
corporate limits. to a point lying 1066.7 feet South of
the Northwest corner of said Government Lot 1; thence
North 37052' East for a distance of 760.03 feel, more or
less, along the said present corporate limits, to a point
466.7 feet East of the West line of said Government Lot I,
said point 'also being 466.7 feet South of the North line
of said Section 24; thence Northerly and parallel to the
West line of said Government Lot I, being along the said
present corporate limits, 466.7 feet, to the North line
of said Section 24; thence Easterly along ihe North line

The basis of bearing is the East line of Section 19, Town-
ship 1 North, Range 3 West, San Bernardino Base and Meri-
dian being South 0004' East and Course No. 32 as shown
on said plat of the Muscupi;Jbe Rancho, being South 450
East.

SECTION THREE: That the above described property will be subject to

taxation equally with the property within such municipal corporation, to pay

its proportion of the following bonded indebtedness of the City of San Bernar-
5
dino, which said bonded indebtedness was outstanding at the time of filing
said petition, or theretofore authorized and is outstanding at the time of
6
said annexation, to wit:

A bonded indebtedness of $200,000.00 incurred for the construction
8
and completion of a convention hall, the outstanding indebtedness thereon bein~
$15,000,00, bearing interest at the rate of 5% per annum;
A bonded indebtedness of $275,ooO.0<l incurred for the acquisition
9
and construction of water works, including ~Devil Canyon Water Works., water

rights, rights of way, pipe lines, wells and pumping plants, the outstanding
indebtedness thereon being $41,250.00, bearing interest at the. rate of 5%

per annum;

A bonded indebtedness of $490,000.00 incurred for the acquisition
and construction of a public library, including additions to and enlargements
of the public library system of .said CHY._ the outstanding indebednesss
thereon being $490,000.00, bearing interest at. the rates of 4-3/4%, 3-1/4%
and 3-1/2'~ per annum.
SECTION FOUR: The property herein annexed is declared to be a part

of Ward 4, and the boundaries of Ward 4 are hereby altered to include said

annexed territory: and said property is placed and declared to be in R-l,
Single Family Residential Zone.

SECTION FIVE: The City Clerk shall certify to the passage of this
25
ordinance and shall cause the same to be published three consecutive times
in the San Bernardino Evening Telegram, a daily newspaper designated for that
26

purpose.

I HEREBY CERTIFY that the foregoing ordinance was duly adopted by

the Mayor and Common Council of the City of San Bernardino at an adjourned
