AN ORDINANCE OF 'TIlE MAYOR AND COMMON COUNCIL OF 'TIlE CITY OF SAN
BERNARDINO, AYPROVING THE ANNEXATION OF DISTRICT NO. 116.
WHEREAS, heretofore proceedings were initiated by the Common Council
of the City of San Bernardino, on its own motion, to annex to the City of San
Bernardino certain contiguous uninhabited territory hereinafter described; and
WHEREAS, on the 2nd day of February, 1959, a resolution was adopted
by the aforesaid Common Council of t.he City of San Bernardino, California,
declaring that proceedings had been initiated by said Council and proposing
the annexation for the reasons therein stated of the aforementioned uninhabited
territory to be generally known as Annexation District No. 116 to the City of
San Bernardino, and that said resolution provided that the proposed annexation
should be generally known and identified as AnnexatiOn District No. 116; and
WHEREAS, .said resolution set forth therein that all the property
included in the aforesaid territory should be taxed equally with the other
property within the said City to pay the bonded indebtedness and any and all
general indebtedness and liability of the City of San Bernardino contracted
prior to or existing 'or' outstanding at the time of the aforesaid proposed
annexation of the aforesaid property, as provided in the hereinbefore mentioned
Government Code; and
WHEREAS,said resolution did fix, determine and declare that a hearing
be held on the 16th day of March, 1959, at the ho~r of 7:30 o'clock p. M.,
in the Council Chambers of the City Hall in the City of San Bernardino, and
the same was the day, hour and place designated where any person owning real
estate within such territory so proposed to be annexed and hav,ing any ob-
j ection to the proposed annexation might obj ect before the Common Council and
show cause why such territory should not, be annexed, and furthermore, the said
resolution provided that at any time not later. than the hour set, as mentioned
hereinbefore for the said hearing, any owner of property within the said
territory proposed to be annexed might file written protest with the City of
San Bernardino against such annexation; and
WHEREAS, at said meeting of the Common Council on the 16th day of

1 March, 1959, in response to the public announcement of the said Common Council
2 that any person, firm or corporation desiring to protest or object to said
3 annexation might do so, one property owner, owning less than one-half of the
4 last assessed ~aluation of the territory proposed to be annexed, personally
5 objected and filed protest in writing to the proposed annexation; and
6 WHEREAS, said written protest and oral objections of the said one
7 property owner was overruled by the Common Council at said meeting as not being
8 made by owners of one-half of the last assessed value of the territory proposed
9 to be annexed as required by Section 35313 of the Goyernment Code; and
10 WHEREAS, it appears to the Common Council of the City of San Bernar-
11 dino that the aforesaid annexation proceedings have been completed and every-
12 thing performed at this time in accordance with said Government Code, as
13 mentioned hereinbefore, and any and aU other laws in any way connected with
14 the said annexation procedure having been complied with; and
15 WHEREAS, the Common Council of the City of San Bernardino desire to
16 approve at this time the annexation of the aforesaid territory.
17 NOW, mEREFORE, mE COMMON COUNCIL 01' THE CITY 01' SAN BERNARDINO DOES

SECTION ONE: That said territory as herein described as Annexation
20 District No, 116 is hereby annexed and incorporated in and made a part of the
21 City of San Bernardino.
SECTION Tl\U: The territory herein referred to as being annexed to

23 the City of San Bernardino is particularly described as follows, to wit:

All that Portion of Orange Grove Tract as per plat thereof
recorded in book 11 of Maps, page 14, Records of the County
Recorder of San Bernardino County, described as follows:

Beginning at a point on the North line of Highland Avenue,
82.5 feet wide, said point being the Southeast corner of
Annexation District No. 58 of the City of San Bernardino;
thence Westerly along the North line of said Highland
Avenue, being also along the present corporate limits of the
City of San Bernardino to the most Northeasterly corner of
Annexation District No, 17; thence Southerly along the
present corporate limits of the City of San Bernardino, to
the Southwest corner of Lot 3, Block 6 of said Orange
Grove Tract; thence Easterly along the present corporate
limits of the City of San Bernardino, to the Northeast
corner of Block 5, said Orange Grove Tract; thence Southerly
along the present corporate limits of the City of San

SECTION TIlREE: Tbat tbe above described property will be subtlect to
taxation equally with the property witbin sucb municipal corporation, to pay
its proportion of tbe following bonded indebtedness of tbe City of San Bernar~
dino. wbicb said bonded indebtedness was outstanding at the time of filing
said petition or tberetofore autborized and is outstanding at tbe time of said
annexation. to wit:

completion of a convention ball. tbe outstanding indebtedness tbereon being
