HomeMy WebLinkAbout2366 . . ~ 1 ORDIN.t\NCE NO. -:?...-:}C 6 AN ORDINANGE OF THE MAYOR AND COMMQN COUNCIL OF THE CITY OF SAN BERN~lNO APPROVING THE <WNE;ATION OF DISTRicT NO. 136. 2 3 4 WHEREAS, heretofore, a petition was filed with the Common Council of 5 the City of San Bernardino requestirig that certain uninhabited territory 6 contiguous to said City be annexed to the City of San Bernardino, and ",hich' 7 said petition d.escribed said territory and the boundaries thereof proposed to 8 be annexed to the City; and, 9 .WHEREAS, said petition ",as filed by the owner of. not less than one- 10 fourth of the area of landtri such territory and representing not less: than 11 one- fourth of the assessed value of such territory accordfrig to the last pre- 12 .ceding equalized assessmentr'oll of the County of San Bernar~ino, in which said 13 County the City of San Bernardillo is situated; and. 14 WHEREAS, saidpetitioll requested the said territory to be annexed to 15 and included ill the saidmullicipal corporation ill accordance with the provisions' 16 of the Goverllment Code, Section 35300, et seq.; and 17 WHEREAS, on the 15th day of Kay, 1961, a resolution "'as adopted by 18 the aforesaid Common Council o.fthe City of Sall Bernardino, California, proposillg 19 the allnexation of the aforesaid uninhabited territory, to be generally known .as 20 ANNEXATION' DISTRICT NO. 136 to the City of Sall Bernardino, ana' that said reso- 21 lution provided therein that the proposed anllexation, should be geneJ;allykllown, 22 alld idelltified as ,ANNEXATION DISTRICT NO. 136; and 23 WHEREAS, said resolutioll set forth therein that all the property ,24 included in the aforesaid territory should be taxed equally with the other 25 property within ,the said City to p.ay the bOllded illdebtedp.ess lllld any and aU., ' 26 general indebtedll.ess alldliability of the City of San BelC"nardino coritracted 27' prior to, orexis.ting' or outstanding at the time of the l!foresaid proposed 28 allnexation of the aforesaid property as provided in the hereillbefore meptioned 29 Government Code ; and 30 ' WIlEREAS,said res,alutHm did fix, determine arid declare that a hearing 31 be held on the 19th day ,of June, 1961, at the hour of 9:30 O'Clock A. City ()f San Bernardin(), and the 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 ,< , 17 , . . same was the day, hour ana place designated wb,ere any person owning real estate within such territory so proposed to be annexed and having any objections tp the proposed annexation<might object before the Common Council and show cause why such territory should not <be ann,!xed; and, furthermore, the said resolution provided that at any time not later than the said hour set, as mentioned herein- before for the said hearing, any owner of property within the said territory proposed to be annexed might file written protest with the City of San Bernardino against such annexation; and WHEREAs, no written protests of any kind or nature whatsoever were. filed with the City Clerk of the City of San Berna.rdino prior to 9: 30 o' clock A. M. on the 19th day of June, 1961; and WHEREAS, it appears to the Common Council of the City of San Bernardino that the aforesaid annexation proceedings have been completed an<;l everything performed at this time in accordance with said Government Code, as mentioned hereinbefore, and any and all other laws in '.any way connected with the said annexation procedure having been complied with; and WHEREAS, theCommonCouncii of the City of San Bernardino desire to 18 i approye at this time the annexation of the aforesaid territory. 19 NOW, THEREF9RE, THE COMMON COUNClL OF Tim CITY OF SAN BERNARDINO' 20 DOES HEREBY ORllAlN As FOLLOWS: . 21 S.ECTION .ONEi .
