2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 204. (LAFC No. 593)

WHEREAS, heretofore, a petition was filed with the Common Council
5
of the City of San Bernardino requesting that certain uninhabited territory
6
contiguous to said City be annexed to the City of San Bernardino, and which
7
said petition described said territory and the boundaries thereof proposed
8
to be annexed to the City; and
9
WHEREAS, said petition was filed by the owners of not less than
10
one-fourth of the area of land in such territory, and representing not less
11
than one-fourth of the assessed value of such territory according to the
last preceding equalized assessment roll of the County of San Bernardino,
in which said County the City of San Bernardino is situated; and
WHEREAS, said petition requested the said territory to be annexed
to and included in the said municipal corporation in accordance with the
provisions of the Government Code, Section 35300, et seq.; and

WHEREAS, on the 24th day of June, 1968, a Resolution was adopted

by the aforesaid Common Council of the City of San Bernardino, California,
19
proposing the annexation of the aforesaid uninhabited territory and that said
Resolution provided therein that the proposed annexation should be generally
known and identified as Annexation District No. 204; and
WHEREAS, said Resolution set forth therein that all the property
included in the aforesaid territory should be taxed equally with the other
property within the said City to pay the bonded indebtedness and any and all
general indebtedness and liability of the City of San Bernardino contracted
prior to or existing or outstanding at the time of the aforesaid proposed

annexation of the aforesaid property as provided in the hereinbefore
28
mentioned Government Code; and

WHEREAS, said Resolution did fix, determine and declare that a
30
hearing be held on the 5th day of August, 1968, at the hour of 9:30 o'clock

A. M. in the Council Chambers of the City Hall in the City of San Bernardino,

and the same was the day, hour and place designated where any person owning

real estate within such territory so proposed to be annexed and having any
2
objections to the proposed annexation might object before the Common Council
3
and show cause why such territory should not be annexed; and, furthermore,
4
the said Resolution provided that at any time not later than the said hour
5
set, as mentioned hereinbefore for the said hearing, any owner of property
6
within the said territory proposed to be annexed might file written protest
7
with the City of San Bernardino against such annexation; and
8
WHEREAS, there was one written protest filed with the City Clerk
9
of the City of San Bernardino prior to 9:30 o'clock A. M. on the 5th day
10
of August, 1968; and

WHEREAS, on the 5th day of August, 1968, the date set for the
12
hearing of protests against the proposed annexation, Resolution No. 9337
13
was adopted by the Common Council of the City of San Bernardino declaring
14
that a majority protest has not been presented; and
15
WHEREAS, it appears to the Common Council of the City of San
16
Bernardino that the aforementioned annexation proceedings have been completed
17
and everything performed at this time in accordance with said Government Code
18
as mentioned hereinbefore, and any and all other laws in any way connected
19
with the said annexation procedure having been complied with; and
WHEREAS, the Common Council of the City of San Bernardino desire
to approve at this time the annexation of the aforesaid territory.
NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
SECTION ONE: That said territory herein described as Annexation
25 District No. 204 is hereby annexed and incorporated in and made a part of the
26 City of San Bernardino.

SECTION TWO: The territory herein referred to as being annexed to
28 the City of San Bernardino is particularly described as follows, to wit:
29 Those portions of Lots 5, 6, 14, 15, and 16, Block 43,
Rancho San Bernardino as per plat thereof recorded in
30 Book 7 of Maps, page 2, Records of the County Recorder
of San Bernardino County, State of California, described
31 as follows:
32 Beginning at a point on the Present Corporate Limits of

the City of San Bernardino, said point being the intersection
of the Northerly prolongation of the East line of the West
230.00 feet of said Lot 14 and the North line of Ninth Street,
said point also being 1865.00 feet East, more or less from
the center line of Waterman Avenue; thence along said City
Limit Line the following courses and distances; thence East
along the North line of said Ninth Street a distance of
1335.00 feet, more or less to its intersection with the
Northerly prolongation of the West line of the East 31.3
feet of said Lot 16; thence South along said Northerly pro-
longation and the West line of the East 31.3 feet of said
Lot 16 to the North line of Lot 5 of said Block 43; thence
West along the North line of said Lot 5 to the Northwest
corner of the East 10 Acres of said Lot 5; thence South
along the West line of the East 10 acres of said Lot 5 a
distance of 984.00 feet to the North line of Sixth Street
82.50 feet wide; thence leaving said City Limit Line and
South along the Southerly prolongation of said West line a
distance of 41.25 feet to the center line of said Sixth
Street; thence West along the center line of said Sixth
Street a distance of 305.00 feet to the Southerly prolon-
gation of the East line of the West 305.00 feet of said
Lot 6; thence North along said Southerly prolongation and
said East line of the West 305.00 feet of said Lot 6 a
distance of 1025.25 feet, more or less to the North line
of said Lot 6; thence West along said North line a distance
of 305.00 feet to the Southeast corner of said Lot 14, said
point being on the said City Limit Line; thence North along
said City Limit Line and the East line of said Lot 14 to a
point which is 545.00fBet South of the North line of said
Lot 14; thence West along said City Limit Line and the
South line of the North 545.00 feet of said Lot 14 to a
point which is 230.00 feet East of the West line of said
Lot 14; thence North along said City Limit Line and the
East line of the West 230.00 feet of said Lot 14 and its
Northerly prolongation a distance of 627.50 feet, more or
less to the point of beginning.

Containing 35 acres, more or less.
SECTION THREE: That the above described property will be subject
22 to taxation equally with the property within such municipal corporation to
23 pay its proportion of the following bonded indebtedness of the City of San
24 Bernardino, which said bonded indebtedness was outstanding or theretofore
25 authorized and is outstanding at the time of said annexation, to wit:
26 A bonded indebtedness of $490,000.00 incurred for the acquisition
27 and construction of a public library, including additions to and enlargements
28 of the public library system of said City, the outstanding indebtedness
29 thereon being $310,000.00, bearing interest at the rates of 4 3/4%, 3 1/4%
30 and 3 1/2% per annum;
31 A bonded indebtedness of $1,116,000.00 incurred for the acquisition
32 and construction of additions to, relocations of and replacements of the fire

1 fighting system of said City, the outstanding indebtedness thereon being
2 $865,000.00, bearing interest at the rates of 4%, 3%, 3 1/2%, 2 3/4% and
3 2.9% per annum.

SECTION FOUR: The property herein annexed is declared to be a part
5 of Ward 1 and the boundaries of Ward 1 are hereby altered to include said
6 annexed territory, with portions of Lots 6, 14, 15, and 16, Block 43, Rancho
7 San Bernardino, lying north and south of the County Flood Control Channel be
8 admitted in C-M Commercial-Manufacturing Zone and the Flood Control Channel
9 be admitted in "0" Open Zone as shown on the attached map marked "Exhibit A",
10 and that the 6 acre addition, more or less, to the original annexation be
11 admitted in "0" Open Zone, which addition is described as follows:
12 The south 8 feet of the east 100 feet of Lot 15; the south
8 feet of the west 155 feet of Lot 16; the west 75 feet,
13 more or less, of Lot 5; and the east 305 feet of Lot 6,
Block 43, Rancho San Bernardino.

16 Ordinance and shall cause the same to be published three consecutive times,
SECTION FIVE: The City Clerk shall certify to the passage of this
17 exclusive of holidays, in the San Bernardino Evening Telegram, a daily
18 newspaper designated for that purpose.
