HomeMy WebLinkAbout2938 ORDINANCE NO. 2938 AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDINANCE NO. 1991 KNOWN AS THE "LAND USE ZONING ORDINANCE"; ELIMINA'.[ING THE REQUIREMENT OF A NINE (9) FOOT OPEN ACCESSWO A REAR YARD IN THE "R-l" DISTRICT; PERMITTING THE FIVE (5) FOOT PROJECTION OF SIGNS, MARQUEES AND CANOPIES INTO THE FRONT YARD SETBACK AREAS ON "D" STREET FROM THIRD STREET TO BASE LINE STREET; AND REPEALING ORDI- NANCE NOS. 1419 AND 1834. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION ONE: Ordinance No. 1991 Section 4.2 Subsection D 9 10 is hereby amended to read as follows: "D. YARDS: 11[ 12 13 14 15 1. FRONT - There shall be a front yard of not less than twenty-five (25) feet. For blocks partly built up, See Section 20.6 B. For key lots, see Section 20.6 D. 2. SIDE: a. There shall be a side yard on each side of the main building of not less than ten (10) percent of the width of the 16 17 18 19 lot, but it need not exceed five (5) feet nor may it be less than three (3) feet. b. On corner lots, side yard abutting the street shall be twenty (20) percent of the width of the lot, but need not 20 exceed fifteen (15) feet nor may it be less than ten (10) feet. c. On a reversed corner lot, the side yard abuttin the street shall be not less than half (1/2) of the distance re- quired for front yards on interior lots on the street upon which the reversed corner lot sides, provided, however, that this side yard may not be less than fifteen (15) feet. Private garages located in the side yard shall be at least eighteen (18) feet from the side property line. 3. REAR: a. There shall be a rear yard of not less than ten (10) feet for each lot. b. Accessory buildings may be built to the side 32 and rear property lines provided that: (1) A masonry wall is built along said property lines, and (2) Such buildings are not closer than ten (10) feet to any residence." SECTION TWO: Ordinance No. 1991 Section 20.6 Subsection D is hereby amended to read as follows: "D. There shall be a setback area on each lot or parcel adjacent and contiguous to Waterman Avenue which shall include the area from the street center line to a point 55 feet from the center line of Waterman Avenue. No building, wall, fence, sign, marquee, canopy or other structure shall be maintained within said setback area." 14 SECTION THREE: Ordinance No. 1991 Section 20.6 is hereby 15 amended by adding thereto Subsection F to read as follows: 16 "F. There shall be a setback area on each lot or parcel 17 adjacent and contiguous to "D" Street from the north line of Third 18 Street to the south line of Base Line Street which shall include 19 the area parallel with and from the center line of "D" Street to a 20 point fifty (50) feet from the center line of "D" Street in both 21 an east and a west direction and extending from the north line of 22 Third Street to the south line of Base Line Street. No building, 23 wall, fence, sign, marquee, canopy or other structure shall be 24 maintained within said setback area, except that signs, marquees, 25 canopies and similar structures may extend not more than five (5) 26 feet into the front yard setback of said area provided there is 27 compliance with Ordinance No. 2623, Ordinance No. 1991 and other 28 ordinances, codes and laws." 29 SECTION FOUR: Ordinance No. 1991 Section 20.10 Subsection B 30 is hereby amended to read as follows: 31 32 "B. SIGN PROJECTIONS IN OTHER THAN RESIDENTIAL DISTRICTS: 1. SECTION FIVE: Ordinance Nos. 1419 and 1834 are hereby repealed.
