HomeMy WebLinkAbout2942 '"__"C~""~_'"~_'__~"_~""__' ".,.~,..,f ]'.'1 1 ORDINANCE NO.c?<'9'//2_ r I 2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 207 (LAFC No. 612) 3 4 WHEREAS, heretofore, proceedings were initiated by the Common 5 Council of the City of San Bernardino, on its own motion, to annex to the 6 City of San Bernardino certain contiguous uninhabited territory hereinafter 7 described; and 8 WHEREAS, on the 29th day of July, 1968, a resolution was adopted 9 by the aforesaid Common Council of the City of San Bernardino, California, 10 declaring that proceedings had been initiated by said Council and proposing 11 the annexation, for the reasons therein stated, of the aforementioned 12 uninhabited territory to the City of San Bernardino, and that said 13 resolution provided that the proposed annexation should be generally known 14 and identified as Annexation District No. 207; and 15 WHEREAS, said resolution set forth therein that all the property 16 included in the aforesaid territory should be taxed equally with the other 17 property within the City to pay the bonded indebtedness and any and all 18 general indebtedness and liability of the City of San Bernardino contracted 19 prior to or existing or outstanding at the time of the aforesaid proposed 20 annexation of the aforesaid property as provided in the hereinbefore 21 mentioned Government Code; and 22 WHEREAS, said resolution did fix, determine and declare that a 23 hearing be held on the 10th day of September, 1968, at the hour of 7:00 24 o'clock P. M. in the Council Chambers of the City Hall in the City of San 25 Bernardino, and the same was the day, hour and place designated where any 26 person owning real estate within such territory so proposed to be annexed 27 and having any objections to the proposed annexation might object before 28 the Common Council and show cause why such territory should not be annexed; 29 and, furthermore, the said resolution provided that at any time not later 30 than the said hour set, as mentioned hereinbefore for the said hearing, any 31 owner of property within the said territory proposed to be annexed might 32 file written protest with the City of San Bernardino against such .-_.'~__._""______._... ---I.... f....., 1 annexation; and 2 WHEREAS, no written protests of any kind or nature whatsoever were 3 filed with the City Clerk of the City of San Bernardino prior to 7:00 o'clock 4 P. M. on the 10th day of September, 1968, and thereafter on the 10th day of 5 September, 1968, Resolution No. 57~JCfwas adopted by the Mayor and Common 6 Council declaring that a majority protest has not been presented; and 7 WHEREAS, it appears to the Common Council of the City of San 8 Bernardino that the aforesaid annexation proceedings have been completed and 9 everything performed at this time in accordance with said Government Code, 10 as mentioned hereinbefore, and any and all other laws in any way connected 11 with the said annexation procedure having been complied with; and 12 WHEREAS, the Common Council of the City of San Bernardino desire 13 to approve at this time the annexation of the aforesaid territory. 14 NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 15 DO ORDAIN AS FOLLOWS: 16 SECTION ONE: That said territory herein described as Annexation 17 District No. 207 is hereby annexed and incorporated in and made a part of 18 the City of San Bernardino. 19 SECTION TWO: The territory herein referred to as being annexed to 20 the City of San Bernardino is particularly described as follows, to wit: 21 Those portions of Lots 10, 11, 12, 13, Block 72, Lot 1, Block 55, Rancho San Bernardino as per plat thereof 22 recorded in Book 7 of Maps, Page 2, and that portion of Tract 2038 as per plat thereof recorded in Book 29 of 23 Maps, Pages 51 and 52, and that portion of Tract 2424 as per plat thereof recorded in Book 34 of Maps, Page 60, 24 and that portion of Tract 2228 as per plat thereof recorded in Book 31 of Maps, Page 95, records of the 25 County Recorder of San Bernardino County, State of California, described as follows: 26 30 Beginning at a point in the present corporate limits of the City of San Bernardino said point being the Northeast corner of Lot 5 of said Block 72, and also being a point on the center line of Tippecanoe Avenue, which point is 79.65 feet North of the center line of Gould Street; thence along said City Limit Line the following courses and distances; thence Westerly along the North line of Lots 5 and 6 of said Block 72 to the Southeast corner of said Lot 10, Block 72; thence North along the East line of said Lot 10, Block 72 to the Southerly line of the Atchison, Topeka and Santa Fe Railroad Right of Way; thence Northwesterly along said Railroad Right of Way a 27 28 29 31 32 - 2 - 10 1 distance of 580.00 feet, more or less to its intersection with the center line of the San Bernardino County Flood Control Channel as said center line is established on the San Bernardino County Flood Control District Map, File No. R/W 2-701, Drawing Number 8, dated May 17, 1960 in the office of the Chief Engineer of said District; thence leaving said City Limit Line North 410 58' 04" East a distance of 50.69 feet, more or less to the center line of said Atchison, Topeka and Santa Fe Railroad Right of Way; thence continuing North 410 58' 40" East a distance of 26.82 feet to the beginning of a tangent curve concave Southeasterly and having a radius of 9368.91 feet; thence Northeasterly along said curve through a central angle of 260 55' 11" a distance of 4401.88 feet to the center line of Tippecanoe Avenue; thence South along the center line of Tippecanoe Avenue to the point of beginning. Containing 256 acres, more or less. 2 3 4 5 6 7 8 9 SECTION THREE: That the above described property will be subject 11 to taxation equally with the property within such municipal corporation to 12 pay its proportion of the following bonded indebtedness of the City of San 13 Bernardino, which said bonded indebtedness was outstanding or theretofore 14 authorized and is outstanding at the time of said annexation, to wit: 15 A bonded indebtedness of $490,000.00 incurred for the acquisition 16 and construction of a public library, including additions to and enlargements 17 of the public library system of said City, the outstanding indebtedness 18 thereon being $310,000.00, bearing interest at the rates of 4 3/4%, 3 1/4% 19 and 3 1/2% per annum; 20 A bonded indebtedness of $1,116,000.00 incurred for the acquisition 21 and construction of additions to, relocations of and replacements of the 22 fire fighting system of said City, the outstanding indebtedness thereon 23 being $865,000.00, bearing interest at the rates of 4%, 3%, 2 3/4%, 2.9% 24 and 2 1/2% per annum. 25 SECTION FOUR: The property herein annexed is declared to be a 26 part of Ward 1 and the boundaries of Ward 1 are hereby altered to include 27 said annexed territory, with zoning classifications as shown on a map filed 28 in the City Clerk's office titled "Exhibit A", consisting of portions of 29 Lots 10, 11, 12, 13, Block 72, Lot 1, Block 55, Rancho San Bernardino, 30 Tract 2038, Tract 2424, and Tract 2228, and described as follows: 31 Parcell, M-l Zone 32 Beginning at a point in the present corporate limits of - 3 - 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 I 1 the City of San Bernardino said point being the Northeast corner of Lot 5 of said Block 72, and also being a point on the center line of Tippecanoe Avenue, which point is 79.65 feet North of the center line of Gould Street; thence along said City Limit Line the following courses and distances; thence Westerly along the North line of Lots 5 and 6 of said Block 72 to the Southeast corner of said Lot 10, Block 72; thence North along the East line of said Lot 10, Block 72 to the Southerly line of the Atchison, Topeka and Santa Fe Railroad Right of Way; thence Northwesterly along said Railroad Right of Way a distance of 580.00 feet, more or less to its intersection with the center line of the San Bernardino County Flood Control Channel as said center line is established on the San Bernardino County Flood Control District Map, File No. R/W 2-701, Drawing Number 8, dated May 17, 1960 in the office of the Chief Engineer of said District; thence leaving said City Limit Line North 410 58' East a distance of 100 feet, more or less to the North line of said Atchison, Topeka and Santa Fe Railroad Right of Way; thence South along the North line of the Atchison, Topeka and Santa Fe Railroad Right of Way a distance of 400 feet to the beginning of a tangent curve concave Southeasterly and having a radius of 8968.91 feet; thence Northeasterly along said curve a distance of 3850 feet, more or less, to the West line of Tippecanoe Avenue; thence South along the West line of Tippecanoe Avenue to the point of beginning. 2 3 4 5 6 7 8 9 Parcel 2, "0" 'Open Zone Beginning at a point which is the North line of the Atchison, Topeka and Santa Fe Railroad Right of Way and the centerline of the San Bernardino County Flood Control Channel as said center line is established on the San Bernardino County Flood Control District Map, File No. R/W 2-701, Drawing Number 8, dated May 17, 1960 in the office of the Chief Engineer of said District; said point being the beginning of a tangent curve Southeasterly and having a radius of 9368.91 feet; thence Northeasterly along said curve through a central angle of 26.0 55' 11" a distance of 4401. 88 feet to the centerline of Tippecanoe Avenue; thence South 400 feet, more or less, to the South line of the Flood Control channel; thence Southwesterly and parallel and 400 feet South of the above described curve to the North line of the Atchison, Topeka and Santa Fe Railroad Right of Way line; thence Northwesterly along the Atchison, Topeka and Santa Fe Railroad Right of Way 400 feet, more or less, to the point of beginning.
