2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 206 (LAFC No. 608).

WHEREAS, heretofore, a petition was filed with the Common Council
5
of the City of San Bernardino requesting that certain uninhabited territory
6
contiguous to said City be annexed to the City of San Bernardino, and which
7
said petition described said territory and the boundaries thereof proposed
8
to be annexed to the City; and
9
WHEREAS, said petition was filed by the owners of not less than
one-fourth of the area of land in such territory, and representing not less
than one-fourth of the assessed value of such territory according to the
last preceding equalized assessment roll of the County of San Bernardino, in
which said County the City of San Bernardino is situated; and
WHEREAS, said petition requested the said territory to be annexed
to and included in the said municipal corporation in accordance with the
provisions of the Government Code, Section 35300, et seq.; and
WHEREAS, on the 22nd day of July, 1968, a Resolution was adopted
by the aforesaid Common Council of the City of San Bernardino, California,
proposing the annexation of the aforesaid uninhabited territory and that
said Resolution provided therein that the proposed annexation should be
generally known and identified as Annexation District No. 206; and
WHEREAS, said Resolution set forth therein that all the property
included in the aforesaid territory should be taxed equally with the other
property within the said City to pay the bonded indebtedness and any and all
general indebtedness and liability of the City of San Bernardino contracted
prior to or existing or outstanding at the time of the aforesaid proposed
annexation of the aforesaid property as provided in the hereinbefore
mentioned Government Code; and
WHEREAS, said Resolution did fix, determine and declare that a
hearing be held on the 10th day of September, 1968, at the hour of 7:00
o'clock P. M. in the Council Chambers of the City Hall in the Cit~ of San
Bernardino, and the same was the day, hour and place designated where any

1 person owning real estate within such territory so proposed to be annexed and
2 having any objections to the proposed annexation might object before the
3 Common Council and show cause why such territory should not be annexed; and,
4 furthermore, the said Resolution provided that at any time not later than the
5 said hour set, as mentioned hereinbefore for the said hearing, any owner of
6 property within the said territory proposed to be annexed might file written
7 protest with the City of San Bernardino against such annexation; and
8 WHEREAS, no written protests of any kind or nature whatsoever were
9 filed with the City Clerk of the City of San Bernardino prior to 7:00 o'clook
10 P. M. on the 10th day of September, 1968, and thereafter on the 10th day of
11 September, 1968, Resolution No.~ffwas adopted by the Mayor and Common
12 Council declaring that a majority protest has not been presented; and
13 WHEREAS, it appears to the Common Council of the City of San
14 Bernardino that the aforesaid annexation proceedings have been completed and
15 everything performed at this time in accordance with said Government Code,
16 as mentioned hereinbefore, and any and all other laws in any way connected
17 with the said annexation procedure having been complied with; and
18 WHEREAS, the Common Council of the City of San Bernardino desire
19 to approve at this time the annexation of the aforesaid territory.
20 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF
21 SAN BERNARDINO DO ORDAIN AS FOLLOWS:

SECTION ONE: That said territory herein described as Annexation
23 District No. 206 is hereby annexed and incorporated in and made a part of
24 the City of San Bernardino.

SECTION TWO: The territory herein referred to as being annexed to
26 the City of San Bernardino is particularly described as follows, to wit:

That portion of Tract No. 3996 as per plat thereof re-
corded in Book 52 of Maps, page 64, Records of the
County Recorder of San Bernardino County, State of
California, described as follows:

Beginning at a point on the present corporate limits of
the City of San Bernardino, said point being the inter-
section of the center line of Highland Avenue and the
Southerly prolongation of the East line of Lot 3, Block
7, West Highlands as per plat thereof recorded in Book
5 of Maps, page 77, records of the County Recorder of

said County, said point also being 148.69 feet more or
less, West of the intersection of the center lines of
Highland Avenue and Valaria Drive; thence Westerly along
said City Limit Line and along the center line of said
Highland Avenue a distance of 20.62 feet, more or less,
to the intersection of the Northerly prolongation of the
East line of Block 2 of said West Highlands; thence
Southerly along said City Limit Line and along said
Northerly prolongation and the East line of said Block
2 a distance of 220.06 feet, more or less to its inter-
section with the Westerly prolongation of the center
line of a 20.00 foot wide East-West Alley as delineated
on the map of said Tract 3996 and being adjacent to and
Southerly of Lots 1 and 93 of said Tract 3996; thence
leaving said City Limit Line and East along the said
prolongation and the center line of said alley a distance
of 404.34 feet; more or less, to its intersection with
the East line of said Tract 3996; thence North along the
East line of said Tract 3996 and its Northerly prolongation
a distance of 219.94 feet, more or less to the center line
of Highland Avenue; thence West along the center line
of Highland Avenue to the point of beginning.
Containing 2.04 acres, more or less.

SECTION THREE: That the above described property will be subject
14 to taxation equally with the property within such municipal corporation to
15 pay its proportion of the following bonded indebtedness of the City of
16 San Bernardino, which said bonded indebtedness was outstanding or theretofore
17 authorized and is outstanding at the time of said annexation, to wit:
18 A bonded indebtedness of $490,000.00 incurred for the acquisition
19 and construction of a public library, including additions to and enlargements
20 of the public liorary system of said City, the outstanding indebtedness
21 thereon being $310,000.00, bearing interest at the rates of 4 3/4%, 3 1/4%
22 and 3 1/2% per annum;
23 A bonded indebtedness of $1,116,000.00 incurred for the acquisition
24 and construction of additions to, relocations of and replacements of the
25 fire fighting system of said City, the outstanding indebtedness thereon
26 being $865,000.00, bearing interest at the rates of 4%, 3%, 2 1/2%, 2 3/4%
27 and 2.9% per annum.

SECTION FOUR: The property herein annexed is declared to be a
29 part of Ward 2 and the boundaries of Ward 2 are hereby altered to include
30 said annexed territory, and said property is placed and declared to be in
31 C-3A Limited General Commercial Zone.

SECTION FIVE: The City Clerk shall certify to the passage of this

Ordinance and shall cause the same to be published three consecutive times,
exclusive of holidays, in the San Bernardino Evening Telegram, a daily
newspaper designated for that purpose.
I HEREBY CERTIFY that the foregoing Ordinance was duly adopted by
the Mayor and Common Council of the City of San Bernardino at a regular
