ORDINANCE NO. oJ:1 ~f
AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 208 (LAFC No. 627).
WHEREAS, heretofore, a petition was filed with the Common Council
of the City of San Bernardino requesting that certain uninhabited territory
contiguous to said City be annexed to the City of San Bernardino, and which
said petition described said territory and the boundaries thereof proposed
to be annexed to the City; and
WHEREAS, said petition was filed by the owners of not less than
one-fourth of the area of land in such territory, and representing not less
than one-fourth of the assessed value of such territory according to the
last preceding equalized assessment roll of the County of San Bernardino, in
which said County the City of San Bernardino is situated; and
WHEREAS, said petition requested the said territory to be annexed
to and included in the said municipal corporation in accordance with the
provisions of the Government Code, Section 35300, et seq.; and
WHEREAS, on the 29th day of July, 1968, a Resolution was adopted
by the aforesaid Common Council of the City of San Bernardino, California,
proposing the annexation of the aforesaid uninhabited territory and that
said Resolution provided therein that the proposed annexation should be
generally known and identified as Annexation District No. 208; and
WHEREA~ said Resolution set forth therein that all the property
included in the aforesaid territory should be taxed equally with the other
property within the said City to pay the bonded indebtedness and any and all
general indebtedness and liability of the City of San Bernardino contracted
prior to or existing or outstanding at the time of the aforesaid proposed
annexation of the aforesaid property as provided in the hereinbefore
mentioned Government Code; and
WHEREAS, said Resolution did fix, determine and declare that a
hearing be held on the 16th day of September, 1968, at the hour of 9:30 o'clock
A. M. in the Council Chambers of the City Hall in the City of San Bernardino,
and the same was the day, hour and place designated where any person owning

real estate within such territory so proposed to be annexed and having any
objections to the proposed annexation might object before the Common Council
and show cause why such territory should not be annexed, and, furthermore,
the said Resolution provided that at any time not later than the said hour
set, as mentioned hereinbefore for the said hearing, any owner of property
within the said territory proposed to be annexed might file written protest
with the City of San Bernardino against such annexation; and
WHEREAS, there were two written protests filed with the City Clerk
of the City of San Bernardino prior to 9:30 o'clock A. M. on the 16th day
of September, 1968; and
WHEREAS, on the 16th day of September, 1968, the date set for the
hearing of protests against the proposed annexation, Resolution No. 9403
was adopted by the Common Council of the City of San Bernardino declaring
that a majority protest has not been presented; and
WHEREAS, it appears to the Common Council of the City of San
Bernardino that the aforementioned annexation proceedings have been completed
and everything performed at this time in accordance with said Government Code
as mentioned hereinbefore, and any and all other laws in any way connected
with the said annexation procedure having been complied with; and
WHEREAS, the Common Council of the City of San Bernardino desire
to approve at this time the annexation of the aforesaid territory.
NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
SECTION ONE: That said territory herein described as Annexation
District No. 208 is hereby annexed and incorporated in and made a part of the
City of San Bernardino.
SECTION TWO: The territory herein referred to as being annexed to
the City of San Bernardino is particularly described as follows, to wit:
That portion of the Southeast one-quarter of the Southeast
one-quarter of Section 29 and that portion of Section 28,
and the Southwest one-quarter of Section 21, Township 1
North, Range 3 West, San Bernardino Meridian and that
portion of Tract No. 7231, as per plat thereof recorded
in Book 100 of maps, pages 45 thru 49 inclusive, Records
of the County Recorder of San Bernardino County, State of

California, described as follows:

Beginning at a point in the Present Corporate Limits of the
City of San Bernardino, said point being the intersection
of the center line of Highland Avenue and the Southerly pro-
longation of the East line of that certain parcel described
in deed to Arthur L. Kobal et al by deed recorded October 19,
1966; Document 244 in Book 6715, page 212, Official Records
of said County; said point also being 614.46 feet East of the
center line of Orange Avenue; thence North along said City
Limit Line and said Southerly prolongation and said East line
of said Kobal property a distance of 660.00 feet to the South
line of Tract No. 4986, as per plat thereof recorded in Book
79 of Maps, page 80 & 81, Records of the County Recorder of
said County; thence leaving said City Limit Line East along
the South line of said Tract No. 4986 and the Easterly pro-
longation thereof a distance of 660.00 feet more or less
to the center line of Palm Avenue; thence South along the
center line of Palm Avenue a distance of 150.00 feet more
or less to the center line of Twenty-third Street, 60.00

thereof, recorded in Book 99 of Maps, pages 7 and 8, Records
of the County Recorder of said County; thence North along
said Southerly prolongation and the East line of said Tract
7752 a distance of 810.71 feet to the Northeast corner of
Lot 8 of said Tract 7752; thence West along the North line
of said Tract 7752 and the Westerly prolongation\thereof a
distance of 661.38 feet to the center line of said Palm
Avenue; thence North along the center line of Palm Avenue
and along the West line of said Section 28 and the West line
of said Section 21, Township 1 North, Range 3 West, San
Bernardino Meridian a distance of 6610.00 feet more or less,
to the Northwest corner of the Southwest one-quarter of said

SECTION THREE: That the above described property will be subject
10 to taxation equally with the property within such municipal corporation to
11 pay its proportion of the following bonded indebtedness of the City of San
12 Bernardino, which said bonded indebtedness was outstanding or theretofore
13 authorized and is outstanding at the time of said annexation, to wit:
14 A bonded indebtedness of $490,000.00 incurred for the acquisition
15 and construction of a public lib~ary, including additions to and enlargements
16 of the public library system of said City, the outstanding indebtedness
17 thereon being $310,000.00, bearing interest at the rates of 4 3/4%, 3 1/4%
18 and 3 1/2% per annum;
19 A bonded indebtedness of $1.116,000.00 incurred for the acquisition
20 and construction of additions to, relocations of and replacements of the fire
21 fighting system of said City, the outstanding indebtedness thereon being
22 $865,000.00, bearing interest at the rates of 4%, 3%, 3 1/2%, 2 3/4% and
23 2.9% per annum.

SECTION FOUR: The property herein annexed is declared to be a part
25 of Ward 4 and the boundaries of Ward 4 are hereby altered to include said
26 annexed territory, with the zoning classifications as shown on a:map titled
27 "Exhibit A", on file in the office of the City Clerk, consisting of a portion
28 of the Southeast one-quarter of the Southeast one-quarter of Section 29, a
29 portion of Section 28, and the Southwest one-quarter of Section 21, Township
30 1 North, Range 3 West, San Bernardino Base Meridian, and a portion of Tract
31 No. 7231 as per plat thereof recorded in Book 100 of maps, pages 45 thru 49
32 inclusive, Records of the County Recorder of San Bernardino County, State of
