AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDI-
NANCE NO. 1991 KNOWN AS THE "LAND USE ZONING ORDINANCE" AND PRO-
VIDING THAT THE USES OF MOVIE THEATERS, SECONDHAND GOODS STORES,
AUCTION HOUSES, POOL HALLS, AMUSEMENT ENTERPRISES AND PAWN BROKERS
SHALL BE SUBJECT TO THE REQUIREMENTS OF A CONDITIONAL DEVELOPMENT
PERMIT.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO

SECTION 1: Ordinance No. 1991 Section 11 Subsection ll.l-D
which relates to the service uses permitted in the "C-2" Neighbor-
hood Commercial District is hereby amended to read as follows:

"D. SERVICES:
1. Banks and financial institutions.
2. Catering establishments.

3. Gasoline service stations, including tire shop and
14 minor repairs (new and unused merchandize may be stored outside);
15 service station pump islands shall not be closer than fourteen (14)
16 feet from the street property line which distance shall be measured
17 from the nearest street property line to the nearest edge of the
18 pump island.

4. Dry cleaning and pressing establishments and laundries
20 provided each machine has a rated capacity of not more than sixty
21 (60) pounds.

5. Medical or dental laboratories.
6. Movie theaters, subject to a conditional development

8. Open uses such as: agriculture (field crops, truck
27 gardening, berry or bush crops, flower fields, apiaries) when not

SECTION 2: Ordinance No. 1991 Section 12 Subsection

shall be used and no buildings or structure shall be hereafter
erected, structurally altered, enlarged or maintained except for
the following uses:
A. Uses permitted in the "C-2" District.
B. RETAIL STORES:
1. Automobile sales, new and used cars including ser-
vicing and repairs conducted entirely within a building.
2. Commercial greenhouses {retail only).

I 3. Secondhand goods sold in an enclosed building (no

9\ junk yards), subject to a conditional development permit.
4. Used car and trailer sales lots (service and repair
facilities conducted entirely within a building).
C. SERVICES:
1. Animal hospitals, subject to conditional develop-
ment permit.
2. Auction houses or stores, subject to conditional
development permit.
3. Baths, Turkish and the like.
4. Blueprinting and photocopying.
5. Bowling alleys.
6. Boxing arenas, subject to conditional development
permit.
7. Dance halls, subject to conditional development
permit.

8. Drive-in theaters, subject to conditional develop-

9. Employment agencies.
10. Ice and roller skating, subject to conditional de-
velopment permit.
11. Automobile wash, subject to conditional development

12. Mortuaries and funeral parlors, subject to condi-

13. Motels and motor hotels, subject to a conditional
development permit.
14. Natatoriums.
15. Pool halls, subject to a conditional development
permit.
16. Repair garages, including automobile and truck re-
pair and painting or upholstering (conducted wholly within a build-
ing) .
17. Trade schools (if not objectionable due to noise,
lights, odor, vibration or dust).
18. Trailer camp, subject to a conditional development
permit.
19. Upholstery shop.
20. Wedding chapels.
21. Tire retreading and recapping, subject to the follow-
ing restrictions:
Said operation to be completely enclosed in a building of
commercial appearance; space devoted to tire retreading and recap-
ping not to exceed 25% of total first floor area, and new and
used tire storage area not to be a part of the retreading and
recapp~ng area; tire buffer room to contain motors, blowers and
buffer equipment with waste container for buffed or waste rubber
to be outside the buffer room, but within the enclosed building,
and the buffer room to be reasonably fire and sound proof.
22. Trampolines, subject to a conditional development
permit.
D. COMBINATION USES: See Section 9.2.
E. Such other uses as the Commission determines to be
similar."
SECTION 3: Ordinance No. 1991 Section 14 Subsection
14.1 which relates to the service uses permitted in the "C-4"
Central Business District is hereby amended to read as follows:

"14.1 USES PERMITTED: No building or structure or land
shall be used and no building or structure shall hereafter be
erected, structurally altered, enlarged or maintained except for
the following purposes:
A. Uses permitted in the "C-3" General Commercial Distric .
B. COMBINATION USES: See Section 9.2.
C. OTHER USES:
L. Film distributors.
2. Pawn brokers, subject to a conditional development
permit.
3. The following amusement enterprises subject to Com-
mission review and approval: Games of skill or science, shooting
galleries and the like when conducted entirely within an en-
closed building, subject to a conditional development permit.
4. Electric distribution substations.
D. Tho~e uses expressly prohibited in the "C-3" General
Commercial District shall be prohibited in the "C-4" Central
Business District.
E. Those uses listed as requiring conditional develop-
ment permits in the "C-3" General Commercial District are per-
mitted in the "C-4" Central Business District, with the same con-
ditions to use, with the exception of trailer camps, which are
specifically prohibited in the "C-4" Central Business District."
SECTION 4: Ordinance No. 1991 section 28 Subsection 28.1
is hereby amended to read as follows:
"28.1 LOCATION OF PERMITTED USES: Whenever it is stated
in this ordinance that certain uses may be permitted in a land
use zoning district subject to securing a conditional development
permit, said uses are deemed to be part of the development of
the Master Plan or its objectives and shall conform thereto,
and to the requirements and procedures of Section 28."
