HomeMy WebLinkAbout1983ORDINANCE NO. 1983 AN ORDINANCE REGULATING ENCROACHMENTS, OBSTRUCTIONS AND THE CLOSING OF STREETS OR PORTIONS OF STREETS WITHIN THE CITY OF SAN BERNARDINO. THE MAYOR AND CONMON COUNCIL OF THE CITY OF SAN BERNARDlllO 00 ORDAIN AS FOLLOWS: SECTION ONE: It is hereby declared unlawful for any person, firm or corporation to encroach upon, obstruct or close any public street, alley, court or any portion thereof within the City of San Bernardino, for any purpose, without first having obtained permission in writing so to do from the Superrtendent of streets of said City. SECTIOO TWO: The Superintendent of Streets is authorized to issp.e en- croachment permits subject to the following rules and regulations ahd payment of fees as herein set forth: l (a) Each applicant, before obtaining a permit, shall pay a fee herefor 19 as follows: 20 21 22 1. For each s1xt.een (16) feet of space at any location where parkirtg meters are installed, forty ($.40) cents per day; 2. For each encroachment, obstruction or closing permit in locations 23 where no parking meters are installed, two ($2.00) dollars; 24 3. The minimum fee for any permit shall be two ($2.00) dollars. (b) That said application shall be filed with said Street Superintendent at least forty-eight (48) hours prior to the reqUestedencroachmenJ, obstruction 25 26 27 or closing. 28 (c) No such permit shall be issued for a longer period than 30 days from 29 30 the day of granting thereof. (d) No permit granted under this Section shall be issued unless and until 31 32 said applicant has executed a good and sufficient surety bond to t e City of San Bernardino in a sum designated by said Superintendent of Stree s, ;conditioned I I I " t ~.,..,."....".",~~""._--~_..........'" , It """"",. 1""''';''''''-0'' III . c ,^"" v 1 that said applicant will save and keep the City and all officers thereof harm- 2 less from any and all costs, damages or expenses that the City or any of its 3 officers may incur or be obligated to pay by reason of the granting of such 4 permit, or the erection or maintenance of the structure or appliance for which 5 the permit is granted. The Superintendent of Streets may, in his discretion, 6 I waive the necessity of the filing of the bond. 7 (e) Nothing herein shall be construed as interfering with any rights 8 granted to any persons, rim or corporation under and by virtue of any franchise 9 of the State of California, or of the City of San Bernardino. 10 (f) The Superintendent of Streets is authorized and directed 1;0 issue 11 permits without fee to the following: 12 13 1. Agencies of the United States of America, the state o~ California, the County of San Bernardino, and the City of San Bernardino, or any of 14 15 their duly authorized commissions, departments, agents or employees, in pursuance of their governmental functions. 16 .
