HomeMy WebLinkAbout1988ORDmANCE NO. 1988 AN ORDINANCE PROHIBITING AND REGULATION THE USE OF EXPLOSIVES, THE SETTING OF FIRES AND SMOKING WITHIN CERTAIN AREAS LYING WITHIN THE CITY OF SAN BERNARDINO, REGULATION THE CONSTRUCTION OF CHIMNIES AND FIRE PLACES AND THE USE OF CERTAIN TYPES OF ROOFING MATERIALS WITHIN CERTAIN AREAS OF SAN BERNADINO CITY, DESCRIBING AN AREA KNOWN AS "HIGH FIRE HAZARD AREA: AND PRESCRIBING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE AND REPEALING ORDINANCES IN CONFLICT THEREWITH. THE llAYOR AliD Cill/EON COUNCIL OF TIU CITY OF SAlI BERIUlEDDm DO ORDAIN AS FOLLa:IS: SECTION ONE: It shall be unlawful for any person, fina or ~orporation fire for the clearinF of land or at any time to light a fire or fires or use 10 to buna brush, slash, fallen timber, grass, or other inflammable ,naterial, 11 12 13 14 15 16 17 18 19 Hithin the City of San Bernardino, ,d.thout first having obtainedl a 'IT'itten permit from the City Fire Department; that nothing in this secti<j>n shall pre- vent the use of proper and lawful fires for safe domestic purposes; fur~her provided, that no permit ,rill be necessary to burn inflammable material in properl;y constructed incinerators, outdoor ,l1ater heating units, cooking grills and other similar devices having chirnneys covered with spark arresters consist- ing of galvanized or copper screening of a mesh not larger than a quarter of an inch, and openings such as doors, to be spark tight and other;;ise approved by the fire department, and ;:here the land around such incinerator, outdoor ,11ater heating units, cooking grills and other sir,ular devices, is. cleared of all inflau~able lloaterial }rithin a radius of at least ten (10) feet. SECTION 1';;0: It shall be unla",ful for any ccerson, firn or corpol'atj.on in the City of San Bernardino, to allo\i or' permH any fire attendee! by him or it to escape from his or its control. ( - -- 1 vehicle, or "~chile riding upon any horse, donkey, mule: or other animal. 2 3ECTIOK IIIlTS: Any person, firm or corporation, o.'minG, leasing, using, 3 4 controlling, cor operating any cabin, house, hotel, houset;:'ailer, apiary, or other building, structure or improvement in said "hiGh fire hazard area", shall 5 6 at all times maintain upon his said land or adjacent to said cabin, house, im- provffinent or structure, an effective fire protection or firebreak; s&id fire 7 protection or firebreak to be made by removing all inflammable vegetation or 8 growth or other inflammable materials or vegetation from the ground around said 9 buildings, structures and improvements for a distance of not less than thirty 10 (30) feet from the exterior walls of the buildings, structures, house trailers 11 12 and improvements, the aforeJ:lentioned fire protections or firebreak, shall cover all lands situated bebieen the building structures and the property boundary; 13 provided, however, that this section shall not apply to trees, except where dead 14 or where the foliage of said trees shall be within ten (10) feet of the Chimney 15 nor shall it apply to evergreen vegetation vlhere growing and preserved for 16 decorative effect. 17 SECTION TEl,: No person, firm or corporation hereafter shall erect, con- struct, enlarge, or add to any cabin, house, hotel or other buildings, or struc- 18 19 tures, in the "high fire hazard area", as herein defined, unless the same is 20 provided rnth a fire-retardent roof. 21 SECTION ELEVEth It shall be unlawful for any person, firm or corporation 22 in said "high fire hazard area", as herein defined, to place or cause to be placed 23 on his own'land, or on the land of another, any rubbish, paper, sawdust, shavings, 24 boxes, petroleum products not :in closed containers, or residue, fallen timber, 25 slash, lilnb-rlOOd, branches of trees, brush, grass, litter or other inflammable 26 at erial , except at places and in the manner designated by' the City Fire Depart- 27 nent; and all such infla-nrnable material shall be effectively destroyed by fire 28 at such tL~e and in such lnanner as shall be designated by the fire department 29 after securing a permit from said department. 30 31 32 Any such rubbish, paper, sawdust, shavings, boxes, petrolewil products or residue, fallen limbs, slash, limb-.food, branches of trees, brush grass, litter or other inflammable material placed, caused to be placed 01' existing on any land, -3- --..---..."."-."....." -_.._- ....' ."--,,~<,,--,~,- 3 4 5 6 7 8 9 10 11 [' '~'f"'''''''7,.,,,:'O":''>';''''-:':'01::' ~ ~:.::r' ~~'Tf I llr' ~ ,-~--, - -',:"i'!O"'''''_ " \, .....\ ,,",' ~- '. 1 contrary to the provisions of this ordinance, is hereby declared to be a public 2 nuisance and shall be abated pursuant to law. SECTION TWELVE: All of the territory in the City of San Bernardino, in- ... cluded cdthin the following described boundaries is hereby determined to be the "high fire hazard area": All that area vdthin the City of San Bernardino lying North of the follol'ing described streets: Forty-eighth Street between "F" Street and Hountain View Av,nue, Forty-ninth Street between Hountain View Avenue and Leroy Sifreet, Avery Street between Harrison Street and Del Rosa Avenue, I Foothill Drive between Del Rosa Avenue and the East City Limits of the City of San Bernardino. In addition to the above area, all of the City of San Bernardino l;ying within the boundaries described in Annexation No. 20. 12 SECTION THIRTEEN: Any person, firm or corporation violatingl any of the 13 provisions of this ordinance shall be guilty of a misdemeanor and upon convic- 14 tion thereof, shall be punished by imprisonment not to exceed six (6) months or 15 by a fine of not to exceed Five Hundred (:$500.00) Dollars, or by both such fine 16 and imprisonment. 17 18 herel,ith are hereby repealed.
