HomeMy WebLinkAbout1989ORDINANCE No. 1989 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION OF ANNEXATION DISTRICT NO. 64. liKEREAS, heretofore a Petition was filed with the Common Council of i the City of San Bernardino requesting that certain uninhabited ter~itory con- ! tiguous to said City be annexed to the City of San Bernardino and "hich said 6 Petition described said territory and the boundaries thereof proposed to be 7 annexed to the City; and 8 9 10 lv'HEREAS, said Petition was filed by the owners of not less than one- fourth of the area of land in such territo~ and representing not less than one-fourth of the assessed value of such territo~ according to the last pre- 11 12 ceding equalized assessment roll of the County of San Bernardino, :i,n which said 13 County the City of San Bernardino is situated; and I WHEREAS, the said Petition requested the said territory t1 be an- nexed to and included in the said municiapl corporation, in accord~ce ~th the provisions of the Government Code, Section 35300, et seq., and ~JHEREAS, all and each of the o,mers of all of the aforemet:io*ed real property and of each and eve~ parcel contained therein have consented in writing and filed ,.ith the City Clerk of the City of San BernaJ!'din~.whoa~t,~ ::0::: :::1:::: :::: :;::~~:dt::::i:::e::a:d~g::~:q::at ~lr'tt ': ~i:.';,;-~--:~'r;' other property within the said Cityto pay the bonded indebtedn~ss d,~#ibd all general indebtedness and liability of the City of San Bernar jotlted prior to or following or outstanding at the time the aforesaid Peti iOI!.' ol"'the annexation was filed and subsequent thereto, as provided in lIa1,d mt Code I WHEREAS, on theIst day of June, 1953, a Resolution was afio~ed by the aforesaid Common Council of the City of San Bernardino, califorhia, pro- posing the annexation of the aforesaid uninhabited territo~ to be kenerally .e;',,; and known as the ANNEX1,TION DISTRICT NO. 64 to the City of San Bernardino, and that said Resolution provided therein that the said proposed annexation should be generally knovrn and identified as the ANNEXATION DISTRICT NO. 64; and -1- ...-.-- ."'-~...---_._- -""~--',. 29 30 31 32 11 ,I II I: I' II t',"'1 "U:'I",_ ~" -. . 1 .~AS, said Resolution set forth therein that all of the property 2 included in the aforesaid territory should be taxed equally with the other prop- 3 erty within the said City to pay the bonded indebtedness and any and all general 4 indebtedness and liability of the City of San Bernardino, contracted prior to 5 or existing or outstanding at the time of the aforesaid proposed annexation of 6 the aforesaid property, as provided in the hereinbefore mentioned Government 7 Code; and 8 WHEREAS, the said Resolution did fix, determine and decla~e that a 9 10 hearing would be held on the 20 day of July , 1953, at the hour of 7:30 P.M. o'clock in the Council Chambers in the City Hall in the City of San Bernardino, 11 California, and same was the day, hour and place designated where any person 12 owning real estate within such territory so proposed to be annexed and having 13 any objection to the proposed annexation might object before the Common Council 14 15 and show cause why such territory should not be annexed, and furthermore, the said Resolution provided that at any time, not later than the said hour set, 16 as mentioned hereinbefore for the said hearing, any owner of property "ithin the 17 18 said territory proposed to be annexed might file written protest with the City of San Bernardino against such annexation; and 19 WHEREAS, no objections or protests of any kind or nature whatsoever 20 21 were made or filed, either written or oral, with the said City of San Bernardino, I and no protests or objections of any nature whatsoever were made, either written 22 or oral, at the meeting of the Common Council on the 20th day of July , 195 , 23 24 as mentioned hereinbefore, at which said meeting the said Common CoUncil pub- licly announced that any person, firm or corporation desiring to protest or 25 object to said annexation might do so at said meeting; and, 26 WHEREAS, it appears to the Common Council of the City of Slj.n Bernard- 27 , mo that the aforesaid annexation proceedings have been completed and everything 28 performed at this time, in accordance with said Government Code, and mentioned hereinbefore, and any and all other laws in any way connected ,lith the said an- nexation procedure, having been complied with; and .J1lEREAS, the Common Council of the City of San Bernardino desires to approve at this time the annexation of the aforesaid territory, ' -2- !! I, '1 ~ I c"" (' ,""... 1 NOH, THEREFORE, THE COHMON COUNCIL OF THE CITY OF SAN BERNAIWINO 2 DOES HEREBY ORDAIN AS FOLLO\1S: 3 SECTION ONE: That said'territory as herein described as Annexation 4 District No. 64 is hereqy annexed and incorporated in and made a part of the 6 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 5 City of San Bernardino. SECTION TI10: The territory herein referred to as being annexed to 7 the City of San Bernardino is particularly described as follows, to wit: BEGINNING at a point on the North line of Highland Avenue, 82.50 feet wide; and the center line of Golden Avenue 82.5 feet wide, said center line of Golden Avenue being the pre- sent corporate limits of the City of San Bernardino; thence ~!esterly along the North line of Highland Avenue to a point, said point being 220.00 feet West of the center line of Gol- den Avenue; thence Northerly and parallel with the West line of Golden Avenue to a point, said point being 198.00 feet North of the North line of Highland Avenue; thence Westerly and parallel with the North line of Highland Avenue to the East line of Tract No. 2536, as per plat recorded in Map Book 36, at Page 35, records of the County Recorder of San Bernardino County; thence Northerly along the East line of Tract No. 2536 to the Southeast corner of Lot 16 of said Tract No. 2536; thence Easterly and parallel to the North line of Highland Avenue 6.00 feet; thence Northerly and parallel to the East line of said Tract 2536; 180.00 feet; thence Westerly and parallel to the North line of Highland Avenue 6.00 feet to the Northeast corner of Lot 15 of said Tract No. 2536; thence Northerly along the East line of said Tract No. 2536, 300.00 feet to the Northeast corner of said Tract No. 2536, said point being the Northwest corner of Lot 2, Block 11, Orange Grove Tract, as per plat recorded in Map Book 11, Page 14, Records of San Bernardino County; thence Easterly along the North line, and its Easterly extension, of Lots 2 and 3, Block 11 of said Orange Grove Tract to an intersec- tion with the center line of Golden Avenue, said intersection being a point on the corporate boundary of the City of San Bernardino; thence South along the center line of Golden Avenue, and being also along the corporate boundary of the City of San Bernardino, to the North line of aforesaid High- land Avenue, the point of beginning. SECTION THREE: That the above described property shall be subject to taxation, equally with the property within such municipal corporation, to p its proportion of the following bonded indebtedness of the City of, San Bernar- dino, which said bonded indebtedness was outstanding at the tLme of filing said Petition or theretofore authorized and is outstanding at the time <pf said an- nexation, to wit: A bonded indebtedness of $200,000.00 incurred for the con$truction and completion of a convention I;1a.ll, the outstanding indebtedness thereon being -3- ""'...,..-.~_. . '- I - , , \ $45,000.00, bearing interest at the rate of 5% per aDI1\lIIl; A bonded indebtednees of $275.000.00. incurred for the acquisition and construction of _ter works. including "Devil Canyon Water Wo~ksn. water rights. rights of way, pipe lines, wells and p"mping plants. the outstanding indebtedness thereon being $82.500.00. bearing interest at the rat~ ot 5% per annum; A bonded indebtedness of $650.000.00, incurred tor the acquisition I of real property, and construction of a sewage disposal plant, inverted siphon sewer lines and intercepting sewers, the outstanding indebtedness thereon being $129,999.96, bearing interest at the rate of 4l% per aDI1\lIIl. SECTION FIVE: The City Clerk shall certify to the passage ot this ~ oJ Ordinance and shall cause the same to be published three consecutive times in the San Bernardino Evening Telegram, a daily newspaper designated for that pur- pose.
