For the purpose of carrying out the intent of tho ordin~lce>

ingor struoture used for living or sleeping purposes and
equipped with wheels or other means to facilitate move-
ment trom plaoe to plaoe, and vehioles when used for liv-
ing or sleeping purposes.
AUTOMOBILE WRECKING shall mean the wl:'ecking or dismantling of
used motor vehioles or trailers, or the storage of, sale
of or dumping of dismantled, partly dismantled, obsolete
or wreoked motor vehioles or their parts.
AUTOMOBILE SERVICE STATION shall mean an area whioh provides
for the servicing of motor vehicles, including tube and
tire repairs, battery oharging, storage of merchandise,
and supplies related to the servicing of motor vehicles,
sale of gasoline and lubricants, automobile washing (not
inoluding automatio oar wash) and grease raoks, but
exoluding automobile repairs, body and fender works,
engine overhauling and. other similar aotivities.
BASEMENT sh8.ll mean a space wholly or partly underground, and
having more than one half ot its height, measuring from
its floor to its oeiling, below the average adjoining
grade; if the finished floor level direotly above a
basement is more than six (6) feet above grade at any
point, such basement shall be oonsidered a story.
BLOCK shall mean a pp~cel of land surrounded by publio streets,
highways, freeways, railroad right-of-way, fi.ood oontrol
channel, oreek, wash, river or uneubdivided acreage or
any combination thereof.
BOARDING HOUSE shall mean a building wi thin whioh lodging wi th
or without meals is provided for compensation for not more
than five (5) persons unrelated by blood or marriage to
the owner or operator; not to inolu~e rest homes or homes
for the aged.
BUILDING shall mean any structure having a roof and walls built
and maintained for the support, shelter or enolosu~e of
persons, animals, ohattels or property of any kind.
BUILDING, HEIGHT OF shall mSclJl the vel.tioa! distance mea.sured
from the adjoining curb level to the highest point of the
struoture, exoluolve of ohimneys and ventilators; provided,
however, that where buildings are set back from the street
line, the height shall bo measured from the average eleva-
tion of the finished. grade at the front of the blAilding.
BUILDING, MAIN shall mean a building within whioh is conducted

this ordinance.
BUILDING SITE shall mean the ground al'ea of a bulldingtog~the:r
with all the open space requh'ed by this ordinance.
BUILDING, UNIT GROUP shall mean two or mo~e buildings grouped
on a lot.
BUNG.~W COURT shall mean a group of two or more detaohed
buildings used or intended to be used as one-famil~ or
tWO-family (duplex) dwellings, located on a single lot.

Outdoor advertising signs and structures shall be permttted
in the City of San Bernardino under the conditions set forth
in the following paragraphs:
A. GENEHAL ProVISIONS:
1. No outdoor advertising sign or structure shall
be plaoed on a building or on ths land other
than as specifioally provided for below.

may be located within five hundred (500)
feet of the oenter line of a freeway or
parkway it.the advertising thereon is
designed primarily to be viewed trom the
main traveled roadway of a freeway or park-

BUILDING HEIGHT: No building or structure may be erected.
structurally altered or enlarged within lines which detine
the flight zone for landing strips or aircraft runways
unless the height of said buildings shall be below a line
defined as the angle 01' glide. The angle of glide is herein
defined as beginning at the end of the take-off or landing
strip and having an angle described by a one (1) foot verti-
cal rise for every forty (40) feet of horizontal run. All
existing buildings lying wi thin this area which do not comply
to this provision are hereby declared to be nonconforming
and are subject to such action as may be prescribed by law.
SECTION 21
EXCEPTIONS
21.1 LOTS ON DOWNHILL SLOPES:
A. On property located on downhill slopes having a twenty-
tive (25) percent or greater slope {measured in the
general direotion of the side lot lines) an additional
story may be oonstructed on the main building, providing
however. that the oeiling of the lowest story shall be
not more than two (2) feet above the curb level, meas-
ured at the center 01' the lot frontage.

yard provided, however, that every portion of said
garage shall be at least five (5) teet from the front

21.2 STRlICTURES PERMI'i'TED ABOVE HEIGHT LIMIT:

Penthouses or roof structures for the housing of elevators, stair-
ways, tanks, ventilating tans or similar equipment required to
operate and maintain the building and fire or parapet walls, sky-
lights, towers, steeples, flagpoles, ohlmneys, smokestaoks, wire-
less and television masts, water tanks, s110s or siml1ar struc-
tures may be erected above the maximum height permitted in each
district. No structure or penthouse shall be allowed for purposes
of providing additional floor space.
21.3 LARGE-SCALE HOUSING DEVELOPMENT:
Where the entire frontage in a residential block is designed and
developed as a unit the following provisions may be applied:
A. The front yard requirements may be varied by not more
than five (5) feet in either direction provided that
the average front yard for the entire frontage is not
less than that required in the district.
B. The side yard provisions may be varied, provided that
the combined total width of the two side yardS on a lot
shall be not less than that required for lots in the
distriot, and that the distanoe between the sides of
buildings be not less than ten (10) feet.
21.1!. PROJECTION INTO YARDS:
A. A covered driveway may be permitted in a side yard,
prov1ded that the structure 1s not more than one (1)
story in height, twenty (20) feet in length and 1s
entirely open on three (3) sides except for the sup-
porting columns and oustomary architectural features.
Columns or posts supporting the structure must be
located not less than three (3) feet from the property
line.
B. Fire esoapes may extend into any required yard not more
than four (4) feet.
C. Open, unenolosed stairways or baloonies may extend into
a rear yard not more than four (4-) feet and into a front
yard not more than thirty (30) inohes.
D. Open, unenolosed porches, platforms or landing plat-
forms whioh dO not extend above the level of the first
floor of the building may extend or proJeot into the
front or rear yard a distance not more than six (6)
feet, and such features may not extend into a court
more than twenty (20) percent of the width of said
court and not more than six (6) feet.
E. Planting boxes may be permitted 1n a required yard.
21.5 COMPUTATION OF YARDS:
A. In measuring a front yard or side yard adjoining a
street, it shall be the perpendioular distance between
the street and a line through the oorner or face of
said building olosest to and drawn parallel with the
street excluding any arohitectural features permitted

NONCONFORMING BUD-DINGS AND NONCONroRMING USES
The following regulations shall apply to all nonconforming
buildings and nonconforming land.uses:

Family Residentlaf District, and shall remain in said distriot
until the Land Use Zoning Plan tor the area has been adppted
by the Commission and Council unless the Commission an~ Counoil
determine the precise zoning as a part of the annexation pro-
oedure. The Commission shall recommend to the Council appro-
priate districting of the land within ninety (90) days after
an application for ohange has been :filed with the Commission,

3. Plans and specifications for the proposed improve-
ments at the new looation, ino1uding landsoape
treatment.
4. Definition of the route of travel for the houRe
to be moved.
B. Before the Commission may approve the applioation for
moving of a building or struoture there shall be a
finding that eaid moving shall- have no detrimental
effect on the living environment and property values
in the area into which the structure is to be moved.
C. Before a building permit may be granted there shall be
the posting of a bond as determined by the Chief Build-
ing Inspeotor and City Engineer to cover oosts of the
activities involving the City and the expenditures
involved in complying with conditions related to improve-
ments of the property whioh may have been established
in the granting of' the permit. The bond shall also
cover the costs involved in oleaning up the vacated
site and restoring it to a safe and sightly oondition.
D. The provisions of Ordinanoe No. 1750 and Ordinance No.
la55 whioh are not in oonfiict herewith are made a
part of this ordinance.
SECTION 25
. CERTIFICATE OF OCCUPANCY
25.1 CONDITIONS ~~UIRING APPLICATION~
No vacant, moved, altered, repaired, or hereafter erected build-
ing, ehal1 be occupied by any use requiring a business license
until after a Certificate of Oocupancy shall have been issued by
the Chief Building Inspector. The following uses and conditions
shall also necessitate an application for a Certificate of Oocu-
pancy:

Uses such as charitable, fraternal, or religious insti-
tutions and other nqnprofi t organizations.

SECTION 26
VARIANCES, ADJUSTMENTS, APPEALS AND CONDITIONS TO USE
26.1 PURPOSE AND PRINCIPLE:
When practical difficulties, unnecessary hardships or results
inconsistent with the general intent and purpose of this ordi-
nance occur by reason of the striot interpretation of any of
ita provisions, the Commission, upon its own motion, may, or
upon the verified applioation of any interested person shall
initiate prooeedings for consideration of the granting of a
variance from the provisions of this ordinanoe under suoh oon-
ditione as may be deemed necessary to assure that the intent
and purpose of the ordinance and the Master Plans upon whioh
it is based, will be observed and that the health, safety and
publio welfare be secured and that substantial Justice be done.

A varianoe shall not be oonstrued as an amendment to this ordi-
nance or oause the maps which are part of t!.ls ordinance to be
changed.
26.2 NECESSARY CONDITIONS BEFORE A VARIANCE MAY BE GRANTED:
The Commission, before it may grant a variance, must make a find-
ing in writing that in the evidence presented all of the follow-
ing conditions exist in reference to the property being consid-
ered:
A. That there are exceptional or extraordinary clircum-
stanoes or conditions applicable to the prop~ty
involved, or to the intended use of the p~opert1,
which do not apply generally to other property in the
same zoning district and neighborhood.
B. That such varialloe is necessary for the preservation
and enjoyment of a substantial property right of tho
applioant, which right io possessed by other prop-
erty owners under like conditions in the same zoning
distriot and neighborhood.
C. That the granting of the variance will not be materi-
ally detrimental to the public welfare or injurious
to property and improvements in the zoning distriot
and neighborhood in which the property is located.
D. That the granting of such a varianoe will not be con-
trary to the objectives of the Master Plan.
26.3 FILING OF APPLICATIONS:
A. Applications for varianoes shall be made .to the City

forty ( ) days thereafter. No less than ten (10)
full days before the date of the publio hearing, notice
of such hearing shall be given in the following manner:

under oonsideration and in at least ten (10) other
plaoes wi thin a min1mum radius of five hundred (500)
feet of the property under oonsideration, suoh notice
conta1ning the same date as re~lired in subsection
(1) of this Seotion.
B. The Chairman of the Commission, or the aoting oha1rman,
may administer oaths and oompel attendance of witnesses.
26.5 FINDINGS OF THE COMMISSION:

Commission shall render a decision in writing.
26.6 CONDITIONS:
The Commission, in granting a variance, may establish reasonable
conditions which in the opinion of the Commission shall assure
the intent and purpose of this ordinanoe.
26.7 NOTICE OF DECISION:
A written report of the deoision of the Commission shall be filed
with thel Common Counoil and mailed to the applioant at the address
shown on the applioation. Fa11ure to report a deoision to the
Counoil within forty (40) days shall be deemed to constitute a
denial, unless the time limit be extended by oommon consent of
both the applicant and the Commission.
26.8 DECISION AND APPEALS THEREFROM:

26.9 Y. ANCES GRANTED WITHOUT PUBLIC HEARING:

The Commission may, when in the public interest, grant the follow~
ing varianoes without publio hearing, in whioh case no filing fee
will be required:
A. Reductions in lot area requirements, yard requirements,
maximum height requirements, where in the Commission's
Judgment the shape of the individual building site, topog-
raphY of the site, the location of existing buildings or
other oonditions Which make strict oomplianoe impossible
without praotical diffioulties or personal hardships.
B. Allow the extension of a zone bouno.ary where the said
boundary divides a particular lot into two (2) parts,
which lots are less than the minimum required for lots
in their respective zones.
C. Permit the reconstruotion or remodeling of nonconforming
buildings whioh in the Commissionk Judgment will bring
suoh bulldings and subsequent use into greater oonformity
with the uses permitted in the distriot.
26.10 VOIDING OF VARIANCES:
Each variance granted under the provisions of this artiole shall
become null and void unless:
A. The construction authorized by said variance or permit
shall have been oommenoed within one hundred and eighty
(lelO) days atter the granting ot said varianoe and pur-
sued diligently to oompletion; or
B. The occupancy of land or buildings authorized by suoh
variance has taken place within one hundred and eighty
(laO) days after the grantingof such varianoe. .
Q. W~re oircumstances beyond the control of the applioant
oause delays which do not permit compliance with the
time limits established herein, the Commission may grant
an extension of time for a period not to exceed an add:i.-
tional ninety (90) days.
D. The Commission may void any variance for noncompliance

gross acreage of not less than five (5) acres, pro-
vided, however, they comply with yard requirements
on the boundaries of the property and with the height
and area regulatlo ns of the zone in which they are
located, and in no case involve more than forty (40)
percent coverage of the buildable area of the site
(excluding acoessory buildings). Variations with
height and area may be allowed if the density pro-
visions (families per net residential acre) are
complied w1 th and the buildable area coverage is
oorrespondingly reduced.

28.3 PROCEDURE:
Application tor the approval of any use referred to in this
Section shall be filed with the Commission upon forms provided,
and accompanied by suoh data as m~ be presoribed tor that
purpose by the Commission to assure the fullest practical
presentation of facts.
28.4 HEARINGS ON PETITIONS AND NOTICES THEREOF:
A. The Comm1ssion shall bold at least one publ10 hearing
on matters referred to in petitions for Conditional
Development Permits not less than fifteen (15) days nor
more than forty-five (4;) days after said petition is
received.
B. The Comm1ssion shall give notioe of the time and plaoe
for the hearine; on the petitio.n by posting notioes not
less than ten (10) days prior to the date of suoh hear-
ing within a radius of five hundred (500) feet of the
property in question.
28.5 DECISION BY THE COMMISSION:
The Commission shall make its findings 1n writing to the Common
Counoil wi thin forty (40) d~s atter the date of hearing and
shall forthwith transmit a oopy thereof to the applioant and to
the Council. If the Comm1ssion falls to report w1 thin the time
designated herein it shall lose Jurisdiotion, and the applioant
may appeal to the Oouncil.
28.6 CONDITIONS TO APPROVAL:

SECTION 29
BOARD OF ARCHITECTURAL REVIEW
ESTABLISHMENT OF BOARD:
A Board ot Architectural Review is hereby established, which .
Board shall oonsist ot three (3) members, one (1) of whom shall
be a member of' the Planning Commiss1on, preferable a member with
architeotural training and experienoe. The other two members
shall be Architeots licensed under the Business and Professions
Codes of the State of California. The members of the Board shall
be appointed by the Mayor and be approved by the Common Counoi1.
The 'term of office or the members of' the Board shall be for four
(~) years. The member who is a Planning Commissioner shall have
his term run concurrent with his term as a Commiss1oner. Of' the
other members first appointed one shall be appointed for a term
ot two (2) years and the other for a term of four (~) years.
The Board shall adopt rules and regulations for the conduct of
their business. TWO (2) members shall constitute a quorum. In
cases where there can be no agreement I the differences shall be
submitted to the Commission as the findings of the Board. The
Direotor of Planning shall serve as the seoretary of the Board.
The reoords of its meetings shall be available to the Commis-
sion at all times.
29.2 AUTHORITY OF THE BOARD:
The Board's first and most important responsibility shall be the
safeguarding of the quality of the living environment in the
City and to advise the Commission on methods for improving said
environment. It shall be espeoially ooncerned with the tollow-
ing matters:
A. All matters referred to it by the Planning Commission
as required by this ordinance.
B. All matters concerning the development ot the Civio
Center.
C. Plans and elevations for all private buildings proposed
to be bu1lt on the streets having common frontage or
siding on the Civio Center
D. All house moving activities.
E. The Board may advise the Commission on all matters
relating to site planning.
The Board shall make no rul1ngs on the bas is of Architectural
style, but it may advise the developer of its opinion in this
matter when the Board's opinion is unanimous.
If' the Board makes no report to the Commission on matters
referred to it by said Commission within a thirty <:~O) day
period, the Commission may. take aotion based on its own judgment.
Recommendations by the Board and conourred in by the Commission
shall have the same status as all other reoommendations by the
Commission.
SECTION 30
FORM OF APPLICATION, PETITIONS AND APPEALS
The Commission shall, in its rules ot prooedure, pre~oribe the
form and soope of all petitions and applioations proyided for in

SECTION 31
ENroRC~T, LEGAL PROCEDURE, PENALTIES FOR VIOLATION
31.1 ENFORCEMENT:
It shall be the duty of the Chief Bu1lding Inspeotor to enforoe
the provisions of this ordinanoe pertaining to the ereotion, oon-
struotion, reoonstruotion, moving, conversion, alteration, set-
baok or addition to any building or struoture.
31.2 LEGAL PROCEDURE:
An., building or structure set up, erected, construoted, altered,
enlarged, oonverted, moved or maintained oontr8J"1 to the provi-
sions of this ordinanoe, and any use of land, bu1lding or premises
established, conduoted or operated or maintained oontrary to the
provisions of thiS ordinanoe, shall be and the same is hereb.,
deolared to be unlawful and a publio nuisanoe; and the Cit., Attor-
ney Of the Cit." upon order of theCouno1l shall immediately oom-
menoe action or prooeedings for the abatement and removal and the
enjoining thereof in the manner presoribed bY' law, and shall take
suoh other steps and shall apply to suoh oourts as may have Juris-
diotion to grant suoh relief as w111 abate and remove the struo-
ture or bu1lding, and enjoin any person, f1rm or oorporation from
setting up, ereoting, building, maintaining or use of any such
building or struoture or using property oontrarY' to the provisions
of this ordinance. The remedies provided herein shall be cwumula-
tive and not exclusive.
31.3 PENALTIES FOR VIOLATION:
Any person, fim or corporation, whether as principal, agent,
employee, or otherwise, violating or oausing the v101ation ot anY'
of the provis1ons of this ordinanoe shall be guilty of a mis-
demeanor, and upon oonv1ction thereot shall be punishable by a
tme of not more than five hund%'ed (500) dollars, or by imprison-
ment tor a term not to exceed six (61 months, or bY' both suoh tine
and imprisonment. Suoh person, f1l'm or oorporation shall be
deemed guilty of a separate otfense for each and every day during
any portion of which an., violation of this ordinanoe is colllll1'tted
or continued bY' such person, firm or corporation and shall be
punishable as herein provided.
SECTION 32
VALIDITY
It anJ section, sentence, olause or phrase of this .0rdJ,nanoe is
tor any reason held bY' a oourt ,of oompetent Jur18d~ot101l to be
invalid, suCh deois10n shall not etfect the validitY' ot the .
remaining porti::ms of this ordinance. The Common Oounpil of the
Ci ty of' San Bernard1no hereby deolares that it would ~ve passed
and does hereby pass this ordinanoe and eaoh section, entenoe,
clauses and phrases hereof, irrespeotive of the tact at any
one or more sections, sentenoes, clauses or phrase a be deolared
inval~, or unconstitutional.
