WHEREAS, heretofore a Petition was filed with the Common Council of the City of San Bernardino requesting that certain uninhabited territory con- tiguous to said City be annexed to the City of San Bernardino andWbich~" , Petition described said territor.y and the boundaries thereof proposed te.bt annexed to the City; and WHEREAS, said Petition was filed by the owners of not less than one- fourth of the area of land in such territor.y and representing not less than one-fourth of the assessed value of such territor.y according to the last pre- ceding equalized assessment roll of the County of San Bernardino, in which said County the City of San Bernardino is situated; and WHEREAS, the said Petition requested the said territor.y to be annexed to and included in the said municipal corporation, in accordanoe with the pro_ visions of the Government Code, Seotion 35300, et seq., and ~iHEREAS, all and each of the owners of all of the aforesaid real property and of each and ever.y parcel contained therein have consented in writing and filed with the City Clerk of the City of San Bernardino, who acts as Clerk for said Common Council, their consent and agreement that all of the property included in the aforesaid t-erritor.y shall be taxed equally with the other property within the said City to pay the bonded indebtedness and any and all general indebtedness and liability of the' City of San Bernardino contracted prior to or follOwing or outstanding at the time the aforesaid Petition of the annexation was filed and subsequent thereto, as provided in said Government Code and WHEREAS, on the ~day of ~ , 1953, a Resoiution was adopted by the aforesaid Common counc~f~ of San Bernardino, Calif- ornia, proposing the anneXation of the aforesaid uninha1:dted territor.y to be generally mown as the ANNEXATION DISTRICT NO. 66 to the City of San Bernar- dino, and that said Resolution provided therein that the proposed annexation should be generally known and identified as the ANNEXATION DISTRICT NO. 66; and -1- _,. ...____M.'~'_ __," <'._'_' 1 2 3 " IS 8 7 B 9 10 11 12 13 1" 15 18 17 18 19 20 21 22 23 24 2f) 26 27 28 29 30 31 - ) '__-r ....<. ... . WHEREAS, said Resolution set forth therein that all of the property included in the aforesaid territory should be taxed equally with the other property within the said City to pay the bonded indebtedness and any and all general indebtedness and liability of the City of San Bernardino, contracted prior to or existing or outstanding at the time of the aforesaid proposed annexation of the aforesaid property, as provided in the hereinbefore mentioned Government Code; and WHEREAS, the said Resolution did fix, determine and declare that a hearing would be held on the 17th day of August, 1953, at the hour of 7:30 P.M. o I clock in the Council Chambers in the City Hall in the City of San Bernardino) California, and same was the day, hour and place designated where any person owning real estate within such territory 50 proposed to be annexed and having any objection to the proposed annexation might object before the Comnon Council and show cause why such territory should not be annexed, and furthermore, the said Resolution provided that at any time not later than the said hour set, as mentioned hereinbefore for the said hearing, any owner of property within the said territory proposed to be annexed might file written protest with the City of San Bernardino against such annexation; am WHEREAS, no objections or protests of any kind or nature whatsoever were made or filed, either written or oral, with the said City of San Bernardino and no protests or objections or any nature whatsoever were made, either written or oral, at the meeting of the Comnon Council on the 17th day of . Aul!tlst . 1953, as mentioned hereinbefore, at which said meeting the said Common Council publicly announced that any person firm or corporation desiring to protest or object to said annexation might do so at said meeting; and WHEREAS, it appears to the Common Council of the City of San Bernardino that the aforesaid annexation proceedings have been completed and everything performed at this time, in accordance with said Government Code, and mentioned hereinbefore, and any and all other laws in any way connected with the said annexation procedure, having been complied with; and WHEREAs, the Common Council of the City of San Bernardino desires to 32 approve at this time the annexation of the aforesaid territory. -2- -~, 3 4 D e 7 B g 10 11 12 13 14 US 1e 17 18 19 20 21 22 23 24 215 26 27 28 29 30 31 32 "..~-"~-..~...-"- ,.--.-....- ,,-.. .- ,- i ,,~' 1 NCM, THEREFORE, THE COMMON COUNCil. OF THE CITY OF SAN BERNARDINO 2 DOES HEREBY ORDAIN AS FOLLOWS: SECTION ONE: That said territory as herein described as Annexation District No. 66 is hereby annexed and incorporated in and made a part of the City of San Bernardino. SECTION TWO: The territory herein referred to as being annexed to the City of San Bernardino is particularly described as follows, to wit: Beginning at a point in the present corporate limits of the City of San Bernardino, said point being in the South line of Nineteenth street, 60 feet wide, with the southerly pro- longation of the East line of Lot 10, as shown on plat of Tract 1711 Norton Little Farms, recorded in Book 25 of Maps', at page '27, records of the County Recorder of San Bernardino County; thence westerly along the South line of Nineteenth. street to a point of intersection of the Southerly prolonga- tion of the West line of Lot 14, Tract 1711 Norton Little Farms; thence northerly along the southerly prolongation of the West line of Lot 14, and the West line of Lot 14 to the Northwest corner of said Lot 14, Tract 1711 Norton Little Farms; thence easterly along the North line of Lots 10, 11, 12, 13, and 14, to the Northeast corner of said Lot 10, said Tract 1711, Norton Little Farms; thence southerly along the East line of Lot 10, being along the present corporate limits of the City of San Bernardino, to the point of beginning. SECTION THREE: That the above described property shall be subject to taxation, equally with the property within such mtnicipal corporation, to pay its proportion of the following bonded indebtedness of the City of San Ber- nardino, which said bonded indebtedness was outstanding at the time of filing said Petition or theretofore authorized and is outstanding at the time of said annexation, to wit: A bonded indebtedness of $200,000.00 incurred for the construction and completion of a convention hall, the outstanding indebtedness thereon being $45,000.00, bearing interest at the rate of 5% per annum; A bonded indebtedness of $275,000.00, incurred for the acquisition and construction of water works, inCluding "Devil Canyon vlater ",orks", water rights, rights of ~, pipe lines, wells and pumping plants, the outstanding indebtedness thereon being $82,500.00, bearing interest at the rate of 5% per annum; A bonded indebtedness of $650,000.00, incurred for the acquisition of real property, and construction of a sewage disposal'plant, inverted siphon -3- -, 7. 8 9 10 11 12 13 14 1~ 16 17 18 19 20 21 22 23 24r 2~ 26 27 28 29 30 31 32 I - '......, " . 1 sewer lines and intercepting sewers, the outstanding indebtedness thereon 2 being $129,999.96, bearing interest at the rate of 4~ per annum. 3 SECTION FOUR: . The property herein annexed is declared to be a part 4 of Ward ~, and the boundaries of Ward S are hereby altered to include IS said annexed territory; and said property is placed and declared to be .in 8 Zone #-/ under the Zoning Ordinance and Regulations of said City. SECTION FIVE: The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published three consecutive times in the San Bernardino Evening Telegram, a daily newspaper designated for that purpose.
