HomeMy WebLinkAbout2000ORDINANCE NO. 2000 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO PROVIDING FDR FILING OF OFFICIAL BONDS AND DETER- MINING THE AMOUNT THEREOF. PROVIDING FDR A BLANKET POSITION BOND FDR CITY EMPLOIEES. AND REPEALING CERTAIN &BCTIONS OF ORDINANCE NO. 821 AND ORDINANCE NOS. 1695 AND 1916. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FDLLOWS: SECTION ONE: The following officers of the City of San Bernardino, before entering upon the discharge of their official duties, and within twenty days after notice of their election or appointment, shall severally execute to said City an official faithful performance bond in the following penal sums, to-wit: Mayor $1,000.00 Each member of the Common Council, $1,000.00 City Clerk, $1,000.00 City Attorney, $1,000.00 16 17 18 Each member of the Board of Water Commission- ers, $1,000.00 City Treasurer, $75,000.00 The City Treasurer, in addition to his official bond in the penal sum of $75,000.00, shall execute to said City an addi- tional bond in the penal sum of $25,000.00, which additional bond shall be known as the treasurer's "Trust Fund Bond", and shall be conditioned for the payment by said Treasurer to any person, firm or corporation lawfully entitled thereto, of all moneys received by said Treasurer, his deputies, clerks and attaches, under or pursuant to the provisions of the Improvement Act of 1911, or any other special assessment or other acts, by the provisions of which moneys, other than moneys belonging to said City, are payable to the City Treasurer/of said City for disbursement to any person, firm or corporation, other'han said City, and which "Trust Fund Bond" shall by its provisions be made to enure to the benefit of, and provide that an action may be maintained thereon by any person, firm or corporation entitled to 1 receive money from said Treasurer under the acts aforesaid. 2 SECTION TWO: On all employees of the City of San Bernardino 3 except those in the Municipal Water Department, a blanket position 4 bond shall be provided, indemnifying the said City against any and 5 all fraudulent or dishonest acts, failure of performance of 6 official duties, including false arrest by Police Department 7 employees, failure to account properly for any and all moneys or 8 property received by virtue of any position or employment, of or 9 by any employee, acting alone or in collusion with others, said 10 bond to comply with the provisions of all other Ordinances of the 11 City applicable thereto, and to be in the following amounts for 12 the employment indicated:~\Chief of Police, $5,000.00; Deputy City 13 Treasurer, each, $5,000.00; all others, $2,500.00 each. The word 14 "employee" or "employees" as used in this ordinance shall mean and 15 include those officers, employees and other subordinates of the 16 said City who are not otherwise required by Ordinance to furnish 17 an individual bond to qualify for office or employment. 18 SECTION THREE: That Section 104 and Section 104-A of 19 Ordinance No. 821; and Ordinance Nos. 1695 and 1916 are hereby 20 repealed. 21 SECTION FOUR: This Ordinance is for the immediate preser- 22 vation of the public peace, health and safety, in that it provides 23 for a larger indemnity than exists under currently effective 24 individual bonds, and which larger indemnity the Mayor and Common 25 Council find is urgently required as a protection of City moneys 26 and property, and shall therefore become effective immediately 27 upon its adoption and publication. 28 SECTION FIVE: The City Clerk shall certify to the passage 29 of this Ordinance and shall cause the same to be published three 30 (3) consecutive times in the San Bernardino Evening Telegram, a 31 daily newspaper hereby designated for tqat purpose. 32 - 2 - 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 1 2 :5 4 5 I HEREBY CERTIFY that the foregoing Ordinance was duly adopted by the Mayor and Common Council of the City of San thereof held on the ;< 4 Bernardino at a regular meeting Of\.~ ,~~JL, ~~-' NOES :n/lM1R day . 1953. by the following vote, to-wit: AYES: 1l.vrlA'b.A'l li-"'H>A~ ~~ ABSENT: '---J?Aht.J 6 7 " " ,/ :' 0--'" 0- ~ i~' ~I 77~~ '~ C Y Cler I hereby approve the foregoing Ordinance this '- f /lL" day of n~"'An'-O"",-, . 1953. ~t~~:rd1no Approved as to form ~~tf1;Z:nH-- FILED NO',/ J 1053 J~~Clerk ay ,.....
