'" .. .. 1 ORDINANCE NO. ,^06/ 2 AN ORDINANCE OF THE ~lAYOR AND COI-lMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION OF ANNEXATION DI3I'RICT NO. 67. 3 4 15 l'iHEREAS, heretofore a Petition was filed Viith the Conunon Council of the City of San Bernardino requesting that certain uninhabited territory con- e tiguous to said City be annexed to the City of San Bernardino and Vihich said 7 8 9 10 11 12 Petition described said territory and the boundaries thereof proposed to be annexed to the City; and WHEREAS, said Petition Vias filed by the owners of not less than one- fourth of the area of land in such territory and representing not less than one-fourth of the assessed value of such territory according to the last pre- ceding equalized assessment roll of the County of San Bernardino, in which 13 said County the City of San Bernardino is situated; and 14 15 ~1lliREAS, the said Petition requested the said territory to be annexed to and included in the said municipal corporation, in accordance VTith the pro- 16 17 18 visions of the Government Code, Section 35300, et seq., and Wffi.."lEAS, all and each of the owners of all of the aforementioned real property and of each and every parcel contained therein have consented in 19 20 21 22 23 24 writing and filed VTith the City Clerk of the City of San Bernardino, Viho acts as Clerk for said Cormnon Council, their consent and agreement th9. t all of the property included in the aforesaid territory shall be taxed equally Viith the other property within the said City to pay the bonded indebtedness and any and all general indebtedness and liability of the City of San Bernardino contracted prior to or following or outstanding at the time the aforesaid Petition of the 215 annexation Vias filed and subsequent thereto, as provided in said Government Code 26 and 27 /O~ day of r;;'r'A~ 19S-? a Resolution VIaS Common Council of the City of San Bernardino, WHEREAS, on the 28 adopted by the aforesaid 29 30 California, proposing the annexation of the aforesaid uninhabited territory to be generally known as the ANNEXATION DISTRICT NO. 67 to the City of San Bernar- 31 dino, and that said Resolution provided therein that the proposed annexation 32 should be generally kno.m and identified as the ANNEXATION DISTRICT NO. 67; and -1- - .. .. 1 vlliEREAS, said Resolution set forth therein that all of the property 2 included in the aforesaid territory should be taxed equally with the other pro- 3 perty within the said City to pay the bonded indebtedness and any and all gen- 4 eral indebtedness and liability of the City of San Bernardino, contracted e prior to or existing or outstanding at the time of the aforesaid proposed 8 annexation of the aforesaid property, as provided in the hereinbefore mentioned 7 Government Code; and 8 9 10 WHEREAS, the said Resolution did fix, determine and declare that a hearing would be held on the 21st day of September, 1953, at the hour of 7:30 P.M. o'clock in the Council Chambers in the City Hall in the City of San Ber- 11 nardino, California, and same was the day, hour and place designated ~lhere any 12 person owning real estate within such territory so proposed to be annexed and 13 having any objection to the proposed annexation might object before the Common 14 15 Council and show cause why such territory should not be annexed, and furthermore, the said Resolution provided that at any time not later than the said hour set, 18 as mentioned hereinbefore for the said hearing, any owner of property within 17 18 the said territory proposed to be annexed might file written protest with the City of San Bernardino against such annexation; and 19 vlliEREAS, no objections or protests of any kind or nature whatsoever 20 21 were made or filed, either written or oral, with the said City of San Bernardino, and no protests 22 or oral, at the or objections of any nature whatsoever were made, meeting of the Common Council on the 2'-"'.J..day of either written ~ , 23 24 1953, as mentioned hereinbefore, at which said meeting the said Conrnon Council publicly announced that any person, firm or corporation desiring to protest to 25 or object to said annexation might do so at said meeting; and 26 IVHEREAS, it appears to the Common Council of the City of San Bdrnardino 27 that the aforesaid annexation proceedings have been completed and everything 28 performed at this time, in accordance with said Government Code, and mentioned 29 30 hereinbefore, and any and all other laws in any way connected with the said nnexation procedure, having been complied with; and 31 \'iHEREAS, the Common Council of the City of San Bernardino desires to 32 -2- 17 18 19 20 21 22 ,.~;-, - .. .. 1 approve at this time the annexation of the aforesaid territory. 2 NON, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 3 DOES HEREBY ORDAIN AS FOUDWS: 4. SECTION ONE: That said territory as herein described as Annexation 15 District No. 67 is hereby annexed and incorporated in and made a part of the 6 City of San Bernardino. 7 8 9 10 11 12 13 SECTION TI-Kl: The territory herein referred to as being annexed to the City of San Bernardino is particularly described as follows, to wit: Beginning at the Southwest corner of Lot $, H.H. Linville Sub- division, records of the County Recorder, San Bernardino County, California, as recorded in Book 8 of Maps, at Page 47; thence Northerly along the West line of Lots 8, 7, 6 and 5, said H.H. Linville Subdivision and the West line of the South one-half of Lot 6, Block 58, Rancho San Bernardino, records of the County Recorder, San Bernardino County, California, as recorded in Book 7 of Yaps, at Page 2, to the Northwest corner of the South one-half of Lot 6, Block 58, Rancho San Bernardino; thence Easterly along the North line of the South one-half of said Lot 6 to the Northeast corner said South one-half said Lot 6; thence Southerly along the East line of Lot 6, Block 58, Rancho San Bernardino and the East line of H.H. Linville Subdivision to a point said point being 198 feet more or less South from the North East corner of Lot 2, H.H. Linville Subdivision, also said point being the present Corporate City Limits; thence Westerly along the present Corporate City Limits line to the East line of Pennsylvania Avenue $2.50 feet wide, - dedicated as Olive Street as shown on map of said H.H. Linville Subdivision as recorded in Book 8 of Maps, at page 47, records of the County Recorder of San Bernardino County; thence South- erly along the East line of said Pennsylvania Avenue being along the present cOrpDrate City Limits to the Southwest corner of said Lot 2, of H.H. Linville Subdivision; thence Westerly along the present Corporate City Limits line to a point said point being 323 feet West of the West line of Pennsylvania Avenue; thence Southerly and parallel with the West line of Pennsylvania Avenue along the present Corporate City Limits to the North line of Base Line Street; thence Westerly along the North line of Base Line Street to the point of beginning. 14. 15 16 23 24 215 SECTION THREE: That the above described property shall be subject 26 to taxation, equally with the property within such municipal corporation, to 27 28 pay its proportion of the following bonded indebtedness of the City of San Ber- nardino, which said bonded indebtedness was outstanding at the time of filing said Petition or theretofore authorized and is outstanding at the time of said 29 30 annexation, to wit: 31 32 A bonded indebtedness of $200,000.00 incurred for the construction and completion of a convention hall, the outstanding indebtedness thereon being $45,000.00, bearing interest at the rate of 5% per annum; -3- ,,' J - .. .. - 1 A bonded indebtedness of $275,000.00, incurred for the acquisition 2 and construction of water works, including "Devil Canyon Water Works", water 3 rights, rights of way, pipe lines, wells and pwnping plants, the outstanding 4 indebtedness thereon being $82,500.00 bearing interest at the rate of 5% per 15 annum; 8 A bonded indebtedness of $650,000.00, incurred for the acquisition 7 of real property, and construction of a sewage disposal plant, inverted siphon 8 sewer lines and intercepting sewers, the outstanding indebtedness thereon 9 being $129,999.96, bearing interest at the rate of 4~% per annum. 10 SECTION FOUR: The property herein annexed is declared to be a part 11 of Ward S , and the boundaries of Ward ..5' are hereby altered to include 12 said annexed territory; and said property is placed and declared to be in 13 Zone 1<- / under the Zoning Ordinance and Regulations of said City. 14 SECTION FIVE: The City Clerk shall certir,y to the passage of this 15 Ordinance and shall cause the same to be published three consecutive times in 16 the San Bernardino Evening Telegram, a daily newspaper designated for that 17 purpose. 18 I HEREBY CERTIFY that the foregoing Ordinance was duly adopted by 19 the Mayor and COffil1on Council of the City of San Bernardino at a regular. meeting 20 thereof held on the /t,~day of ~LU- , 1953, by the following vote: 21 AYES: k~ / ~/ ~, 1~-L-1~ ~~ 22 NOES: ~ ABSENT: ~ 23 24 25 I-~ ~ Z;e/-L=- I hereby approve the foregoing Ordinance this 17 ~ of ~. 26 1953. 27 28 29 30 Approved as to form: Sl S2 F I I r~ D ,,,_ t"_ " Av~ 7v~/) City Attorney t '-- !VoV j 'I l'lt3 , -4- JACK T.
