HomeMy WebLinkAbout2005 ~ . . ~ 1 ORDINANCE NO. ;2. oO!:J- 2 AN ORDn~ANCE REGULATING THE MOVING OF WILDINGS AND OVERSIZE LOADS ON, OVER AND ACROSS PUBLIC STREETS, ALLEYS AND PLACES WITHIN THE CITY OF SAN 3 BERNARDINO, CALIFORNIA. 4 The Ma;yor and Conmon Council of the City of San Bernardino do or- 5 dain as follows: 6 Section 1. The following words and phrases are definitions and 7 shall be construed as hereinafter set forth. 8 (a) "Building" shall mean any type of structure normally 9 used as a place of habitation, business, storage or for the shelter of ani- 10 mala. 11 (b) "Oversize loads" shall mean any load other than a 12 building carried on a vehicle which exceeds a height of ]J16. from the surface 13 of the pavement to the top of the load, or exceeds a width of 96", or the Ie 14 authorized by the California Vehicle Code, and the exceptions therein autho- 15 rized. 16 Section 2. It mall be unlawful for any person, finn or corporation 17 to move, or cause to be moved, any wilding or oversize load on, over or 18 across any public street, place or alley within the City of San Bernardino 19 without first obtaining a permit to do so from the Superintendent of Streets 20 of the City of San Bernardino. 21 Section 3. Application for such permit shall be in writing and 22 shall be filed with the Superintendent of Streets a minimum of forty eight:. (48) 23 hours prior to the. entry of any building, structure, or oversize load on any 24 public street, alley or place in the City of San Bernardino. The application 25 for permit shall show the following information: 26 (a) The present location and the proposed location to which 27 the building or oversize load is to be moved. 28 (b) The height, width and length of the building or over- 29 size load to be moved. 30 31 32 -1- J 1 ..p.v 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 . . .. , - (d) Approval in writing of the Park Superintendent re- garding street tree clearance on route of moving. (e) If the approval is one for moving a building, the application shall be accompanied by approval in writing of the Secretary of the Planning Commission or City Clerk to the effect that the Planning CoDmis- sion or City Council has approved the moving of the building to the new loca- tion. Section 4. Upon tiling of said application, accompanied by the fee and bond required by this ordinance, the Superintendent of Streets may issue his permit, designating the streets over. on or across which such building or oversize load shall be moved. Section 5. The following fees will apply to permits for moving any building or oversize load on, over or across any public street. alley or place within the City of San Bernardino. (a) For the moving of any building or any separate sec- tion thereof. $7.50. (b) For the moving of any oversize load, $2.50. Section 6. It shall be the duty of every person IIIOving any build- ing or oversize load over public streets, alleys or places to provide warning flags, lights or reflectors in such locations on the building or oVersize load as to clearly indicate the existence of a hazard in all directions from which traffic may approach. Lights and reflectors will be used between sunset ,and sunrise. In addition to the warning flags, lights and reflectors required above, a flagman shall be stationed approximately 300 feet from the wilding or oversize load in the direction of any normal traffic flow. In all cases where a building or oversize load projects over the center line of the street, a flagman shall be stationed 300 feet ahead of, and another flagman 300 feet behind the building or oversize load. The Superintendent of Streets is autho- rized to require such additional warning and safety measures as he may deem necessary to safeguard the public. Section 7. No permit shall be granted under this section unless and until said applicant has executed a good and sufficient surety bond to the -2- . . . . " ~ 1 City of San Bernardino in a sum designated by said Superintendent of Streets, 2 but not less than $1,000.00, conditioned that said applicant will hold ani 3 save the City and all officers thereof harmless from eIJY and all costs, dam- 4 ages or expenses that the City or any of its officers may incur or be obliga- 5 ted to pay by the reason of the granting of such permit, including damage to 6 streets, trees and other City owned property. 7 Section $. Any psrson, firm or corporation violating any of the 8 provisions of this ordinance shall be deemed guilty of a misdemeanor and upon 9 conviction thereof shall be punished by fine not exceeding Five Hundred Dollar 10 ($500.00) or by imprisonment for a term not exceeding six (6) months, or by 11 both such fine and imprisonment. 12 I HEREBY CERTIFY that the foregoing ordinance was duly adopted by 13 tha Mayor and Common Council of the City of San Bernardino at a ~~-;.{ meet- 14 ing thereof, held on the ,23-ul day of ) t~7-.~, -?li,..-(,-l..-t , 1953, 15 by the following vote, to wit: 16 17 18 19 20 21 22 23 AYES: /._~c.i:.
