Rule I. Classification
SECTION 1. Pursuant to the p?ovisions of the Charter of the
1 City of San Berna1"dino, Caljfornia, the Civil Service of the City
is divided into the unclassified and the classified service:

The lillclassified service shall include:
All officers elected by the people:
All officers cppointed for a definite term:
All deputies and assistants of elective officers
who hold office during the pleasure of such
elective officers.
The heads of departments, and the heads of
divisions of departments and members of 8.11
appointive boards;
One Secretary for each department.

8 SECTION 3. The classified service shall comprise all posi-
tions not specifically included in this Charter in the unclassi-
9 fied service. There shall be in the classified service the follow-
ing three classes, to be known as the competitive class, the un-
10 competitive cless, and the labor clrss;
(a) The competitive class shall include all positions and
11 employment for which it is practicable to d '.termine the merit and
fitness of applicants by competitive examinations;
12 (b) The uncompetitive cless shall consist of all positions
requiring peculiar and exceptional qUAlifications of a scientific,
13 managerial, professional or educational character, or may be deter-
mined by the rules of the Board.
14. (c) The labor class shall inclnde ordinary unskilled le.bor.
15 SECTION 4: The competitive class of the classified service
shall include the following position8, which, for convenience in
16 carrying on examinetion, in certifying for appointments olOd. in
making removals, shall be classified as follows:

SECTION 7: The labor clrcss shall include ordin8ry unskilled

23 SECTION 1. (a) ~dmission to examination for a position in th
classified service shall be based upon the maximum and minimum ages
24 set forth in the classifications in Sections 4 and 6 o~ Rule I.
25 (b) In all examinations before the Civil Service
~oard, honorable discharged soldiers, sailors and marines of the
26 Pnited States GoverQment, and widows of SUCh, and the wives of

RULE III APPLICATION

131 SECTION 1. Applic~tions for sc1mis~ion to examin.tion shall

the moral ch~r~cter ~nd fitne3~ of the .pplic~nt. Each applicant

ment~ m~de in his .pplic'Jtion and sh~.ll file the ssme Hith the
16 Secrehry of the Bo~rd. All ~pplio"tion5 must be filed at lea~t

in the non-competitive or labor classes (together with all accompBnr-
ing certificates) shall be cRrefully examined by the Chief Examiner
9nd such applicants shall be graded (lccording to their experience,
reliabili ty, industry, and qualificll,tions for the position sought.
Examinations, assembled or unassembled, may be held by the Chief
EX9miner in orde~ to ascertain the qualifications of such applicant
and the determinations of such qualifications shall be based on
merit, efficiency, character and industry. In case of applican~s
for positions requiring peculiar and exceptional qualifications of
a scientific, professional or expert character, or for positions
the duties of which requit'e qualifications the Chief EXlLminer mllY
also require certificates of competency or the possession of such
licenses as the law may provide as necessBry for the prRctice of
the profession, and/or trade involved. The n~es of ~pplicants
found to be qualified for t~e positions sought, according to the

eligible lists in a register or eligibles together with and accord-
ing to the gradc~ received.
RULE V. PERCENTAGE AND REGISTRATION
SECTION 1. All applicants who attain a general average of
seventy per centum, or over, and who do not fall below the minimum
fixed for any separate pRrt of the examin&tion, shall be eligible
for appointment .in the classification for which examined and their
ne~~s sh~ll be enrolled in the precedence of highest general
average in the register of eligibles upon the eligible list for
the positions examined, respectively.
SECTION 2. In all examinations before the Board, honorably
discharged soldiers, sailors and msrines of the United States
Government and such widows of such, and the wives of injured
soldiers, sailors, m~rines who themselves are not qualified but
vJhose wives ere q'.lHlified to hold such positlons, shllll be given
precedence as follows, viz; If such person has obtained an average
perc~ntllge of sixty-five where the average percentage required
seventy, he shall be eligible and his name shall be placed on the
list Rbove and be certified before the na~es of persons who have no
been allowed preference. If the names of more than one preference
claimant appear on the list the name of the claimant having the
highest average percentage shall head the list; provided that the

such dismissal is made, the Secretary of the Board shall advise the
employee involved thAt he is found beloH the established standard

from date of receipt of such notice, he may be heard in his own
defense before the Board. If such demand is made, the Board shall

SECTION 6. Char~es based on efficienc records. Any markin[s
of general average e ow seventy per centum on the efficiency
records of a Civil Service employee shall be suffi cient ground for
investigation and action by the Civil Service Br)[~rd 9S provided in
the Charter.
Where the verified final avera[e 0 f a Civil Service employee
is below seventy per centmn, the Board may order his dismissal
from the service, after such employee has first been presented
with r",asons fop such dismissal specifically stated inwrlting
~nd has been given an opportunity to be heard before the Soard
in his own defense. The communication of such decision to the
employee shall without other formality separate him from the service.
RDLE XI. PROMOTIONS
SECTION 1. All promotions in the Civil Service shall be in
accordance with Sec. 252 of the Charter, and in the competitive
class shall be made upon competitive examinations. Competition in
such examinetlons shall be limlted to the employees in the lower
gre.des of the same division who have served at least one ;)'ear in
the department in which the position exists. An advancement in
rank shall constitute a promotion. whenever practicable, vacancies
shall be filled by promotion; provided that whenever the Board shall
determine that it is impracticable to fill a position by prol"otion,
an eligible list shall be created by an open competitive examination.

RULE XIII . ABSENCE
SECTION 1. Except in cases of sickness or great emergency,
.bsence from duty without lEave or without written notice to the
ead of the department involved, stating the reason for such
bsence, shall be cause for dismissal. Any officer or employee in
he Civil Service of the City who shall absent himself from duty
or a period of six or more days, without permission in writing
rom the head of the department, shall be deemed discharged from
he service of the City.
SECTION 2. The head of a department may grent to an employee
herein upon his written request, a leave of absence without pay
or a period of not exceeding sixty days, by first obtainin3 the
pproval and consent of the Ci~il Service Board in writing.
