2 AN ORDINANCE OF THE MAYOR AND CCMHON COUNCIL OF THE CITY OF SAN
BERNAlIDINO APPROVING THE ANNEXATION DISTRICT NO. 69.

WHEREAS, heretofore a Petition was filed with the Common Council

.of the City of San Bernardino requesting that certain uninhabited territor,y
5
contigueus to said City be annexed to the City of San Bernardino and which sai
6
Petition described said territory and the boundaries thereof proposed to be
7

annexed to the City; and
WHEREAS, said Petition was filed by the Ol'ners of not less than .one
fourth of the area of land in such territory and representing net less than
one-feurth of the assessed value of such territory according te the last pre-

ceding equalized assessment roll of the COWlty 9f,Sa.n Bernardino, in which
said County too City of San Bernardino is situated; and
WHEREAS, the said Petition requested the said territery to be
annexed te and included in the, ~aid'municipal corporation, in accordance
with the provisions of the Government Code, Section 35300. et seq., and
WHEREAS, all and each of the o~mers of all of the aforesaid real
property and .of each and every parcel contained therein have consented in
writing and filed \iith the City Clerk of the City of San Bernardino, who acts
as Clerk for said Common Council, their consent and agreement that all .of the
property included in the aforesaid territory shall be taxed equally with the
other property within the said City te pay the bonded indebtedness and any and
all general indebtedness and liability of the City of San Bernardino contrac-
ted prior to .or fellowing or outstanding at the time the aforesaid Petition
of the annexation was filed and subsequent thereto. as provided in said
Government Code, and
WHEREAS, en the

1954, a Resolution was adopted by the aforesaid Common Council of the City of
San Bernardino, California. propesing the annexation of the aforesaid unin-
habited territory to be generally known as the ANNEXATION DISTRICT NO. 69 to
the City of San Bernardine, and that said Resolution provided therein that the
preposed annexation should be generally known and identified as the ANNEXATION
DISTRICT NO. 69; and

WHEREAS, said Resolution set forth therein that all the property
included in the aforesaid territory should be taxed equally with the other
property within the said City to pay the bonded indebtedness and any and all
general indebtedness and liability of the City of San Bernardino, contracted
prior to or existing or outstanding at the time of the aforesaid proposed
annexation of the aforesaid property, as provided in the hereinbefore men-
tioned Government Code; and
WHEREAS, the said Resolution did fix, determine and declare that
a hearing would be held on the 15th day of March, 1954, at the hour of 7 :30
P. M. olclock in the Council Chambers in the City Hall in the City of San
Bernardino, California, and the same was the day, hour and place designated
where any person owning real estate within such territory so proposed to be
annexed and having any objection to the proposed annexation might object be-
fore the Common Council and show cause why such territory should not be
annexed, and furthermore, the said Resolution provided that at any time not
later than the said hour set, as mentioned hereinbefore for the said hearing,
any owner of property within the said territory proposed to be annexed might
file written protest with the City of San Bernardino against such annexation;
and,
WHEREAS, no objection or protests of any kind or nature whatsoever
were made or filed, either written or oral, with the said City of San Bernar-
dino and no protests or objections of any nature whatsoever were made, either
written or oral, at the meeting of the Common Council on the 15th day of
March, 1954, as mentioned hereinbefore, at which said meeting the said Common
Council publicly announced that any person, firm or corporation desiring to
protest or object to said annexation might do so at said meeting; and
w1!EREAS, it appears to the Common Council of the City of San Ber-
nardino that the aforesaid annexation proceedings have been completed and
everything performed at this time, in accordance with said Government Code,
and mentioned hereinbefore, and any and all other laws in any way connected
with the said annexation procedure, having been complied with; and
\'iHEREAS, the Common Council of the City of San Bernardino desires

1 to approve at this time the annexation of tre aforesaid territory.
2 NOW, THEREFORE, THE CCMMON COm~CIL OF THE CITY OF SAN BERNAIIDINO
3 DOES HEREBY aWAIN AS FOLl.(MS:

SECTION ONE: That said territory as herein described as Annexa-
5 tion District No. 69 is hereby annexed and incorporated in and made a part of
6 the City of San Bernardino.
SECTION TWO: The territory herein referred to as being annexed

to the City of San Bernardino is particularly described as follows, to wit:
BEGINNING at a point on the North line of "A" Street €I:> feet
wide, (now known as 42nd Street), as shown on plat of ArrfM-
head Suburban Farms, Tract "E", Tract 1748, recorded in Book
25 of Maps, at Page 59, records of the County Recorder of
San Bernardino County, said point being 150 feet East of the
West line of Section 16, Township One North, Range Four West,
San Bernardino Base and Meridian, and being on the present
corporate limits of the City of San Bernardino; thence .Easter-
ly along the present corporate limits of the City of San Ber-
nardino being also the North line of said "A" Street 300 fe,et;
thence Southerly and parallel to the West line of said Section
16 to a point 300 feet South of the South line of said "A"
street; thence Westerly and parallel to the South line of "A"
street 150 feet; thence Southerly and parallel to the West
line of said Section 16, 206 feet; thence Westerly and parallel
to the South line of said "A" Street 150 feet to a point in the
present corporate limits of the City of San Bernardino; thence
Northerly along the present corporate limits of the City of
San Bernardino, to the point of beginning.
SECTION THREE: That the above described property shall be subject
to taxation, equally with the property within such municipal corporation, to
pay its proportion of the following bonded indebtedness of the City of San
Bernardino, which said bonded indebtedness was outstanding at the time of
filing said Petition or theretofore authorized and is outstanding at the time
of said annexation, to wit:
A bonded indebtedness of $200,000.00 incurred for the construction
and completion of a convention hall, the outstanding indebtedness thereon be-
ing $45,000.00, bearing interest at the rate of 5% per annum;
A bonded indebtedness of $275,000.00, incurred for the acquisition
and construction of water works, including "Devil Canyon Water Works", water
rights, rights of way, pipe lines, wells and pumping plants, the outstanding
indebtedness thereon being $82,500.00, bearing interest at the rate of 5% per
annum;

A bonded indebtedness of $650,000.00, incurred for the acquisition
of real property, and construction of a sewage disposal plant, inverted siphon
sewer lines and intercepting sewers, the outstanding indebtedness thereon
being $129,999.96, bearing interest at the rate of 4!% per annum.
SECTION FOUR: The property herein annexed is declared to be a part
of Ward 4, ani the boundaries of Ward 4 are hereby altered to include said
annexed territory; and said property is placed and declared to be in Zone
M - 1 under the Zoning Ordinance and Regulations of said City.
SECTION FIVE: The City Clerk shall certify to the passage of this
ordinance and shall cause the same to be published three consecutive times in
the San Bernardino Evening Telegram, a daily newspaper designated for that
purpose.
I HEREBY CERTIFY that the foregoing ordinance was duly adopted by
the Mayor and Common Council of the City of San Bernardino at a regular meet-
ing thereof held on the
