AN ORDINANCE AMENDING ORDINANCE NO. 1991 OF 'IRE CITY OF SAN BERNAR-
DINO, COMMONLY KNOViN AS THE "LAND USE ZONING CRDINANCE."

The Mayor and Common Council of the City of San Bernardino do ordain
as follows:

SECTION 1. Section 24 of Ordinance No. 1991 is hereby amended to
read as follows:

Section 24.1. No building or structure shall be moved from one lot
or parcel to another lot or parcel in the City, or be moved, from any, lot, or v
~., '.
parcel outside of the City, to a lot or parcel in the' City, without fll-st
filing with the Collllllission an application for such moving, and obtaining a
penuit therefrom to allow such moving to be done.
Section 24.2. Any person, firm or corporation desiring to move any
building or structure from one lot or parcel to another lot or parcel in the
City of San Bernardino, or from some lot or, parcel outsidEi' of the City of San
Bernardino to a lot or parcel in the City of San Bernardino, shall file an
application with the Collllllission, which application shall set forth the follow-
ing information:
(1) Location and address of the old and proposed new site.
(2) Plot plan of the new site, setting forth the size and
shape of the adjacent lots or parcels, including a description of structures
and improvements thereon.
(3) Plans and specifications setting forth proposed im-
provements and remodeling of such building or structure at the new site, in-
cluding landscaping.
Section 24.3. Said application shall be accompanied by a fee of
$25.00, which fEle shall be exclusive of any other fees required by other ordi-
nances pertaining to such mOVing.
Section 24.4. Upon the filing of said application and payment of fil-
ing fee, said application shall be referred to the Chief Building Inspector of
the City, who shall within five ('5) days make an inspection of the building or
structure to be moved, and report to the Planning Commission the type of con-
struction, age and present condition of such building or structure. In the
event said application is for the moving of a building or structure from a

point outside of tba City to a lot or parcel inside tba City, the application
shall also be accompanied by a fee of $65.00, which fee shall be paid to the
Chief Building Inspector in addition to the fee provided in Section 24.3 here-
of, and which additional fee shall be for the purpose of reimbursing the City
for the cost and expense of such inspection. In all cases where an applica-
tion is filed under this section, the applicant shall make the property avail-
able for inspection at such time as is requestecl by the Chief Building Inspec-
tor.
Section 24.5. Upon receipt of said application, the Planning
Director shall forthwith by letter or other written means report to the City
Councilman of the Ward wherein the new site is located, the substance 'of the
application for such moving.
Section 24.6. After the receipt by the Planning Commission of the
report of the Chief fuilding Inspector, the Planning Commission shall hold a
hearing on such application, giving such notice as it deems sufficient to in-
form all persons interested of the fact of said application, and date and
place of hearing. At the time of hearing, the Planning Commission shall hear
all persons who may appear to support or protest the granting of the applica-
tion. After the hearing the Commission shall make its recommendation to the
City Council for its approval, rejection or modification. In making its re-
commendation to the Council, tba Commission shall report all such changes, re-
pairs or modificiations of the building or structure to be moved, which in its
judgment are necessary and proper to comply with the provisions of this ordin-
ance and other laws and ordinances of tba City.
Section 24.7. The recommendation of the Planning Commission shall
be acted upon by the City Council at its rext regular meeting.
Section 24.8. In making its recommendation to the Council, the Com-
mission shall find, in the event it approves the moving of said building or
structure, that such moving shall have no detrimental effect Gn the living
environment and prGperty values in the area into which the building or struc-
ture is to be moved.

Section 24.9. In all cases where the moving permit covers the
moving from one site within the Oity to another site ,within the Oity, it
shall be a condition of such moving permit that the applicant, upon said
blilding or structure being moved eft of a lot, shall clear the site from
which said building or structure is maTed within a period of thirty (.30) dqs
atter removal of said building or structure of all rock, brick, foundation
material, and waste am debris of all kinds, including deaj or uncared for
trees and vegetation, and shall also fill up any holes or excavations, so
that the premises after the moving shall be left in a clean, sightlJr and safe
condition; and in the event the applicant does not clean up said site as
herein prescribed within said period of time, the City may itself clean up
the site or cause the same to be done by other persons, in which event the
reasonable cost thereof shall be a charge against the applicant and his surety.
Section 24J.0. In the event the City Council acts favorablJr on said
application, and allows said building or structure to be moved, it shall order
a building permit issued by the Chief Building Inspector, covering the same,
on such terms and conditions as the City Council may prescribe; prOVided,
however, that before such permit is issued, there shall be deposited by the
applicant with the Chief Building Inspector a surety bond made payable to the
City of San Bernardino in an amount equal to the reasonable am estimated
cost of the repairs or additions required to be made to the building or struo-
ture to be moved, including cost of clean-up required by Section 24.9 hereof,
but in no case less than the sum of One Thousand Dollars ($1,000.00), which
said bond shall be conditioned upon the faithful performance by the applicant
of the terms and conditions of the permit as issued, including the cleaning
up of the site and other work required by Section 24.9 hereof, and reimburse-
ment to the City or other persons in interest of the cost of eIeaning up said
site in the event said Cleaning up is not done by the applicant within the
time prescribed; provided, however, that such faithful peformance bond need
not CaTer the cleaning up of the site in cases where the building or structure
is moved from a site outside of the City to a site within the City.
SKCl'IOO 2. Ordinance Nos. 1.750, 1.855 and 2008 are hereby repealed.
