ORDINANCE NO. :;Zo::J.7 AN ORDINANCE OF THE CITY OF SAN BERNARDINO, CALIFORNIA, ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL ELECTION TO BE HELD IN THE CITY OF SANJBERNARDINO ON THE 8TH DAY OF JUNE, 1954, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY A PROPOSITION TO INCUR BONDED INDEBTEDNESS BY SAID CITY FOR A CERTAIN MUNICIPAL IMPROVEMENT, AND CONSOLIDATING SAID ELECTION WITH THE STATEWIDE PRIMARY ELECTION ON SAID DATE. WHEREAS, the Mayor and Common Council of the City of San Bernardino, California, did on the ..5 Ii. day of ~h~~ , 1954, by a vote of more than two-thirds of the members of said Common Council, adopt Resolution No. ?~go entitled "A Resolution of the Mayor and Common Council of the City of San Bernardino, California, determining that the public interest and necessity demand the acquisition and construction of a certain municipal improvement, and making findings relat- ing thereto," which said resolution was duly signed and approved by the Mayor of said city and attested and certified by the City Clerk of said city; The Mayor and Common Council of the City of San Bernardino DO ORDAIN as follOWS: Section 1. That a special election be held, and the same is hereby called to be held, in the City of San Bernardino, California, on the 8th day of June, 1954, for the purpose of submitting to the qualified voters of said city a proposition of incurring indebtedness and issuing bonds of said city therefor, in the amount hereinafter set forth, and for the objects and purposes set forth in said resolution and herein- after stated. . . Section 2. That the object and purpose for which said indebtedness is to be incurred and and bonds issued therefor are as follows: The acquisition and construction by the City of San Bernardino of a certain municipal improve- ment, to wit: a public library building with vehicle parking therefor and the planting and landscaping of the library grounds, 1nclud1ng the acqu1s1t10n of all land, furn1sh1ngs, f1xtures, equipment and other property necessary therefor. Sect10n 3. That the est1mated cost of the mun1c1pal 1mprovement described 1n Sect10n 2 hereof is the hundred n1nety-sev~h~Jds~rfars ($897,000) and that sum of e1ght the amount of the pr1ncipal of the 1ndebtedness to be incurred therefor 1s thousand the sum of e1ght hundred n1nety-seven/dollars ($897,000). That the maximum rate of interest to be pa1d on sa1d 1ndebtedness shall not exceed the maximum rate permitted by law, to wit, s1x per cent (6%) per annum, payable annually the first year and semiannually thereafter, the actual rate or rates of 1nterest on said bonds to be determ1ned at the t1me of the sale or sales thereof. That 1f the propos1t10n for the 1ncurr1ng of bonded indebtedness so subm1tted rece1ves the requ1s1te number of votes, to w1t, two-th1rds of the votes of the qua11f1ed electors vot1ng on sa1d propos1t10n, bonds of sa1d c1ty, 1n not exceed1ng the princ1pal amount stated 1n such propos1t10n, shall be 1ssued and sold for the object and purpose set forth 2. in said propos1t10n. Sect10n 4. That the polls for sa1d elect10n shall . . be opened at seven o'clock A.M., of the day of said election and shall remain open continuously from said time until seven o'clock P.M., of the same day, when said polls shall be closed, except as provided in Section 5734 of the Elections Code of the State of California. Section 5. This election being consolidated with the statewide primary election and the Board of Supervisors being authorized to canvass the returns and only one form of ballot being authorized, the method of voting upon said bond proposition shall be as provided in the Elections Code of the State of California, and on the ballots to be used at said special election, in addition to any other matters required by law, there shall be printed substantially the following: MARK CROSSES (+) ON BALLOT ONLY WITH RUBBER STAMP; NEVER WITH PEN OR PENCIL. (ABSENTEE BALLOTS MAY BE MARKED WITH PEN AND INK OR PENCIL.) INSTRUCTIONS TO VOTERS To vote on any measure, stamp a cross (+) in the votini s~uare after the word "YES" or after the word NO. All marks, except the cross (+) are forbidden. All distinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the inspector of election and obtain another. 3. . . . . . . . . CITY OF SAN BERNARDINO LIBRARY BOND: PROPOSITION: Shall the City of San : Bernardino incur a bonded indebted- : : ness in the principal sum of $897,000 : : for the acquisition and construction : : by said city of a certain municipal : improvement, to wit: a public library : building with vehicle parking there- : for and the planting and landscaping : : of the library grounds, including the : : acquisition of all land, furnishings, : : fixtures, equipment and other pro- : perty necessary therefor? . . : . . . . . . . . YES : . . . . . . . . . . : . . . . . . . . . . : NO : . . . . . . . . . . . . Section 6. A eross (+) placed in the voting square after the word "YES" in the manner hereinbefore provided shall be counted in favor of the adoption of the proposition. A cross (+) placed in the voting square after the word "NO" in the manner hereinbefore provided shall be counted against the adoption of the proposition. Section 7. That said special election hereby called to be held in the City of San Bernardino on the 8th day of June, 1954, shall be and is hereby ordered consolidated with the statewide primary election to be held on said date, and within the City of San Bernardino the precincts, polling places and officers of election for the special election hereby called shall be the same as those provided for said primary election. The Board of Supervisors of the County of San Bernardino is hereby requested to order the consolidation of the special election hereby called with said statewide primary election, and said Board of Supervisors is authorized hereby to canvass the returns of the special election hereby called, and the elections shall be held in all respects as if there were only one election, and only one form of ballot, namely the ballots used at such primary election, shall be used. Said Board of Supervisors shall certify the result of the 4. . . . canvass of the returns of such special election to the Mayor and Common Council of the City of San Bernardino who shall thereupon declare the result thereof. Said proposition shall be designated on the ballot by a letter printed on the left margin of the square contain- ing the description of the measure, as provided in Section 3831 of the Elections Code of the State of California. Section 8. That only qualified voters of the City of San Bernardino shall be permitted to vote at the election hereby called. Section 9. That the City Clerk shall certify to the passage and adoption of this ordinance by the Common Council of said city by a vote of more than two-thirds of all of its members, and shall cause this ordinance to be published once a day for at least seven (7) days prior to the time appointed for the holding of said election in the SAN BERNARDINO EVENING TELEGRAM, a newspaper printed and published seven days a week in said city. No other notice of such election need be given. Section 10.
