WH&~AS, heretofore a Petition ,~s filed with the Common Council of
the City of San Bernardino requesting that certain uninhabited territory
contiguous to said City be annexed to the City of San Bernardino and which
said Petition described said territory and the boundaries thereof proposed to
be annexed to the City; and
WHEREAS, said Petition was filed by the owners of not less than one-
fourth of the area of land in such territory and representing not less than
one-fourth of the assessed value of such territory according to the last pre-
ceding equalized assessment roll of the County of San Bernardino, in which
said County the City of San Bernardino is situated; and
VrHE~AS, the said Petition requested the said territory to be
annexed to and included in the said municipal corporation, in accordance
with the provisions of the Government Code, Section 35300, et seq., and
WHEREAS, all and each of the O1'illerS of all of the aforesaid real
property and of each and every parcel contained therein have consented in
writing and filed with the City Clerk of the City of San Bernardino, who acts
as Clerk for said Common Council, their consent and agreement that all of the
property included in the aforesaid terr~tory shall be taxed equally with the
other property within the said City to pay the bonded indebtedness and any
and all general indebtedness and liability of the City; of San Bernardino con-
tracted prior to or following or outstanding at the time the aforesaid Peti-
tion of the annexation was filed and subsequent thereto, as provided in said
Government Code, and
WHEREAS, on the 5th day of April, 1954, a Resolution was adopted by
the aforesaid Common Council of the City of San Bernardino, California, pro-
posing the annexation of the aforesaid uninhabited territory to be generally
known as the ANNEXATI ON DISTRICT NO. 70 to the City of San Bernardino, and
that said Resolution provided therein that the proposed annexation should be
generally known and identified as the ANNEXATION DISTRICT NO. 70; and
W1JEREAS, said Resolution set forth therein that all the property in-

cluded in the aforesaid territory should be taxed equally with the other pro-

perty within the said City to pay the bonded indebtedness and any and all
general indebtedness and liability of the City of San Bernardino, contracted

prior to or existing or outstanding at the t:LJLe of the aforesaid proposed
5
annexation of the aforesaid property, as provided in the hereinbefore men-
6
tioned Government Code; and
7
WHEREAS, the said Resol'ltion did fix, determine and declare that a

hearing would be held on the J6~day of May, 1954, at the hour of 7:30 o'clock

P. N., in the Council Chambers in the City Hall :Ln the City of San Bernar-
dino, California, and the same was the day, hour and place designated where
any person owning real estate within such territory so proposed to be annexed
and having any objection to the proposed annexation rfright object before the
Common Council and show cause why such territory should not be annexed, and
furtherraore, the said Resolution provided that at any time not later than the
said hour set, as mentioned hereinbefore for the said hearing, any owner of
property within the said territory proposed to be annexed might file written
protest with the City of San Bernardino against such annexation; and
w1ffiaEAS, no objecti9n or protests of any k:Lnd or nature whatsoever
were made or filed, either written or oral, with the said City of San Bernar-
dino and no protests or objections of any nature whatsoever were made, either
written or oral, at the meeting of the Conunon Council on the ft1{t.~[1 of May,
1954, as mentioned hereinbefore, at which said meeting the said Common Coun-
cil publicly announced that any person, firm or corporation desirir~ to pro-
test or object to said annexation might do so at said meet Lng; and
~1HEP.EAS, it appears~o the Common Council of the City of San Bernar-
dino that the aforesaid annexation proceedings have been completed and
everything performed at this tine, in accordance with said Government Code,
and mentioned hereinbefore, and any and all other laws in any way connected
\dth the said annexation procedure, having been complied with; and
\iHEREAS, the Conunon Council of the City of San Bernardino desires
to approve at this time the annexation of the aforesaid territory,

SECTION O,{E: That said territory as herein described as Annexation
2 District No. 70 is hereby annexed and incorporated in and made a part of the
3 City of San Bernardino.

SECTION TWO. The territory herein referred to as being annexed to
5
the City of San Bernardino is particularly described as follows, to wit:

Being a portion of Lot 11, Block 43, of San Bernardino
Rancho in the County of San Bernardino, State of Cali-
fornia, as per plat recorded in Book 7, Page 2, of Maps,
Records of said County, and more particularly described
as:

BEGINNING at a point in the present corporate limits of
the City of San Bernardino, said point being the point
of intersection of the center line of Waterman Avenue,
82.5 feet wide, l~_th the westerly prolongation of the
southerly line of Ninth Street, 82.5 feet wide, as Ninth
Street extends east;
Thence easterly along the westerly prolongation of the
south line of Ninth Street and the south line of Ninth
Street to a point 417.6 feet east of the center line of
Waterman Avenue;
Thence southerly and parallel with the center line of
Waterman Avenue, 186 feet;
Thence westerly and parallel with the south line of said
Ninth Street and the westerly prolongation of the south
line of said Ninth Street 417.6 feet to the center line
of Waterman Avenue;
Thence northerly along the center line of Waterman Avenue,
being along the present corporate limits of the City of
San Bernardino, 186 feet to the point of beginning.
SECTION THREE: Trot the above described pt"operty shall be subject
to taxation, equally with the property within such municipal corporation, to
pay its proportion of the following bonded indebtedness of the City of San
Bernardino, which said bonded indebtedness was outstanding at the time of
filing said Petition or theretofore authorized and is outstanding at the time
of said annexation, to wit:
A bonded indebtedness of $200,000.00 incurred for the construction
and completion of a convention hall, the outstanding indebtedness thereon be-
ing $45,000.00, bearing interest at the rate of 5% per annum;
A bonded indebtedness of $275,000.00, incurred for the acquisition
and construction of water works, including "Devil Canyon Water Works", 'later
rights, rights of way, pipe lines, wells and pumping plants, the outstanding

1 indebtedness thereon being $82,500.00, bearing interest at the rate of 5% per
2 annum;
3 A bonded indebtedness of $650,000.00, incurred for the acquisition
4 of real property, and construction of a sewage disposal plant, inverted siphon
5 sewer lines and intercepting sewers, the outstanding ll1debtedness thereon being
6 $129,999.96, bearing interest at the rate of 4~ per annum.

SECTION FOUR: The property herein annexed is declared to be a part
9 annexed territory; and said property is placed and declared to be in Zone C-M
10 under the Zoning Ordinance and Regulations of said City.

SECTION FIVE: The City Clerk shall certify to the passage of this
ordinance and shall cause the sa'lle to be published three consecutive times in
the San Bernardino Evening Telegram, a daily newspaper designated for that
purpose.
I HEREBY CERTIFY that the foregoing ordinance was duly adopted by
