() s 3 1 AI>: ORDINANCE ADOPTING AND ESTABLISHING RULE;S Al\TD REGULATIONS 2 FOR THE CONSTRUCTION OF BUILDINGS WITHIN THE CITY OF SAN 3 BERNARDINO AND ADOPTING A BUILDING CODE FOR SAID CITY; PROVIDING, 4 CREATING AND ESTABLISH:NG FIRE ZONES IN SAID CITY. 5 THE HAYOR AND COLE,ON COUNCIL OF TW.i: CITY OF SAN BSRNARDINO 6 DO ORDAIN AS FOLLO'YS: 7 SECTION ONE: That the Building Code herein referred to is con- a tained in book form, designated as Volume I, together with all the 9 provisions in the appendix, and Volume III, entitled "Uniform 10 Building Code, 1952 Edition ", prepared by the P8.cific C08.St Bulld- 11 ing Officials Conference, three copies of each designated volume 12 I now on file in the office of the City Clerk of sald City and 13 I identified by the certificate attached thereto of the City Clerk of 14 I 88.id City reading as follows: 15 I "I, Jack T. Felton 20 II City Clerk of the City of I 21 II San Bernardino.H 22 Ii SECTION TWO: That the provisions of sald Building Code, except 23 la8 herein otherwise provlded, be and they are adopted herein by I 24 ,i reference, and that said Sections aforesaid, except as herein Ii II 25 iiprovided, shall constitute the Building Code of the City of San " ., .. 26 ii Bernar,dno covering the subjects and matters therein referred to; i 27 iland provided, further, tha.t said Code shall be amended by adding or <I " " 28 jimodlfying the following sections, to-wit: i1 29!: 303(a) Table No. 3A: By strikinp, the entire second and third 30iline from Table No. 3A and substituting in lieu thereof the words 3l,iitc20.00 to and including '?400.0~ Fee [1:2.00;11 , 32 ,i 303(b): By striking from the fourth line of"Exception~' the " :: I, il " 'i ;j . . -2- 1 words $10,000.00; Q/CI3 The following subsections are added to Section 303 of said Clodel 2 303(c): The City, County, State or the ~nited States of America, . er any school district; 3 ~hall be exempt from the paying of any fee for any building; 4 303(d): The Building Inspector shall determine the estimated 5 valuB.tion in all cases, and for such purpose he shall be guided by 6 approved estimating practices; 7 303(e): Any person taking out a permit for the general construc- 8 tion of any building or project shall do so at least eight days I i I I 9 prior to the start of actual construction; 10 303(f): A sub-contractor shall obtain a permit or notify the 11 Inspector prior to the start of his work; 12 303(g): Where work for which a permit is required by this Code 13 is started or proceeded with, prior to obtaining said permit, or 14 where the proceeding paragraphs are violated, an additional fee of 15 10% of the cost of the project shall be paid, not to exceed the sum 16 of $200.00, and it shall be the duty of the Chief Building and/or 17 Plumbing and Electrical Inspectors to levy and collect said 18 additional fees. The payment of such fee shall not relieve any per- 19 sons from fully complying with the requirements of this Code in the 20 execution of the work nor from any other penalties prescribed 21 herein; 22 303(h): The Chief Building Inspector shall keep a permanent, 23 accurate account of all fees and other moneys collected and received 24 under this Code, the names of the persons upon whose account the 25 same were paid, the date and amount thereof, together with the 26 location of the building or premises tio which they relate; 27 1005: Deleting therefrom the fourth paragraph of said section 28 and substituting in lieu thereof the following: Every building, 29 office or portion thereof where persons are employed shall be pro- 30 vided with at least one toilet, and roughing in for second toilet 31 shall be installed for future use or expansion. Also by striking out all of Sub-section (c) and (d), and insert in lieu thereof the following: "Thickness: The maximum height or thickness of a marquee measured vertically from its lowest to its highest point shall not exceed three feet {J')." 4506. By deleting therefrom Section 4506 of said Uniform Build ng Cd" and substituting in lieu thereof the following: Movable or hoods must be constructed of canvas, cloth or fabric supported on an incombustible frame attached to the building in such a manne that it can be lowered or folded against the building. Metal awn- ings are prohibited on all commercial buildings unless they are constructed so as to comply with the live load and other require- ments of the Code applicable to marquees; That all awnings hereafter constructed shall comply with the following specif ications: (a) Awnings not more than twenty feet long shall have at least two arms supporting the same, and all awnings over twenty feet Ion shall have one additional arm supporting the same for each additio al ten feet or fraction thereof in length. That each lateral arm sha 1 be securely fastened to the building with at least three lag screw or bolts not less than 3/$" in diameter nor less than 4-1/2" in lengt . (b) Rope hoist awnings not more than twenty feet in length shall have at least three rope hoists and one additional rope hois for each additional ten feet or fraction thereof in length. (c) Slide rod awnings shall not be erected where the wall heig t is less than one-third of the projection. The front rod of all ro e hoist awning frames which span over ten feet in width shall be con structed of galvanized iron pipe not less than 3/4" in diameter. (d) The frames of all rope hoist awnings, together with the arms and lateral arms, shall be constructed of metal. (e) No awnings shall be more than ten feet in projection. Th . . -5- 1 The frames and supports for all awnings shall be securely attached 2 to the walls of the building. 3 (f) The lowest point of the frame of awning shall not be less 4 then 81 above the surface of the sidewalk of the street, and the 5 lowest part of the curtain scallop or valance, or any other part of 6 the awning extending more than 6" from the building upon which it 7 is constructed shall be at least 716" above the level of the side- 8 walk at all times. 9 (g) Any person, firm or corporation desiring to construct or 10 install an awning or awnings within the City of San Bernardino 11' shallfile with the Chief Building Inspector of said City a bond in 12 the penal sum of $1,000.00 for the benefit of the City of San 13 Bernardino and the per.on, firm or corporation for whom the awning 14 shall be constructed; conditioned that any awning constructed or 15 installed by the principal named in said bond shall conform to the 16 I specifications provided for in this Ordinance. Ordinance No. 1110, 1438, 1448, 1526, 1591, 1599, 1641, /7S(,. 91Cf! 1710, 1751,111771, 1852, 1882, 1980, 1985. 54 and 60. 5 SECTIONTEN~~~: The City Clerk shall certify to the passage of 6 this Ordinance and shall cause the same to be published three con- 7 secutive times in the San Bernardino Evening Telegram, a daily 8 newspaper hereby designated for that purpose. 9 SECTION ~LEVEN: That any person, firm or corporation violating 10 any of the provisions of this Ordinance, or said Building Code 11 shall be deemed guilty of a misdemeanor, and upon conviction there- 12 of shall be punishable by a fine of not more than Five Hundred 13 Dollars ($500.00), or by imprisonment in the City Jail for a 14 period of not more than six months, or by both such fine and im- 15 prisonment. Eaoh person, firm or oorporation shall be deemed 16 17 1 16 19 20 21 guilty of a separate offense for every day during any portion of which any violation of any provision of this Ordinance or said Building Code is committed, continued or permitted by such person, firm or corporation and shall be punishable therefore as prOVided by this Ordinance. SECTION TWEBVE:: That if any section, sub-section, sentence, 22 clause or phrase of this Ordinance or said Building Code is for 23 any reason held to be invalid or unconstitutional by the decision .. I . 24 of any oourt of oompetent jurisdiction, such decision shall not 25 affeot the validity of the remaining portions of the Ordinance or 26 Building Code.
