AN ORDINANCE OF THE CIn' .OF SAN BERNARDINO PROVIDING FOR THE CONOOC-
TING OF THE PRIMAIW AND GENERAL ELECTIONS TO BE HEW ON EACH 000 NUMBERED YEAR
IN THE CITY OF SAN BERNARDINO, PURSUANT TO SECTION TEN OF THE CHARTER OF THE
CITY OF SAN BERNARDINO, CALIFORNIA.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN
AS FOLLOWS:
SECTION ONE: That a primary election shall be held on the third Tues-
day in March, 1955 and a like election to be held on the third Tuesday in March
every four years thereafter, in the City of San Bernardino, City of San Bernar-
dino School District and the City of San Bernardino High School District for the
nomination of candidates for the following offices:
1. Mayor;
2. Member of the City Council from the Third Ward;
3. Member of the City Council from the' Fifth Ward:
4. City Clerk;

,5. City Treasurer;
6. City Attorney;
7. Two members of the Board of Education, all of. whom
shall be qualified electors of the City of San Ber-
nardino School District, to be elected for full
terms: and
8. A, member of the Board of Education who shall be a
qualified elector and resident of that portion of
the San Bernardino High School District not included
in the City of San.Bernardino School'District, to
be elected for a full term.

1 The total number of ballots cast for candidates for any office shall be deter-

(e) Date filed with the City Clerk. All nomination papers shall be
filed with the City Clerk not later than 12:00 o'clock noon on the fortieth day
before said municipal election.
(f) Filing fee. The City Clerk shall supply all forms required for
nominations and election to all City offices. Such forms shall be distributed
without charge to all such candidates applying therefor; provided, however, that
10 i such forms shall not be distributed except upon the prepayment of the filing

111 fees. The filing fee for any office shall be two per cent of the first year's
121 salary for the office for which the candidate is issued papers. No nomination

13: papers shall be issued or filed except upon proof of said prepayment. The fil-

14 ing fee shall not be refunded in the event the candidate fails to qualify as a
15, candidate. No filing fee shall be required of a candidate for member of the

SECTION FOUR: The City Clerk is hereby instructed and authorized to
procure, prepare a'nd distribute all necessary ballots and election supplies for
said election.

SECTION FIVE:
That the hour of seven o'clock A. M. on the date of
said elections is herebY fixed as the hour for opening the polls, and the hour

1 arrive at a polling place after seven o'clock P. M. shall be entitled to vote,
2 although the polls may be open when such person arrives. That primary elections
3, shall be held at the regularly designated pOlling places in each precinct as
4 designated in the Resolution setting forth the number of consolidated precincts
5 and the ,location of each polling place. Said Resolution shall aI.so set forth
6 the'list of the names of the election officers appointed. ~ach .precinct board
7 shall consist of one (1) Inspector, one (1) Judge and three (3) Clerks.
8, Not earlier than the Sixtieth nor later than the thirty-first day be-
9 fore anY primary election and not earlier than the twenty-fifth day nor later
10 than the tenth day before any general municipal election, the City Clerk shall
1.1 publish a notice of the election at least once in one or more newspapers pub-
12 lished and circulated in the City of San Bernardino. The notice shall be headed
13 "Notice of Election," and shall contain a statement of:

(a) The time of the election;
(b) The offices to be. filled, specifying full term
or short term, as the case may be;
(c) The measures to be voted on, if any;
(d) A brief general description of the voting precincts
and location of the polling places.
SEGrION SIX: The City Clerk shall publish a list of the names of the
20 nominees, in alphabetical order, or in the order in which they appear on the
21 ballot, and the respective offices for which they have been nominated at least
22 twice before the day of election in one or more daily or weekly newspapers pub-
23 lished in the City.

SEGrION SEVEN: On the second day after a municipal election, exclu-
25 sive of holidays, at 7:30 o'clo.ck P. M., the Mayor and Common Council shall meet
2~ at the City Hall and proceed to canvass the election returns and declare the
27 result.

SEGrION EIGHT: That all ballots cast under the provisions of the Ab-
29 sent Voters Law shall, in order that they may be counted, be receivild by the
30 clerk from whom they were received within six days after the d<lteof the elec-
31 tion in whiCh they are to be counted. As soon as all absent voter ballots issued
32 have been received or returned and accounted for, and in no case later than seven

1 days after any municipal election, the Mayor and Common Councilor an election
2 board authorized by the Mayor and Common Council shall count. and canvass all of

SECTION NINE: General Elections. General Elections shall be conduc-
5 ted under the same laws as the Primary Elections and shall be held on the second
6 Tuesday of April of each odd-numbered year. Names of candidates elected in the
7 Primary Election need not appear on the ballot in tile ensuing General Election.

SECTION TEN: Term of Office. The Mayor shall be elected biennially

9 and hi s term of office shall be for two years from and after the second Monday
10 in May next succeeding his election; the City Clerk, City Treasurer and City
11 Attorney and the members of the Common Council shall hold office for a term of
12 four years from and after the second Monday in May next succeeding their elec.
13 tion.

SECTION ELEVEN: The City Clerk shall certify to the passage and adop-
tion of this Ordinance by the Council of the City of Sari Bernardino and shall
cause the same to be published three consecutive days in the San Bernardino
Evening Telegram, a daily newspaper of general circulation printed and published
within the City Jjf San Bernardino.
