I AN ORDINANCE ESTABLISHING ELECTRICAL COVE , OF 'THE CITY OF SAN BERNARDINO CALIFORNIA THE MAYOR AND CXMMON COUNCIL OF '!HE CITY OF SAN BERNARDINO DO OODAIN AS FOLLOWS: t~. l~tl I1_eli. =1~55) The Electrical Code of the City of San Bernardino is hereby revised to read as follows: Section 1 Aoolications and Permits No alterations or additions shall be made in existing wiring, nor shall any wiring tor the placing of any electric lights, power or heating devices operating at more tl:an 25 volts and which generates, transmits, transforms or utilized more than 50 watts, nor shall any altera- tions be made in any wiring system atter final inspection, with- out notifying the City Electrician and securing a permit therefor, except minor repair work, such as repairing flush and snap switches, changing fusee, changing lamp sockets and receptacles, taping bare joints and repairing drop cords~ Application for such permit, describing such work, shall be made to the City Electrician in writin~ by the person, firm, or corporation in- stalling same and permit when issued shall be to such applicant. This paragraph shall not apply to maintenance and repairs on the premises of a person, firm or corporation regularly employing journeymen electricians. Uires which are to be hidden from view shall state the location by street and house number and where pOSSible the block and lot n~~bers where such work is to be done; the permit issued shall be valid only for the location so stated and unless work issuance the permit shall is commenced within 30 days after .... be cooe null and void. Each appli- '- cation shall be accompanied by dra\'1ings or blue prints as required by the City Electrician which shall show the load at each outlet, type of outlet, wire and conduit sizes, distances, number of wires in conduit, location of every switch, panel board, tablet board and/or switchboard and as nearly as possible the manner in which all wires are to be installed, .S~ction 2 IoIa~nS\.n~ Elect.ricians Any person, firm or corporation, such as industrial establishme.nts and hotels em- ployin~ one or more journeymen electricians for the purpose of installation, alteration, maintenance and/or repairs on -:..= ,-- . . . . . . his or their own premis~s, shall pay a fee of Ten ($10.00) doliars to ,the City Electrician and obtain a certificate of r~gistration for such journeymen electricians, stating their ~ames and addresses. In case of a change of personnel a fee of Two ($2.00) dollars shall be paid to the City Electrician for each chanee. Each certificate of Registration shall expire on the last day of the year in which it was issued and may be renewed by appearing in person at the City Electrician's office and paying a renewal fee of Two (02.00) dollars within ten (10) days after the expiration of said Certificate of Regis- tration. Said person, firm or corporation shall make quarterly reports covering all installations, additions and alterations, paying fees in accordance with Code; shall have all work done in accordance with this Code and shall permit such inspection by the City Electrician as said City Electrician shall deem necessary. Section 3 l~ster Elect~Jl~ians A master electrician within the mea\ning of this Code is a person, firm or corporation engaged in the business of installing, altering and/or repairing electrical wiring of electrical lighting or heating apparatus for others, directly or by means of agents or employees. It shall be unlawful for any person, firm or corporation to engage in business within the City of San Dernardino as a master electrician without first having procured a license there- for as herein provided. Every application for a license as master electrician within the City of San Bernardino shall be made to the City Clerk, and shall be issued by the City Clerk only when the applicant therefor shall by written examination have estab- lished to the satisfaction of the City Electrician that such applicant possesses the qualifications and competency necessary to properly install electric wiring and electrical lightin~ and heating apparatus in accordance with the provisions of this Code. The possession of a valid electrical Contractors License (c-10). issued by Contractors License Board of the State of California shall be considered as evidence of competency. -2<.<'1 I \ . . . . , . . Any license ~ranted to any master electrician may be re- voked by a majority of the Common Council of said City, after notice to such licensee ~t least five days prior to the date of hearing, and the prior filing with the Clerk of said city of a complaint of the City F~ectiric1an requesting such revo- cation and setting forth the grounds thereof. No master electrician shall allow or permit anyone except himself, or his agents or employees, to install, alter and/or repair any electrical lighting or heatine; apparatus or equip- ment under any permit therefor obtained by him. Any violation of this paragraph, of this Code, by a master electrician shall be deemed sufficient ~rounds for revocation at his license as such. Any master electrician licensed under the provisions of this Code who shall allow or permit other than himself or his accredited representative to obtain a permit to perform electrical work under said license shall be guilty of misdemeanor and upon conviction thereof, shall be punished as herein provided. , Section 4 Inspection Upon the completion of the ldring in or on any building or structure of any nature, or tent, or premises, the person, firm or corporation installing the same shall in writi~ notify the City Electrician who shall inspect the installation, and if it is found to be fully in compliance with this COde, he shall issue as provided herein, a certificate of inspection or approval tag authorising connection to the electrical service and the energi3ing of the installation. All wires which are to be hidden from view shall be inspected before concealment and any person, firm or corporation installing such wires shall notify the City Electrician to make the required inspection before such wires are concealed, and shall not con- ceal same or allow same to be concealed until permission has been obtained in writing from the City Electrician. Permission to Cover ~orJi Permission to cover work to be concealtld shall be on a blue tag attached to the work in a _'~c-, ~ , ,--- . . . . suitable place and which shall show the date, location, that such pernission has been eranted and signature of the inspector. Approval Final approval of the wiring or any installa- tion except that of fixtures or other devices customarily or frequently installed under separate contract, shall be by means of a blue tag attached to the work in a suitable place and showing the date, location, approval and signature of the in- spector. Fixture Approval Approval of fixtures, sl~s and/or any apparatus used with electrical lamps or other form of electrical lientin~ or other devices customarily or frequently installed under separate contract, shall be by means of a ere en tag show- ing the date, location, approval and signature of inspector. ~. Tap. Upon the completion and approval of a job there shall be a green ta3 attached to the service switch granting permission to the power company or other serving agency to connect the installation for use. ~fuere there are no service drop wires none shall be run without this tag or a special green tag being at the service switch. This tag shall show the date, location, approval permission and the signature of the inspector. Disapproval Tap. if:here approval is witlilield a red tag showing date, location, defects in the work, and signature of inspector shall be attached in a suitable place to the work. All defects shall be corrected within 10 days after inspection and notification, or within other reasonable time allowed by the City Electrician. Section 5 Special Connection Tag No person, firm, corp- oration or branch or department of ariy city or other political subdivision shall furnish electrical service or connect, or cause or allow connection to be made of, any wires or other equipment over which electricity may be conducted or electrical energy dissipated or utilized, to any source or wires or other equipment already connected to a source or to any distributing . -~ . . . . system of electrical ener5Y, until said wires or other equipment shall have been inspected by the City Electrician and said certi- ficate of inspection or green taG shall have been issued. Pro- vided, however, that the City Electrician may give temporary permission to furnish electrical current throu~ any ~res or other equipment for a length of time not exceedine )0 days, if it appears to the City Electrician that such wires etc., may safely be used, and there exists an ure;ent necessity for use and specinl permission. In this case a special green ta3 ~hall be attached to a suitable place on the work and shall show the date, location, such special approval, date of expiration of such per- mission, and signature of inspector. Section 6 - RA~t of Access Said City Electrician shall have the right during reasonable hours to enter any building in the di8char~e of his official duties or tor the purpose of making an inspection or test of the installation of electric wiring, electric devices and/or electrical LUlterial contained therein. Section 7 - Reinspec~ion The City Electrician periodically shall make a thorough reinspection of the installation in or on buildings and/or premises ot all electric wiring, el~ctric devices and electric material now installed or that may here- after be installed. within the City of San Bernardino. and when the installation of any such wiring. devices and/or material is found to be in a dangerous or unsafe condition, the person. firm, corporation or political subdivision o\ming, using or operating the ~ne shall be notified in writing. and shall s make the necessary repairs or change. required to place such wiring devices and material in a safe condition and have such work completed within fifteen days or other reasonable period specified by the City Electrician in said notice and shall pay such fees as are required by this Code. The City Electrician is hereby empowered to disconnect or order the discontinuance ... of electrical service to such wirin~. devices and/or material -5- . . . . so found to be defectively installed until the installation of such wirirtg, devices and naterial has been cade safe as directed by the City Electrician and any person, firm or corporation or political subdivision ordered to discontinue such electrical service shall do so within 24 hours and shall not reconnect or allow it to be reconnected until notified by the City Electrician. Provided, Rowever,that no re-inspection shall be cade in any dwelling house, while the same is occupied as a dwelline, without the consent of the occupant thereof. No person or persons shall hinder or prevent the City Electrician or his deputies from making any inspection except in dwelling houses. Section 8 . Cost of Permit Fee The City Electrician shall colledt from any person, firm, corporation or political subdivision to whom a permit for doing electrical work has been granted the followin~ fees, at the ti:le the permit is granted, to-wit: No permit shall be issued for less tlmn one (vl.OO)Dollar, except for service permits to serving agency which shall be $.75 per service. Separate permits shall be issued for the installation of electrical conductors, and the installation of lighting fixtures. Combination wiring and fixture installation where not more than five lights are installed and only one inspection is necessary, may be covered by the permit issued for the installation of the electrical conductors, pro~ided the lighting fixtures are in- stalled by the person, fi~or corporation who is install1ng the electrical conductors. The term "lighting fi:>.:ture" shall include, cords, Chandeliers, receptacles, and brackets. Pendant switches shall be considered the same as one light fixture. Evtdence Failure to take out a permit and pay the fees therefor within 72 hours after commencin8 work shall be deemed prima facie evidence of violation of the provisions hereof. Section 9 - General Construction Except as provided other- wise herein, all installations whereby electrical energy is to be dissipated or utilized shall be in strict conformity with the provisions of statutes of the State of California, the rules and regulations of the Industrial Accident Cocmission of the state or California under the authority of the state statutes governing industrial installation, with rules and regulations of the Commission or Iwnigration and Housing of the State of California and with the nost approved methods of construction for the safety of life and property. The regulations as laid down in the llational Electrical Code, as approved by the American -8- , . . Engineering Standards Committee, and the ~ules and regulations of the Board of Fire Underwriters of the Pacific shall be prima facie evidence of such approved methods. In event of any conflict or inconsistency between any re- quirement herein given or prescribed and any requirement of any law, order, rules or regulations of the State of California con- cernin~ the same matter and applying to the case under consider- ation, that requirement which, in the opinion of the City Electrician, prescribes and establishes the higher standard of safety for life and property shall take the precedence and be complied with. ~'lhere the use of another fixture, device or r.tethod of con- struction or installation is desired at variance with those ,,,,,0= / I . ' . . . . label does pot mean that the naterials et cetera may be used indiscriMinately but only for the purpose for which approved. For good cause of when public interest may require, or pending approval, the City Electrician may waive by \iritinS in advance, the requirenents of this section, but such waiver shall apply only to the one particular installation and shall not set a precedent as to further use. Sec~ion 11 - Otd ~~ter~ Old or used material shall not be used in any work without the written approval obtained in advance from the City F.lectrician. Section 12 - A1terat~nl Additions to, extensions, altera- tions and renewals of existing installationsd1all be made in com- pliance with provisions of this code, except that existing in- stallations of lawfully installed non-metallic wiring may be added to, extended, altered or renewed, provided such addition does not exceed the capacity of the existin~ circuits. ~~ere .. such replaceoent is due to damage by fire, any part of an existing non-metallic system may be replaced unless the existing circuits are overloaded, in which case new circuits shall be installed. Complete circuits shall be of type required by Section ~~ of this Code. Section *3 - Outside ~or~ No open wiring requiring more than one set of knobs or insulators, shall be installed on out- side of buildings except as permitted elsewhere herein. Section 14 - ~Qle Construction All pole line construction and conductors over buildings shall comply with the rules and r,;gulations of the Public Utilities Commission of the State of California. Section 15 - Service Wires All service wIres shall be brought out from a buildinB at a point where service wires can be run free of obstruction, and readily and conveniently accessible to the nearest pole of service company or source of supply, and shall be so located that the service wires when attached will . - not approach the buildi~ at an angle of less than thirty (30) -10- . . No entrance wires shall be brought out on the side of the building unless there is a two foot clearance between the building wall and the lot line, except where such wall faces a public high- way. Entrance wires shall be brought out for connection from the public alley in the rear of a buildinB, except where there is an existing pole line in the street and none in the alley, in which case, entrance wires shall enter the building on the street side of sarna. l~ere thereis no pole line in either street or alley, or there is a doubt or question as from which pole the building may be serviced, contractor shall make application to ~ervice Company for proper location. lI~ill;ht Head The service outlet shall not be more than thirty feet, nor less than ten feet, from the Ground. 1'il1ere this clearance cannot be obtained, the matter shall be tak~ up with the City Electrician. The service outlet shall be so located that there will be at least twenty-four inches clearance between it and any signal wires attached to the building, and at least thirty-six inches clearance between the span wires of both systems. The installation of a service head on the service conduit indicates that the service is complete, and signal companies thereafter installing wires shall maintain the required clearance from this point. The wires shall in no case, be within easy reach from any part of the building. Service wire shall not run along, or be attached to, any buildin8 wall unless in conduit. Clearance over Streets and Buildin~8 Clearance of over- head conductors, including service conductors above ground and over buildings shall comply with Rules for Overhead Construction of Public Utilities Commission of State of California. Section 16 - Number of Services The number of sets of service entrance conductors allowed to be installed to anyone building shall be in accordance with Electrical Safety Orders. ~11., I . . . It . Section 19 - Service Hotor Loads Service and feeder con- ductors and equipment serving motors and other rotatine equip- ment shall be installed in accordance with Electrical Safety Orders. Demand factors for service and feeder conductors serving motors and other rotating equipment shall be in accordance with Electrical Safety Orders. Section 20 - Service Condu~t Service entrance conductors shall be installed in approved rigid galvanized or sheradized conduit. electrical Metallic Tubing or other approved raceway. except that other methods of installation complying with Electri- cal Safety Orders may be used for installation of high voltaee service conductors. !:inimum Size Service Conductors and Racews'( !.linimum size of service raceway shall be 1 1/4" and minimum size of service conductors shall be No.6. with the following exceptions. Section 23 - Service entrance Eauinoent - Approval Service . entrance equipment and metering devices shall be of a type approved by serving agency and shall be installed according to their roles and regulations. Spctton 24 - Service EQuiPment Locavion - DwellinRs Service entrance equipment, meters and metering equipment installed on buildings for dwelling occupancy shall be installed on an outside rear wall or on side wall not closer to front than one-half len,~h of building. Service disconnecting means shall be in- stalled at same location as meter. Section 25 - M~ter Location ComnerciJLl Industr~ Service entrance equipment, meters and metering devices installed on buildings of other than dwelling occupancy may be installed either inside or outside of building at a location approved by City Electrician and Serving Agency and in compliance with . servine agency rules and re~ations. Section 26 - Groundinp. Grounding of service equipment, service neutral conductors, interior equipment and conduit sys- tems shall be in accordance with Electrical Safety Orders. Hot more than 12 lieht outlets shall be installed on this circuit. At least one receptacle outlet shall be installed for the connection of laundry appliances. This receptacle shall be of a 3 pole type designed for grounding. Convenience outlets sh~ll not be installed in ironing cabinets. ~ All light outlets in kitchens, bathrooms toilets, laundrys. service porches and outside porches of buildings for dwelling occupancy shall be controlled by wall switches. Li~ht outlets in closets shall be installed over door or in ceiline of closet. Receptacles located less than 6 feet from floor shall be of a type which does' not have current carrying parts exposed when plue is removed. Transformers for bells, chimes, signalling. furnaces, control or other uses shall be installed in a metal cabinet. in a compartment of panel or other approved manner. If in- stalled in attic shall be not more than 6 feet from access hole. Section 4t - Responsibil~y~ This Code shall not be construed to relieve from or lessen the responsibility or liability of any party owning, operating or installing any electrical wiring, electric devices and/or electric material for danages to person or property caused by any defect therein nor shall the City be held as assuming any such liability by reason of the inspection authorized herein, or certificate of inspection issued as herein provided. Savinv. Clause The City Electrician is hereby empowered to make rules and regulations wherever there is a question as to material or methods, or manner in which the material shall be installed. Said interpretations shall be in writinz and shall be final as to that class of installation. Record The electrical inspector shall keep complete records of all perMits issued and inspections made and other official work performed under the provisions of this Code. PaYments The City Electrician shall pay all moneys collected by him into the City Treasury daily. Section 42 - Penalties Every person, firm or corporation violating any of the provisions of tHs Cud" shall be guilty ot a m~emeanor and upon conviction thereof shall be punishable by a fine of not less than Fifty (~50.00) Dollars nor more than Five Hundred (~500.00) Dollars or by imprisonment in the City Jail for a period of not less than ten (10) days nor more than three hundred sixty (360) days or both such fine and imprisonment. Section 43 - Penalties i':very person, firm or corporation violating any of the provisions of this Code shall be deemed guilty of a separate offence for each day or portion thereof during which such violation continued and shall be punishable therefor as herein provided. Section 44 - Penalties It shall be unlawful for any person, firm or corporation, either as owner, architect, contractor, artisan . ~21- ~ . . .' .r ...-........ -~ - ~ .... . . or otherwise, to do or cause, or permit to be done any electrical w1rin~ or installing of electrical apparatus or fixtures in such manner that the sarne shall not conform to all the provisions of this Code. Section 45 - Penalties It shall be unlawtul tor any person, firm or corporation to use or permit or cause to be used, any electrical apparatus or fixtures, when 8'ii1 :lpparatus or fix- tures or the installation ot same does not conform to all the requirements ot this Code.
