OFUIllIc"iCE NO.~y" 1 AN CRDINANCE OF THE CITY OF S1'"N BERN1'RDINO REGULATING THE IHSTflLLl\TIC?1, AND/OR OPER1'"TIOllf OF NOTION PICTURE EG:"UIP- 2 IcfENT AND/OR ELECTRICAL E~UIHlENT USED FOR DISPLAYS OF HOTION PICTURES IN THE CITY OF SAN BERNARDINO, ESTABLISHING THE 3 FEE~ AND PROVIDING PENALTIES FOR VIOLATION THEREOF. 4 THE HAYOR AND COI1HON 00lJNOIL DO ORDAIN AS FOLLOh':': 5 Section I - Motion Picture Projectionist It shall be 6 unlawful for any person to engage in the installation and/or 7 operation of a motion picture equipment and/or electrical 8 equipment used for display of motion pictures in the City of 9 San Bernardino without first obtaining from the City Electri- 10 cian a certificate of registration as hereinafter provided. 11 i Section 2 - Definition of Terms The Term "Professional 12 motion picture equipment of projection" shall mean such machines 13 or devices designed to use Dr operate with motion picture film 14 of standard width of 1 7/8 inch and has on each edge 5.4 per- 15 fora tion' per inch) or any other film of a combus ti ble nature 16 whatsoever. Bureau of Standards or other similar institutions of recog- 24: nized standing. 25; The term "electrical equipment" shall mean all electrical ; 26 utili za tion equipment which genera te s, transmits, transforms 27 or utilizes electrioal current for light, heat or power in con- 28 nection with any professional and/or non-professional motion 29 picture equipment as herein described. 30 The term "booth" shall mean any ro.om or enclosure in which 31 motion picture eq,uipment is being operated. 32 Section 3 - Application aod Fees Every person prior to . " . enga~inc in the operation of a motion picture machine or pro- jector and/or electrical equipment for display of motion pic- tures "ithin the City of San Bernardino shall appear in person at the office of the City Electrician and shall there fay to the City Electrician a registration fee of Ten (~lO.OO) dollars and shall file in writing o~forms furnished by the City Electri- cian, such information as may be desired for permanent records. If said application shows sufficient experience to the satis- faction,ofthe City Electrician and applicant shall answer correctly in writing, all stich questions pertaining to the design and operation of motion picture equipment, and design and operatior of any electrical equipment used in connection wlt,h any motion picture equipment and'" cemonstrate his noility In the act\lal operation of a motion picture machine and necessary aLLxiliary equipment, the application shall be granted. If any applicant should fail to receive a Certificate of Registration after two examinations he shall pay to the City Electrician Five ($5.00) Dollars for each subsequent examination. Section 4 - Assistant or Apprentice It shall be unlawful for any person to act as assistant or apprentice to a motion picture operator or projectionist in the handling, repairing or manipu- lating of a motion picture .projector or equipment used for the purpose of exhibiting motion pictures in the City of San Bernar- dino without having first obtained a permit to do so from the City Electrician. Any person wishing to act as an assistant or an apprentice shall first file his intention to do so with the City Electrician and pay a registration fee of Five (~5.00) Dollars. City Electrician shall have the authority to issue a Certificate of Re6istration when said applicant has proved to the satisfaction of the City Electrician that said applicant is sufficiently coo- versant with the installation, operation, repair, adjustment and maintenance of motion picture equipment which is in common use at the time cf the examination. Said Certificate of Registration shall state that the bearer has sucessfully proved that his or her qualification pertaining to motion picture equipment) and is register-ed at the office of the City Electrician as a journeyman projectionist ) operate a professional or non-professional and is entitled to ~lOtiotl picture projector at large, within the City' of San Ber- nardino. Time and Age Limit No Certificate of Registration shall be issued for a greater period of time than one calendar year, or for tLe unexpired portion theI'eof, at the time of the issuance of the Certificate of Registration, and provided further that no Certificate of Registration shall be issued to any person under the age of eighteen years. Expiration and Renewal Fee Each Certificate of Registration shall expire on the last day of the year in which it was issued and may be renewed by appearing in person at the City Electrician' offico and paying'a renewal fee of Two ($?80) Dollars within ten days after the expiration of said Certificate of Registration. Time Limit Should any holder of a Certificate of, Re[;istra- tion fail to appear within the above specified time for the pur- pose of renewing his or her Certificate of Registration, said registration shall be void and be of no 6ffect. Joction 6 - Reissuance and Revocation of Certificates Should said holder of a Certificate of Recistration fail to renew hiB Certificate within thirty (30) days after expiration of said Certificate, he or she shall be treated as a new applicant . . 1 and shall be required to re-register by paying the regular fee of 2 $10.00 as prescribed in this code. Provided, further, that the 3 City Electrician shall have the pO',ver to issue a Certificate of 4 Registration to a fOl'mer holder of a Certificate of Eegistration 5 without an examination when it is proved beyond any doubt that 6 he has been employed continuously as a motion picture projectionis 7 outside of his jurisdiction. 'The City Electrician shall have 8 the power to suspend any motion picture projectionist in the 9 City of San Bernardino for any of the following causes: 10 (a) Failing to display projectionist certificate "hile 11 on duty. 12 (b) Baking false statements in the application for certi- 13 ficate. 14 (c) Smoking or permitting smoking in booth while on duty. 15 (d) Being intoxicated while on duty or having intoxicating 16 liquors in the booth. 17 (e) Permitting any fire or open light in booth with film 18 exposed while the audience is in the building. 19 (f) illowing door of booth to remain open while operating, 20 except when same is arranged with an automatic closing 21 device, approved by the City Electrician. 22 (g) Negligence "hile on duty. 23 (t) Having film exposed in booth at any time other than 24 the one film in process of transfer from or to machine 25 or rewind or from upper to lower magazine. All other 26 film shall be placed in metal receptacles with self- 27 closing doors. 28 (i) Over-fusing, and/or rendering any safety device inopera- 29 tive. 30 (j) Lending Certificate to an un-registered person to enable 31 the latter to operate. 32 (k) Operating a defective machine or apparatus. , '. . . . . (1) Operatinc or assisting in the operation of any motion picture machine of a type that is not approved. (m) Maintaining a dirty booth or allowing inflammable material to be exposed in booth during the performance of the shovJ. (n) Operating or assistinc in the operation of any motion pictur~ projector, or equipment in connection t;here- with, any lamp utilizinc inflammable gasses or fluids as a source of light. (0) Failing to report pron~tly to the Electrical Depart- ment the occurence of any film fire and the apparent cause therof. (p) Runninc film on the floor or having more than two (2) feet of the film exposed while the audience is in the building. (q) Operatinc with the magazine open or magazine fire traps out of order. (1') Operating with automatic light shutters or fire. guards out of order; (s) Operating with shutters on openings of booth out of order. (t) Reading while picture is being shown. (u) Leaving operating booth while picture is being exhibited (v) General incompetency. Provided further, the City Electrician shall have the power for good and sufficient reasons to make rules and regulations to govern the installation, operation, repairs and maintenance when same are not covered by this COde," and that said City Electrician shall have the power for good and sufficient reason or reasons, to condemn an! or .all motion picture prQject~!'s or equipment when in his opinion said projectors or equipment are unsafe for use in the Uity of. San Bernardino. . . . ~ 1 The City Electrician shall have the power to issue permits 2 to assistants and/or apprentices when, in his opinion said 3 assistant or apprentice will not interfere with operator or 4 projectionist in the discharge of his duty or in any way 5 jeopardize the public safety. 6 Section 7 - Penalties It shall be unlawful to operate any 7 motion picture projector or equivalent unless located in a fire- 8 proof room as required by the building ordinance and provided 9 with automatic fire-shutters over all parts and openings leading 10 to the auditorium, except such as are expressly designed and 11 approved for use without a fire-proof room or booth. 12 Section 8. - Penaltie~ It shall be unlawful for any person 13 firm or corporation, either as owner, manager, agent or other- 14 wise, .to procure, employ, or' peI'mi.t or cause tc be procured, 15 employed or permitted, any person not duly registered, as herein 16 provided, to operate, or assist in the operation of any motion 17 picture projector or equipment of which such owner, firm or 18 corporation has charge or control. 19 Section 9 - Penalties It shall be unlawful for any person 20 to keep locked, during the time in which a motion picture ex- 21 hibition is open to the public, the door or doors or any en- 22 trance to the booth or room within which the motion picture 23 projector or equipment is being operated. 24 Section 10 - Penalties It shall be unlawful for anyone to . 25 operate or cause to be operated a motion picture projector with 26 defective and/or damaged film which is likely to jeopardize 27 public safety. n shall be the duty of the projectionist to 28 I. give the owner or manager a written notice upon finding any 29 film unsafe for use in the City of San Bernardino and a dupli- 30 cate copy of said notice shall be sent to the office of the 31 City Electrician. In the event of a fire or disaster and the 32 projectionist has failed to give said notice as herein described, . . . 1 he alone shall be held responsible, but if the projectionist, 2 after giving due notice to his superior, is ordered to run the 3 4, film regardless of its condition, he shall be exonerated of all responsibility in the event of a fire or disaster. Section 11 - Stage Electrician All the electrical appar- atus in a theatre or moving picture house shall be in charge of a competent electrician and operator. The said electrician 5 6 7 8 shall be at all times in attendance to operate the apparatus 9 whenever the theatre is open. Theatres using the stage for 10 other purposes than motion picture shall have a competent stage 11 electrician in addition to the operator, said electrician to be 12 in attendance at all times when the theatre is open for business. 13 Section 12 - License Fee Before granting such license, 14 each person desiring same shall appear before the City Electri- 15 cian and shall satisfy said City Electrician that he is com- 16 petent to be in charge of said apparatus. . The license fee 17 for stage electrician shall be the same as prescribed in this 18 code for projectionist. 19 . SECTION 13: Any person, firm or corporation violating any 20. of the provisions of this Ordinance shall be deemed guilty 21 of a misdemeanor, and upon conviction thereof shall be pun- 22 ished by fine not exceeding $500.00 or by imprisonment for a 23 term not exceeding six months, or by both such fine and im- 24 prisonment. 25 SECTION 14: That all ordinances in conflict here with . 26 be, and the same are hereby repealed. 27 I Hereby Certify that the foregoing ordinance was duly 28 adopted by the Mayor and Common Council of the City of San 29 Bernardino, at a regular meeting thereof held on the :2/-.J day 30 31 32 e_ 1 2 3 4 5 6 7 8 9 10 11 12 13 . 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ~ ~ . .. . - ... .' 1- . of ~A~ , 1955, by the following vote, to-wit: ,~~ r / .
