WHEREAS, heretofore a petition was filed with the Common COWlcil of the Cityof' San Bernardino requesting that certain Wlinhabited territo17 contiguous to said City be annexed to the City of San Bernardino and which said petition described said territory and the boundaries thereof proposed to be annexed to the City,; and WHEREAS, said petition was filed by the owners. of not less than one- fourth of the area of land in such territory and representing not less than one-fourth of the assessed value of such terrltc17 according to the last preceding equalized assessment roll of the CoWlty of San Bernardino, in which said COWlty the City of San Bernardino is situated,; and WHmEAS, the said petition requested the said territo17 to be annexed , i to and included in the said municipal corporation, in accordance with the pro- 15 : i visions of the Government Code, Section 35300, et seq.,; and 16 17 ; 18 19 20 WHEREAS, all and each of the owners of all of the aforesaid real pro- perty and of each and fNe17 parcel contained therein have consented in writing and filed with the City Clerk of the City of San Bernardino, who acts as Clerk for said Common Council, their consent and agreement that all of the property I inCluded in the aforesaid territory shall be taxed equally with the other pro- 21 ' i perty within the said City to pay the bonded indebtedness and any and all 22 I 23 I 24 25 26. I 27 I 28 29 30 :n 32 general indebtedness and liability of the City of San Bernardino contracted prio to or following or outstanding at the time the aforel\fJ.id petition of the annexa- tion was filed and subsequent thereto, as provided in said Government Code,; and WHEREAS, on the 17th dq of January, 1955, a Resolution was adopted by the aforesaid Common CoWlcil of the City of San Bernardino, California, pro- posing the annexation of the aforesaid Wlinhabited territory to be generally known as the ANNElATIOO DISTRICT NO. 76 to the City of San Bernardino, and that said Resolution provided therein that the proposed annexation should be genera known and identified as the ANNElATION DISTRICT NO. 76; and WHmEA3, said Resolution set forth therein that all the property in- cluded in the aforesaid territory should be taxed equally with the other pro- -1- 1 2 3' , 4 5 I ; 6 I , 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ~ ,. . . per..t;lt within the said City to pay the ronded indebtedness and any and all general indebtedness and liability of the Cit;y of San Bernardino, contracted prior to or existing or outstanding at the time of the aforesaid proposed annexation of the aforesaid property, as provided in the hereineefore men- tioned Government Code; and WHEREAS, the said Resolution did fix, determine and declare that a hearing be held on the 7th dSiY of March, 1955, at the hour of 7:30 o'clock P. M., in the Council Chambers of the City Hall, in the City of San Bernardino, and the same was the day, hour and place designated where any person owning rea" estate within such territory so proposed to be annexed and having any objection to the proposed annexation might object before the Collllllon Council and show cause why such territory should not be annexed, and furthermore, the said Resolution provided that at any time not later than the said hour set, as mentioned hereinbefore for the said hearing, any owner of property wit.hin the said territory proposed to be annexed might file written protest with the City of San Bernardino against such annexation; and WHl!REAS, no objection or protests of any kind or nature whatsoever were mede or filed, either written or oral, with the said City of San Bernar- dino, and no protests or objections of any nature whatsoever were made, either written or oral, at the meeting of the Common Council on the 7th dSiY of March, 1955, as mentioned hereinbefore, at which said meeting the said Common Council publicly announced that any person, firm or corporation desiring to protest or object to said annexation might do so at said meeting; and WHEREAS, it appears to the Comon Council of the City of San Bernardino that the aforesaid annexation proceedings have been completed and everything performed at this time, in accordance with said Government Code, and mentioned hereinbefore, and any and a:l,l other laws in any way connected with the said anne~tion procedure, having been complied with; and WHEaEAS, t.he COIIll!on Council of 'the City' of San Bernardino desire to approve at this time the annexation of the aforesaid territory, NOW, 'llIEIl.EFORE, THE C<l4Mll'I COONCn. SECTION TWO: The territory herein referz:ed to as being annexed to the City of San Bernardino is particularly described as follows, to wit: - All that portion or Lots 1, 2, 3, 4, 5. 22, 23, 24, 25, and 27 of the Pope, Talbot and Pierce .A<l.ditioil,_ ap per pJ.at recorded in Book 11 of Haps at page 38, records of the County Recorder of San Bernardino County, described as follows: BmINNING at a point in the present corporate limits of the City of San Bernardino, said point being the Southwest comer of Lot 8, H. H. Linville Subdividon, as per plat recorded in Book 8 of Maps, at page 47, records of the County Recorder of San Bernardino County; thence Southwesterly to the South comer of Lot 1 of said Pope, Talbot and Pierce Addition; thence North- westerly along the Southwesterly line of said Pope, Talbot and Pierce Addition to a point 19/IJ feet Southeasterly trom the Northwest corner of Lot 32 of said Pope, Talbot and Pierce Addi- tion; thence Northeasterly at right angles, 240.02 feet; thence Southeasterly and parallel to the Southwesterly line ot said Pope, Talbot and Pierce Addition, to the South line ot Lot 112, Tract No. 2353, as per plat recorded in Book 33 of Haps, at pages 66 and 67, records ot the County Recorder of San Bernardino County; thence Easterly along the South line of Lots 112 to 106, inclusive of said Tract No. 2353 to the West line ot State Street, 60 teet wide, as dedicated by said Tract No. 2353; thence South- erJ.y along the West line of State Street to the North line of Lot 24 ot said Pope, Talbot and Pierce Addition; thence Easterly along the North line ot Lots 24, 5 and 4 of said Pope, Talbot and Pierce Addition, to the West line of Calitornia Street, 30 teet wide, as delineated on said Pope, Talbot and Pierce Addi- tion; thence Southerly along the West line of said California Street to the Westerly prolongation of the North line of the South one-halt of Lot 6, Block 58, Rancho San Bernardino, as per plat recorded in Book 7 of Kaps at page 2, records of the County Recorder of San Bernardino County; thence EasterJ.y along the Westerly prolongation of the North line of the South one-halt of sa:ld Lot 6, to a point in the present corporate limits ot the Citu ot San Bernardino, said point being the Northwest corner of the South one-half of said Lot 6; thence Southerly along the West line of said Lot 6 and along the West line of Lots 5, 6, 7 and 8 of said H. H. ~ville Subdivision, being along the present corporate lillli.ts of the City of San Ber- nardino, to the point of beginning. \ SECTION THREE: That the above described property will be SUbject to taxation, equally with the property within such municipal corporation, to pa;y its proportion of the following bonded indebtedness of the City of San Bernardino, which sa:ld bonded indebtedness was outstanding at the time of fUing said petition or theretofore authorized and is outstanding at the t:lJne of said annexation, to wit: -3- 1 2 3 4 5 ! A bonded indebtedness ot $200,000.00 incurred tor the construction and completion ot a convention hall, the outstanding indebtedness thereon be- ing $.35,000.00, bearing interest at the rate ot 5% per annum; A b>nded indebtedness ot $275,000.00, incurred tor the acquisition and construction ot water works, including nDevil ~on Water Works,. water rights, rights ot way, pipe lines, wells and pumping plants, the outstanding indebtedness thereon being $68,750.00, bearing int.erest at the rate ot 5% per annum; A borded indebtedness ot $650,000.00, incurred tor the acquisition ot real property, and construction ot a sewage disposal plant, inverted siphon sewer lines and intercepting sewers, the outstanding indebtedness thereon be- ing $86,666.64, bearing interest at the rate or 41% per annum. SECTION FOUR: The property herein annexed is decJa.red to be a part ot Ward 5, and the bo1D'lCiaries or Ward 5 are hereby altered to include said annexed territory; and said property is placed and deClared to be in Zone B.ool under t~Zon1ng Ordinance and Regulations ot $aid City. SECTION P'IvE: 1< ~ The Cit;v' Clerlt shall oertity .to the passage ot this ordinance and shall cause the same to be published three consecutive times in the San Bernardino Evening Telegram, a dailJ' newspaper designated tor that purpose.
