ORDINANCE NO.~
AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO APPROVING THE ANNEXATION DISTRICT NO. 81.
WHEREAS. heretofore a petition was filed with the Common
5 Council of the City of San Bernardino requesting that certain un-
6 inhabited territory contiguous to said City be annexed to the City
7 of San Bernardino and which said petition described said territory
8 and the boundaries thereof proposed to be annexed to the City; and
9 WHEREAS. said petition was filed by the owners of not less
10 than one-fourth of the area of land in such territory and repre-
11 senting not less than one-fourth of the assessed value of such
12 territory according to the last preceding equalized assessment
13 roll of the County of San Bernardino. in which said County the
14 City of San Bernardino is situated; and
15 WHEREAS. the said petition requested the said territory to
16 be annexed to and included in the said municipal corporation. in
17 accordance with the provisions of the Government Code. Section
18 35300. et seq.; and
19 WHEREAS. all and each of the owners of all of the aforesaid
20 real property and of each and every parcel contained therein have
21 consented in writing and filed with the City Clerk of the City of
22 San Bernardino. who acts as Clerk for said Common Council. their
23 consent and agreement that all of the property included in the
24 aforesaid territory shall be taxed equally with the other property
25 within the said City to pay the bonded indebtedness and any and all
26 general indebtedness and liability of the City of San Sernardino
27 contracted prior to or following or outstanding at the time the
28 aforesaid petition of the annexation was filed and subseque~t
29
thereto. as provided in said Government Code; and

30 WHEREAS. on the 20th day of June. 1955. a Resolution was
31 adopted by the aforesaid Common Council ~f the City of San Ber-
32 nardino. California. proposing the annexation of the aforesaid

1 uninhabited territory to be generally known and identified as the
2 ANNEXATION DISTRICT NO. 81; and
3 WHEREAS, said Resolution set forth therein that all the
4 property included in the aforesaid territory should be taxed equal.'
5 ly with the other property within the sa! d City to pay the bonded
6 indebtedness and any and all general indebtedness and liability
7 of the City of San Bernardino, contracted prior to or existing
8 or outstanding at the time of the aforesaid proposed annexation
9 of the aforesaid property, as provided in the herein before men-
10 tioned Government Code; and

27 desiring to protest or object to said annexation might do so,

three property owners, owning les8 than one -half of the last

29 assessed valuation of the territory proposed to be annexed, per-
30 sonally objected and filed protests in writing to tile. proposed
31 annexation;; and
32 WHEREAS. the said written protests and oral objections of

1 the said three property owners were overruled by the Common Council
2, at said meeting as not being made by owners of one-half of the las1
3' assessed value of the territory proposed to be annexed as required
4 by Section 36313 of the Government Code, and
5 WHEREAS, it appears to the Common Council of the City of
6, San Bernardino that the aforesaid annexation proceedings have been
7 completed and everything performed at this time, in accordanc. wi~t
e! said Government Code, and mentioned hereinbefore, and any and all.
9' other laws in any way connected with the said annexation procedure,
10 . ,.having been complied with; and
11 WHEREAS, the Common Council of the City of San Bernardino
12 desire to approve at this time the annexation of the aforesaid
13 territory,
14 NOW, THEREFORE,. THE COMMON COUNCIL OF THE CITY OF SAN BER-
15! NARDINO DOES HEREBY ORDAIN AS FOLLOWS:

SECTION ONE: That said territory as herein described as
17 Annexation District No. 81 is hereby annexed and incorporated in
18: and made a part of the City of San Bernardino.

All those port ions of Lot s 20, 21. 22',. 23, 27" 28,
29,. 44, and 46, Block 64, Rancho San Bernardino, as
per plat recorded in Book 7 of Maps at page 2, records
of the County Recorder of San Bernardino Count,., and
all those portions of Lots 1 through 9 inclusive of
Block 4" and portions olLot 23, Blook 1, and Lot 30,
Block 2" of Tract No. 1963 Scenic Knoll, as per plat
recorded in Book 28 of Maps at page 62, records of the
County Recorder of San Bernardino County" desoribed as
follows 1
Beginning at a point in the present corporate limits
of the City of San Bernardino, said point being South
600 East, 760.32 feet, from the most Easterly corner
of Lot 48 of the Fairview Survey, as per plat recorded
in Book 1 of Maps at page 43, records of the countg
Recorder of San Bernardino County; thence North 60
West, 760.32 feet, being along the present oorporate
limits of thB City of San Bernardino, to the most
Easterly corner of said Lot 48; thence Southwesterly
along the Southeasterly line of the said Fairvi..

corner of Lot 28 of said Fairview Survey; thence South-
westerly along the Southeasterly line of said Fairview
Survey; thence Southeasterly along the present corpor-
ate limits of the City of Colton, to the most Easterly
corner of Lot 20 of said Fairview Survey; thence South-
easterly along the present corporate limits of the City
of Colton to a point described as being 165.67 feet
Northwesterly from the most Easterly corner of Tract
No. 1947, Larkman Park, as per plat recorded in Book

along the present corporate limits of the City of Col-
ton, 165.67 feet to the most Easterly corner of said

The basis of bearing is the Southwesterly and South-
easterly portions €If Annexatian District No. 8 of the
City of San Bernardina and the Easterly line of Scenic

SECTION THREE: That the above described property will be

9 subject to taxatian equally with the praperty within such munici-
10 pal corporatian, to pay its proportion of the follawing banded
11 indebtedness of the City €If San Bernardino, Which said bonded
12 indebtedness was autstanding at the time of filing said petition
13 ar theretofore authorized and is outstanding at the time of said
14 annexation" to wit:
15 A bonded indebtedness of $200,000.00 inourred for the con-
16 struction and completion €If a canventian hall, the outstanding
17 indebtedness thereon being $35,,000:00, bearing interest at the
18 rate €If 5% per annum;
19 A bonded indebtedness €If $275,000.00, incurred fer the
20 acquisitien and construction of water works, including "Devil
21 Canyen Water Werks," water rights, rights of way, pipe lines,
22 wells and pumping plants" the eutstanding indebtedness thereen
23 being $68,750.00, bearing interest at the rate €If 5% per annum;
24 A bonded indebtedness of $650,000.00, incurred fer the
25 acquisition €If real preperty, and construction €If a sewage dispesal
26 plant, inverted siphon sewer lines and intercepting sewers, the

eutstanding indebtedness thereen being $86,666.64, bearing interest
28 at the rate €If 4*% per annum.

SECTION FOUR: The property herein annexed is declared to
30 be a part €If Ward 3, and the beundaries €If Ward :5 are hereby al-
31 tered to include said annexed territery; and said preperty is
32 placed and declared te be in Zene M-l under the Zening Ordinance

SECTION FIVE: The City Clerk shall certiry to the passage
or this ordinance and shall cause the same to be published three
consecutive times in the San Bernardino Evening Telegram,. a daily
newspaper designated ror that purpose.
I HEREBY CERTIFY that the roregoing ordinance was duly
adopted by the Mayor and Common councilor the City or San Ber-
nardino at :;f'f;;.l~~ meeting there or, held on the 5d day
or August, 1955, by the r~llowing vote, to wit: ~
