THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOILOWS: SECl'ION ONE: That Sections 24, 54, 106..c, 107..c, 111, and 113 of Ordinance No. 763 entitled "An Ordinance providing for the licensing of busines , I , shows, exhibition and games conducted or carried on in the City ,of San Bernar~ : I dino, fixing the rate of license therefore and providing for collection thereof!, passed March 1, 1920 and approved March 2, 1920, be and the same are hereby amended to read as follows: SECrION TWO: That Section 24 of Ordinance No. 763 is hereby amended to read as follows: Section 24: Every person, firm or corporation, operating, main~ taining, leasing, letting, managing or carrying on the business of selling or vending goods, wares or merchandise by means of vending machines, shall pay as a license fee the sum of $50.00 per calendar year, or any part thereof; pro~ vided, however, that in the event any person, firm or corporation so engaged in said business shall operate, maintain, lease or let more than fifty such , , . SECTION FOUR: That a new Section is hereby added to said Ordinance No. 163 to be designated Section l06..c reading as follows: Section 106..c: For every person, firm or corporation conducting managing or carrying on the business of maintaining, repairing, manufacturing" erecting or constructing electrical signs including 3eon, neon, florescent, etc., or submitting any bid therewith, $48.00 per annum; the provisions of Section 101"E of Ordinance No. 163 are hereby specifically made applicable to the payment of said license. SECTION FIVE: Section 101..c of Ordinance No. 163 is hereby amended to read as follows: -2" . . 1 2 3 4 5 Section 107-C: For every person, firm ot corporation conducting, managing or carrying on the business of cement, concrete, paint; "plaster, brick ..-, "< '" "." mason, excavatiag, gndillg" trellching, paving", surfacing, "landscaping, floor i . " '_0, " " polishing, interior decorating or wall paper contractor, building contractor and all other sub-contractors, and every person, firm or corporation submitting 6 any bid in connection therewith, the sum of $48,00 per annum. The provisions 7 of Section 107-i of Ordinance No. 763 ate hereby specifically made applicable 8 to the payment of said license. "9 SECTION SIX: That Section III of Ordinance No. 763 is hereby amended 10 to read as follows: 11 Section Ill: For every person acting as a solicitor, as defined 12 in this Section $30.00 per quarter, or any part of said quarterly period, paya- 13 ble quarterly in advance. 14 A solicitor, within the meaning of this Section, is defined to 15 be .any person who goes from house to house, or from place to place, in the City 16 of San Bernardino, selling or taking orders for, or offering to sell or take 17 orders for, goods, wares or merchandise or any article for future delivery, or 18 for service to be performed in the future, or for the making, manufacturing or 19 repairing of any article or thing whatsoever for future delivery. Application 20 for the license provided for in this Section shall be accompanied by a bond in 21 the penal sum of $500.00, executed by a surety company, or in lieu thereof, a 22 cash bond of equal value, conditioned upon the making of final delivery of the 23 goods, wares or service to be performed in accordance with the terms of such or 24 der. Any person aggrieved by the action of any such solicitor shall have a 25 right of action on the bond for the recovery of money or damages or both. Such 26 27 28 29 30 31 bond shall remain in full force and effect, and in case of a cash deposit, such 'I deposit shall be retained by the City of San Bernardino for a period of 90 days after the expiration of any such license. All orders taken by licensed solici- tors shall be in writing in duplicate, stating the terms thereof, and the amoun paid in advance, and one copy shall be given to the purchaser. All solicitors shall be fingerprinted and photographed by the 32 Police Department. Solicitation shall cease at sundown. I -3- .; I- .' .. . . . 1 SECl'ION SEVEN: Section 113 of Ordinance No. 763 is hereby !lmended 2 to read as follows: 3 Section 113: Every person. firm or corporation conducting, . 4 m!lnaging or carrying on any business of any kind in said City and employing 5 vehicles, automobiles or motor vehicles in the conducting of such business 6 shall pay a license fee of $24.00 per annum for each such vehicle, automobile 7 or motor vehicle used in such business within the corporate limits of said City 8 provided, however, that this Section shall not apply to any person, firm or 9 corporation holding a license for any such business under any other provision 10 of this Ordinance. Any person doing business for less than a full year, and 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 :30 31 32 for which business an annual license is provided in this Section; shall be required to pay the amount of the license fee for a full year, except that the fee for any such license issued on or after July 1 of any year for the remainder of such calendar year to a person never previously licensed or subject to be licensed by the City for the conducting of such business shall be 50 per cent of the annual license fee prescribed for such business where such fee is a fixed amount and is not based on gross receipts. An addition!ll fee of $.50 - shall be charged for a license plate to be attached to the rear of vehicle. SECl'ION EIGHr: This Ordinance is urgently requirecj for the innediate preserv!ltion of the public peace, he!llth !lnd safety and is an emergency measure, and the M!lyor !lnd Connon Council of the City of S!ln Bern!lrdino hereby find th!lt , in order to provide sufficient revenue for the maintenance of the Police Depart", . i ment, the Health Department and other Departments of the City of San Bernardino, this Ordinance must take effect immediately. SEcrION NINE: This Ordinance shall take effect and be in force from and after its passage and approval.
