O'clock of said day, the purpose of which hearing shall be to determine whether or no~ the Mayor and Common Council of the City of San Bernardino by ordinance shall adopt that certain Uniform Building Code, Volume I, 1955 Edition, together with all the provisions in the Appendix therein, and Volume III, Uniform Building Code Standards, 1955 Edition, as promulgated by the Paci- 8 9 10 11 12 13 14 15 16 17 18 19 fie Coast Building Officials Conference, as amended by the pro- posed ordinance adopting said code, which said ordinance upon adoption shall be known as the Uniform Building Code for the City of San Bernardino. The purpose of the code is to establish minimum standard. for all types of buildings and structures proposed to be built or erected in said City, as a safeguard to life, health, property 20 and public welf~re. " 1 ORDINANCE NO.dO' 5"1 / 2 AN ORDINANCE ADOPTING AND ESTABLISHING RULES AND REGULA- TIONS FOR THE CONSTRUCTION OF BUILDINGS WITHIN THE CITY OF SAN :3 BERNARDINO AND ADOPTING THE UNIFORM BUILDING CODE, VOLUME I, 195~ EDITION, AND UNIFORM BUILDING CODE STANDARDS, VOLUME III, 1955 4 EDITION, FOR THE PURPOSE OF ESTABLISHING A BUILDING CODE FOR THE CITY OF SAN BERNARDINO AND PROVIDING, CREATING AND ESTABLISHING 5 FIRE ZONES THEREIN. 6 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNAR- 7 DINO DO ORDAIN AS FOLLOWS: 8 SECTION ONE: That the Building Code herein referred to 9 is contained in book form, designated as Volume I, 1955 Editimny 10 together with all the provisions in the appendix~ and Volume III, 11 entitled "Uniform Building Code Standards, 1955 Edi tion" both pre- 12 pared by the Pacific Coast Building Officials COnfez>ence, three 13 copies of each designated volume now on file in the office of the 14 City Cle rk of said City and identified by the certificate attached 15 thereto of the City Clerk of said City reading as follows: 16 "I, JACK T. " 21 SECTION TWO: That the provisions of said Building Code, 22 except as herein otherwise provided, be and they are adopted herein 23 by reference, and that said Sections aforesaid, except as herein 24 provided, shall constitute the Building Code of the City of San 25 Bernardino covering the subjects and matters therein referred to; 26 and provided, further, that said Code shall be amended by adding or 27 modifying the following sections, to wit: 28 303 (a) Table No. 3A: By striking the entire second and 29 .third line from Table No. 3A and substituting in lieu thereof the 30 words "$20.00 to and including $400.00, Fee $2.00;" 31 The following subsections are added to Section 303 of said 32 Code: 303 (c): The City, County, State or the United States of -1- ~ 10 11 12 13 M 15 16 17 18 . . 1 I America, or any school district shall be exempt from the paying of 2 any fee for any building; 3 303 (d): The Building Inspector shall determine the estimated 4 valuation in all cases, and for such purpose he shall be guided by 5 approved estimating practices; 6 303 (e): Any person taking out a permit for the gen~ral con- 7 struction of any building or project shall do so at least one day 8 prior to the start of actual construction: 9 303 (f): A sub-contractor shall obtain a permit or notify the Inspector prior to the start of his work; 303 (g) Where work for which a permit is required by this Code is completed prior to obtaining said permit, an additional fee of ten (10) percent of the cost of the project shall be paid, not to exceed the sum of $200.00 and it shall be the duty of the Chief Building Inspector to levy and collect said additional fees. The payment of such fee shall not relieve any persons from fully com- plying with the requirements of this Code in the execution of the work nor from any other penalties prescribed ~erein. 19 303 (h): The Chief Building Inspector shall keep a permanent, 20 21 22 23 accurate account of all fees and other moneys collected and receive< under this Code, the names of the persons upon whose account the same were paid, the date and amount thereof, together with the location of the building or premises to which they relate; 1005: Deleting therefrom the fourth paragraph of said section and substituting in lieu thereof the following: Every building, office or portion thereof where persons are employed shall be pro- vided with at least one toilet, and roughing in for second toilet shall be installed for future use or expansion. Every 13 building and each subdivision thereof where both sexes are employed 14 shall be provided wi th at least two toilets located intstlch build- 15 ing or office, each in a separate enclosure: 16 1309: Deleting therefrom this entire section. 17 1405: By striking from the third line of Sub-section (b) there 18 of the words "seven feet six inches (7' 6")" and insert the words 19 "eight feet (8')". 20 Strike the following, "in at least 50 per cent of its required 21 area with no portion less than five feet (5')". 22 Also add to the last sentence after the words "fifty square 23 feet (50 sq. f)" the following: "of superficial floor area"; 24 1409: Deleting therefrom the third paragraph of said section 25 and substituting in lieu thereof the following: Under no circum- 26 stances shall a carport have any opening directly into a room used 27 for sleeping purposes. Windows between a carport and other rOQRS 28 of the dwelling shall not be openable and shall be one (1) hour 29 fire resistive. Doors shall be one (1) hour fire resistive, and 30 provided that any sash used in a door be fixed and be one (1) hour 31 fire resistive; doors between a dwelling and a carport shall be 32 self-closing. -3- .oil 1705: By adding new Sub-section (f) reading as follows: All insulating materials, used in walls or attics, shall be of an approved type, manufacturer recommended and installed according to manufacturer's specifications. 2507 (4) Spacing: Deleting therefrom the following: Except for one-story detached buildings of Group J occupancy, where twenty four inch (24") spacing may be used. 3203: By striking from the third line of Sub-section (e), Section 1, the word "15 points" and insert "19 points in Fire Zone No.1, 15 points for Fire Zone No.2." Also add to the last sent- ence of said Section 1 the following: "Inspection shall be called for when work is approximately 50 per cent complete"; 4503: By adding to first paragraph after the words "the space adjoining a building below" the following: "or above". 4505: By adding to Sub-section (b), first paragraph thereof, after the words "two feet (2')" the following: "that no marquee shall project more than eight feet (8') from the property line". Also by striking out all of Sub-section (c) and (d), and insert in lieu thereof the following: "Thickness: The maximum height or thickness of a marquee measured vertically from its lowest to its highest point shall not exceed three feet (3')." 4506: By deleting therefrom Section 4506 of said Uniform Building Code and substituting in lieu thereof the following:' Movable awnings or hoods must be constructed of canvas, cloth or fabric supported on an incombustible frame attached to the build- ing'in such a manner that it can be lowered or folded against the building. Metal awnings are prohibited on all commercial buildings 28 I unless they are constructed so as to comply with the live load and 29 other requirements of the Code applicable to marquees; 30 That all awnings hereafter constructed shall comply with the 31 follOwing specifications: 32 (a) Awnings not more than twenty feet long shall have at least 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 --- - ~ . . ~ 1 2 3 4 5 6 7 , -4- " . . That each lateral arm shall be securely fastened to the building with at least three lag screws or bolts not less than 3/8" in diameter nor less than 4-," in length. (b) Rope hoist awnings not more than twenty feet in length 8 shall ha~e at least three rope hoists and one additional rope hoist 9' for each additional ten feet or fraction ther40f in length. 10 I (c) Slide rod awnings shall not be erected where the wall i 11; height is less than one-third of the projection. The front rod of i 12' all rope hoist awning frames which span over ten feet in width 13 shall be constructed of galvanized iron pipe not less than 3/4" in 14 diameter. 15 (d) The frames of all rope hoist awnings, together with the 16 arms and lateral arms, shall be constructed of metal. 17 (e) No awnings shall be more than ten feet in projection. The 18 frames and supports for all awnings shall be securely attached to 19 the walls of the building. 20 (f) The lowest point of the frame of awning shall not be less 21 than S' above the surface of the sidewalk of the street, and the 22 lowest part of the curtain scallop or valance, or any other part 23 of the awning extending more than 6" from the building upon which 24 it is constructed shall be at least 7' 0" above the level of the 25 sidewalk at all times. 26 27 28 29 30 31 32 (g) Any person, firm or corporation desiring to construct or install an awning or awnings within the City of San Bernardino shall file with the Chief Building Inspector of said City a bond in the penal sum of $1,000.00 for the benefit of the City of San Bernardino and the person, firm or corporation for wholl. the awning shall be constructed; conditioned that any awning constructed or installed by the principal named in said bond shall conform to the -5- . . . .' 1 specifications provided for in this Ordinance. 2,1 3 'sections and modifications as SECTION THREE: That the sections aforesaid with the omitted herein provided, shall be known and 4 may be cited as the "Building Code of the City of San Bernardino". 5 I SECTION FOUR: That the word "city" in the sections aforesaid 6 shall be deemed to refer to and designate the City of San Bernardino 7 and that any reference to any act or legislative enactment therein 8 referred to shall be deemed to designate and embrace the Statute of 9 the State of California and any amendments thereof, dealing with the 10 subject matter thereby and therein referred to. 11 SECTION FIVE: That the fire zones referred to in the sections 12 aforesaid shall be deemed to refer to the fire zones of the same 13 number hereby created and established. 14 SECTION SIX: That Fire Zone No. 1 of the City of San Bernardino 15 shall embrace all of that territory, the exterior boundaries of, I 16 which are described as follows, to-wit: 17 Beginning at a point in the South line of Church Street, said 18 point being 300 feet East of the East line of "E"'Street; thence 19 East along the South line of Church Street and the Easterly pro- 20 longation of the Sout~ line of Church Street to the center line of 21 Arrowhead Avenue; thence South along the center line of Arrowhead 22 Avenue to the center line of Fifth Street; thence East along the 23 center line of Fifth Street to the West line of Mountain View 24 Avenue; thence South along the West line of Mountain View Avenue to 25 the North line of Second Street; thence West along the North line of 26 Second Street to the West line of "D" Street; thence South along the 27 West line of "D" Street to the North line of the A.
