AN ORDINANCE OF TIIE MAYOR AND COMMON COUNCIL OF 'mE CITY
3 OF SAN BERNARDINO, APPROVING TI:IE ANNEXATION OF DISTRICT NO. 84.
4 WHEREAS. heretofore proceedings were initiated by the
5 Common Council of the City of San Bernardino, on its own motion,
6 to annex to the City of San Bernardino certain contiguous unin-
'I habited territory hereinafter described; and
8 WHEREAS. on the 5th day of December, 1955, a resolution
9 was adopted by the aforesaid Common Council of the City of San
10 Bern,ardino, California, declaring that proceedings had been in-
11 itiated by said Council and proposing the annexation for the
12 reasons therein stated of the aforementioned uninhabited territory
13 to be generally known as the Annexation District No. 84 to the
14 City of San Bernardino, and that said resolution provided that
15 the proposed annexation should be generally known and identified
16 as the Annexation District No. 84; and
1'1 WHEREAS, said Resolution set forth therein that all the
18 property included in the aforesaid territory should be taxed equal- i

ly with the other property within the said City to pay the bonded

20 j indebtedness and any and all general indebtedness and liability

of the City of San Bernardino, contracted prior to or existing
22 or outstanding at the time of the aforesaid proposed annexation
23 of the aforesaid property, as provided in the hereinbefore men-
24 tioned Government Code~ and

WHEREAS, the said Resolution did fix, determine and declare i
that a hearing be held on the /t"[..h day oVhJ~ ,1956, at, the I
hour of 7:30 o'clock P.M., in the counci~Chambers of the City Hall
in the City of San Bernardino, and the same was the day, hour ,and

place designated where any person owning real estate withinsti1:h(

31 the proposed annexation might object before the Common Counci,:}. and
32 show cause why such territory should not, be annexed, and further-

more, the said Resolution provided that at any time not later than
the said hour set, as mentioned hereinbefore for the said hearing,
any owner of property within the said territory proposed to be
annexed might file written protest with the City of San Bernardino
against such annexation; and
WHEREAS, no Objection or protests of any kind or nature
whatsoever were made, or filed, either written or oral, with the
said City of San Bernardino, and no protests or objections of any
nature whatsoever were made, either written or oral, at the meet-
ing of the Common Council on theLt~day o}y~, 195&, as
mentioned hereinbefore, at which said mee~ng the said Common Coun-
cil publicly announced that any person, firm or corporation desirin
to protest or object to said annexation might do so at said meet-
ing; and
WHEREAS, it appears to the Common Council of the City of
San Bernardino that the aforesaid annexation proceedings have been
completed and everything performed at this time, in accordance
with said Government Code, and mentioned hereinbefore, and any

and all other laws in/way connected with the said annexation
procedure, having been complied with; and
WHEREAS, the Common Council of the City of San Bernardino
desire to approve at this time the annexation of the aforesaid
terr i tory
NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN

SECT tON ONE: That said territory as herein described as

SECTION TWO: The territory herein referred to as being
30 annexed to the City of San Bernardino is particularly described

South. Range Four west, San Bernardino Meridian, and
a portion of Block 92. Rancho San Bernardino, as per
plat recorded in Book 7 of Maps at page 2, records of
the County Recorder of San Bernardino County, described
as follows:
Beginning at a point in the present corporate limits of
the City of San Bernardino said point being in the North
line of Tract No. 2154, as per plat thereof recorded
in Book 31 of Maps, at page 31, records of the County
Recorder of San Bernardino County, said point being
843 feet west of the West line of Pennsylvania Avenue,
40 feet wide, as delineated on map of said Tract No.
2154; thence North 5037'38" West 143.5 feet; thence
North 14021'38" West 735 feet; thence North 11057'38"
West to the Easterly prolongation of the South line of
the North one-quarter of the South one-half of said
Section 7; thence Westerly along the Easterly prolong-
ation of the South line of the North one-quarter of the
South one-half of said Section 7, and the 'South line
of the North one-quarter of the South one-half of said
Section 7, to a point 150 feet East of the East line of
the West one-half of said Section 7; thence Southerly
and parallel to the East line of the West one-half of
said Section 7, and the East line of the West one-half
of said Section 18, to the South line of Mill Street,
60 feet wide, as conveyed to the City of San Bernardino
by Deed recorded February 23, 1954, in Book 3332 of
Official Records at page 528, Records of the County
Recorder of San Bernardino County, the above described
course being along the present corporate limits of the
City of 'San Bernardino; thence Easterly along the South
line of said Mill Street to a point 915 feet West of
the, center line of Rancho Avenue, 66 feet wide, as
declared a public highway by the San Bernardino County
Board of Supervisors on August 4, 1891; thence South
erly and parallel to the center line of said Rancho
Avenue to a point 167.5 feet, more or less, Southerty
from the North line ,of said Section 18. said point be~ng
the SouthWest corner of Parcel No. 1 of land conveyed
to Edmond C. Besner and Wilma C. Besner, August 3, 1953,
by Deed recorded in Book 3216 of Official Records at
page 575, Records of the County Recorder of San Bernar-
dinQ ~ounty; thence Easterly along the South line of
said land conveyed to Edmond C. Besner and Wilma C.
Besner, 915 feet, to the center line of said Rancho
Avenue, the center line of Rancho Avenue and the fol-
lowing described course being on and along the present
corporate limits of the City of Colton; thence Norther-
ly along the center line of said Rancho Avenue to a
point 1449.06 feet Northerly from the center line of
Mill Street, 82.5 feet wide, as delineated on said
map of the Rancho San Bernardino; thence Easterly and
parallel to the center. line of said Mill Street, 33.08
feet to the Easterly line of said Rancho Avenue; thence
South 81040' East, 77.17 feet; thence South 31046',
East, 62.93 feet; thence South 10057' East 160.83
feet; thence South 10018' East, 172.80 feet; thence
South 9015' East, 116.36 feet; thence South 8044'30"
East, 131.48 feet; thence Easterly to the Northwest
corner of said Tract No. 2154; thence East along the
North line of said Tract No. 2154, 64.36 feet to the
point of beginning.

SECTION THREE: That the above described property will be
subject to taxation equally with the property within such munici-
pal corporation, to pay its proportion of the following bonded
indebtedness of the City of San Bernardino, which said bonded
indebtedness was outstanding at the time of filing said petition
or theretofore authorized and is outstanding at the time of Slid
annexation, to wit:
A bonded indebtedness of $200,000.00 incurred for the con-
struction and completion of a convention hall, the outstanding
indebtedness thereon being $35,000.00, bearing interest at the
rate of 5% per annum;
A bonded indebtedness of $275,000.00, incurred for the
acquisition and construction of water works, including "Devil
Canyon Water Works," water rights, rights of way, pipe lines,
wells and pumping plants, the outstanding indebtedness thereon
being $68,750.00, bearing interest at the rate of 5% per annUM;
A bonded indebtedness of $650,000.00 incurred for the
acquisition of real property, and construction of a sewage disposal
plant, inverted siphon sewer lines and intercepting sewers; the

bearing interest I
outstanding indebtedness thereon being $86,666.64,
at the rate of 4t% per annum.
SECTION FOUR: The property herein annexed is declared to

30 newspaper designated for t hat purpose.
