HomeMy WebLinkAbout2095 ~ . . 1 2 NOTICE OF EL~CTION ORDINANCE NO. o?CJ95 , 3 AN ORDINANCE OF TH~ CITY OF SAN B~RNARDINO CALLING A SPECIAL ELECTION TO BE II~LD ON TII~ TENTH DAY OF APRIL, 1956, PERTAINING TO TilE ANNEXA- 4 TION OF A DISTRICT CALLED: 5 "ANNEXATION DISTRICT NO. 88" 6 WHEREAS, by resolution, the Mayor and Common Council of the City of 7 San Bernardino declared its intention to call a special election to be held 8 on the tenth day of April, 1956, in certain inhabited territory contiguous to 9 said City proposed to be annexed to said City, for the purpose of submitting 10 to the qualified electors residing in said territory the question whether or 11 not said territory shall be annexed to said City; and 12 WHEREAS, a copy of said resolution was published as required by 13 law; and 14 WHEREAS, at a time not later than the hour set by said resolution 15 for hearing objections to the proposed election no written or oral protests 16 were made by the owners of one-half of the value of the territory proposed to 17 be annexed as shown by the last equalized assessment roll of the property 18 within the territory proposed to be annexed; and 19 WH~REAS, all proceedings have been had in accordance with said 20 resolution and the Annexation Act of 1913, reference thereto hereby being 21 made for further particulars; 22 NOW, THEREFORE, the Mayor and Common Council of the City of San 23 Bernardino do ordain as follows: 24 SECTION ONE: A special election hereby is called to be held on the 25 I 10th day of April, 1956, in the territory hereinafter described and proposed 26 to be annexed to the City of San Bernardino, for the purpose of submitting to 27 the qualified electors residing in said territory the question whether or not 28 such territory shall be annexed to. incorporated in, and made a part of said 29 City of San Bernardino, and whether or not the property in said territory shall, 30 after such annexation, be subject to taxation, equally with the property within 31 the City of San Bernardino, to pay the entire bonded inde~tedness of the City 32 of San Bernardino outstanding at the date of filing of the petition for annexa- 1 2 3! i 41 I 51 I 61 71 S 9 10 11 12 13. 14 15 16 17 1S I 19 i , I 20 21 22 23 24 25 26 I 271 28 29 30 31 32 tion. . . Said territory is described as follows: All of that certain real property located in the County of San Bernardino, State of California, more particularly described as follows: All that portion of Block 11 of the Orange Grove Tract, as per plat recorded in Book 11 of Maps at page 14, Records of the County Recorder of San Bernardino County, and all that portion of Lot 6" Block 86; Rancho San Bernardino, as per plat recorded in Book 7 of Maps at page 2, Records of the County Recorder of San Bernardino County, described as follows: BEGINNING at a point in the present corporate limits of the City of San Bernardino, said point being on the North line of Highland Avenue, 82.50 feet wide, as delineated on said map of the Rancho San Bernardino, and said point being the Southeast corner of Perris Hill Heights, Tract No. 1977, as per plat re.. corded in Book 28 of Maps at page 67, Records of the County Recorder of San Bernardino County; thence Northerly along the East line of said Tract No. 1977, being along the present cor- porate limits of said City, to the South line of Twenty-seventh Street, 50 feet wide, as dedicated by Tract No. 3931 as per plat recorded in Book 50 of Maps at pages 72 and 73, Records of the County Recorder of San Bernardino County; thence Easterly along the South line of said Twenty-seventh Street, being along the present corporate limits of said City, 9.98 feet, more or less, to the Northwest corner of Lot I, Block 12, of said Orange Grove Tract; thence Southerly along the West line of said Lot I, Block 12, being along the present corporate limits of said City, to the Southwest corner of said Lot I, Block 12; thence Easterly along the south line of said Lot I, Block 12, being along the present corporate limits of said City, to the Northeast corner of Tract No. 2536 as per plat recorded in Book 36 of Maps at page 35, Records of the County Recorder of San Bernardino County; thence Sout~erly along the East line of said Tract No. 2536, being along the pres~nt corporate limits of said City, 300.00 feet, to the. Northeast corner of Lot 15 of said 'Tract No. 2536; thence Easterly and parallel to the North line of said Highland Avenue, being along the present corporate limits of sa'id City, 6.00" feet; thence Southerly,and parallel to the East line of said Tract No. 2536, being along.the pre,sent corporate limits of said City, 180.00 feet; thence Westerly and parallel to the North line of said Highland Avenue, being along the present corporate limits of said City, 6.00 feet, to the Southeast corner of Lot 16 of said Tract No., 2536; thence Southerly along the East line of said Tract No. 2536, being along the present corporate limits of said City, to a point 198.00 feet North of the North line of said Highland Avenue; thence Easterly and parallel to the North line of said Highland Avenue, being along the present corporate limits of said City, to a point 220.00 feet West of the Center line of Golden Avenue, 82.50 feet wide, as delineated on said map of the Orange Grove Tract; thence Southerly and parallel to the center line of said Golden Avenue, being along the present corporate limits of said City, to the North line of said High- land Avenue; thence Westerly along the North line of said High- land Avenue, to the point of beginning. SECTION TWO: TIME OF OPENING AND CLOSING OF POLLS. The polls at said election shall be opened at 7 o'clock A. M. of the day herein fixed for -2- . . . . 1 the holding of said election and shall be kept open until 7 o'clock P. M. of 2 the same day, when the polls shall be closed. 3 SECTION THREE: BALLOTS. Upon the ballots to be used at said election 4 there shall be printed the words: 5 SHALL ANNEXATION DISTRICT NO. 88 BE ANNEXED TO, INCORPORATED IN AND 6 MADE A PART OF THE CITY OF SAN BERNARDINO AND THE PROPERTY IN SUCH TERRITORY 7 BE, AFTER SUCH ANNEXATION, SUBJECT TO TAXATION EQUALLY WITH THE PROPERTY 8 WITHIN THE CITY OF SAN BERNARDINO, TO PAY ITS PRO--RATA PORTION, BASED UPON 9 ASSESSED VAWATION OF ALL BONDED INDEBTEDNESS OF THE CITY OF SAN BERNARDINO 10 OUTSTANDING AT THE DATE OF THE flUNG OF THE PETITION FOR ANNEXATION? 11 Opposite these words there shall be printed the words "Yes" and 12 "No," and to the right of each of these last two words there shall be a voting 13 square. If an elector shall stamp a cross <+) in the voting square after 14 the printed word "Yes" the vote of such elector shall be counted in favor of 15 the annexation of said territory to the City of San Bernardino, and if an 16 elector shall stamp a cross <+) in the voting square after the printed word 17 "No" the vote of such elector shall be counted against such annexation. 18 In all particulars not herein recited said election shall be held in 19 conformity, as near as may be, with the laws of the State of California con- 20 cerning general elections and with said Annexation Act of 1913. 21 SECTION FOUR: For purpose of said election there hereby is established 22 in the territory described herein one <I) voting precinct, which shall include 23 all of said territory. The following is the polling place of said election 24 precinct and the following named persons hereby are named officers of election 25 and shall constitute the board of election for such election precinct: 26 Polling Place - Residence of Mrs. Grace M. Tronson 2424 Harrison Street, San Bernardino, California 32 SECTION FIVE: This ordinance shall take effect upon its publication. -3- 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 .. 0_'" .... -' ' . . 1 2 3 4 5 6 7 SECTION SIX: The City Clerk shall certify to the passage and a- doption of this ordinance by the Council of the City of San Bernardino and shall cause the same to be published three consecutive days in the San Bernar- dino Evening Telegram, a daily newspaper of general circulation printed and published within the City of San Bernardino, and once a week for four (4) weeks prior to the date of the election in the Colton Daily Courier, a newspaper of general circulation printed and published outside of the City of San Bernardino but in the County of San Bernardino, California, which said ordinance shall be preceded by the words "Notice of Election," and that due publication of this ordinance as herein provided is hereby determined to be sufficient notice of said election, and the only notice that shall be required to be given.
