BERNARDINO, APPROVING THE ~TION OF DISl'RICl' NO. 85. . .,,<. 4 WHEREAS, heretofore a petition was filed with the Common Council of 5 the City of San Bernardino requesting that certain uninhabited territory con~ 6 tiguous to said City be annexed to the City of San Bernardino and wh~ch said 7. petition described said territory and the boundaries thereof proposed to be annexed to the City; and WHEREAS, said petition was filed by the owners of not less than one~ fourth of the area of land in such territory and representing not less than one~ I 'I , fourth of the assessed value of such territory according to the last preceding I equalized assessment roll of the County of San Bernardino, in which said County the City of San Bernardino is situated; and WHEREAS, the said petition requested the said territory to be annexed I to and included in the said municipal corporation, in accordance with the pro~ visions of the Government Code, Section 35300, et seq., and WHEREAS, all and each of the owners of all of the aforesaid real pro~ perty and of each and every parcel contained therein have consented in writing and filed with the City Clerk of the City of San Bernardino, who acts as Clerk for said Common Council, their consent and agreement that all of the property included in the aforesaid territory shall be taxed equally with the other pro~ perty within the said City to pay the bonded indebtedness and any and all genera~ i , indebtedness and liability of the City of San Bernardino contracted prior to or I following or outstanding at the time the aforesaid petition of the annexation was filed and subsequent thereto, as provided in said Government Code, and . . WHEREAS, on the 9th day of January, 1956, a Resolution was adopted by the aforesaid Common Council of the City of San Bernardino, California, pro- i the annexation of the aforesaid uninhabited territory to be generally : 29 known as the ANNEXATION DISl'RICl' NO. 85 to the City of San Bernardino, and that posing 30 said Resolution provided therein that the proposed annexation should be generall~ 31 known and identified as the ANNEXATION DISl'RICl' NO. 85; and 32. WHEREAS, s.aid Resoluti.on set forth therein that all the property in~ : - 1..... i 1 a 3 4 I) 6 7 8 9 10 11 12 13 14 15 lCl 17 18 - 19 20 21 22 23 24 25! 261 i 271 281 , ; 29' , I 30' ! , 31! 32 .... .,.~ . .. ... --lit-.... .. cluded in the aforesaid territory should be taxed equally with the other pro- perty within the said City to pay the bonded indebtedness and any and all gen- eral indebtedness and liability of the City of San Bernardino, contracted prior to or existing or outstanding at the time of the aforesaid proposed annexation .~ ",,1 of the aforesaid property, as provided in the hereinbefore mentioned Government Code; and ~l!REAS, the said Resolution did fix, determine and declare that a hearing be,held on the 20th day of February, 1956, at the hour of 7:30 o'clock P,M., in the Council Chambers of the City Hall, in the City of San Bernardino, and the same was the day, hour and place designated where any person owning real estate within such territory so proposed to be-annexed and having any objection to the proposed annexation might object before the Common Council and show cauSe why such territory should not be annexed, and furthermore, the said Resolution provided that at any time not later than the said hour set, as mentioned herein- before for the said hearing, any owner of property within the said territory proposed to be annexed might file written protest with the City of San Bernardino against such annexation: and WHEReAS, no objection or protests of any kind or nature whatsoever -l' were made, or filed, either written or oral, with the said City of San Bernardino and no protests or objections of any nature whatsoever were made, either written or oral, at the meeting of the Common Council on the 20th day of February, 1956,' as mentioned hereinbefore, at which said meeting the said Common Council pub- licly announce~ that any person, firm or corporation desiring to protest or object to said annexation might do so at said meeting; and WHEREAS, it appears to the Common Council of the City of.S~n Bernardino that the aforesaid annexation proceedings have been completed and everything per- formed at this time, in accordance with said Government Code, and mentioned hereinbefore, and any and all other laws in any way connected with the said annexation procedure, having been complied with; and WHEREAS, the Common Council of the City of San Bernardino desire to approve at this time the annexation of the aforesaid territory. NOW, THEREFORE, THE COMMoN COUNCIL OF THE CITY OF SAN BERNARDINO DOES ". :1 - 2 - ...~'-.. ......:... . -" .. .. I I 5' SECfION ONE: That said territory as herein described as Annexation SECfION TWO: The territory herein referred to as being annexed to the I 6 City of San Bernardino is particularly described as follows, to wit: ? All that portion of Lot 11. Block 43 of the Rancho San Bernardino, as per plat recorded in Book 7 of Maps at page 2, Records of the County Recorder of San Bernardino County, described as follows: 8 9 10 11 12 13 , ! 14' 151 Beginning at a point in the present corporate limits of the City of San Bernardino, said point being on the center line of Waterman Avenue. 82.50 feet wide. as delineated on said map of the Rancho San Bernardino, and said point being 204.82 feet North of the ' Westerly prolongation of the South line of said Lot II: thence ~ortherly along the center line of said Waterman Avenue, being along the present corporate limits of the City of San Bernardino. 76.50 feet: thence Easterly and parallel to the Westerly prolonga- tion of the South line and the South line of said Lot 11. 283.68 feet: thence Southerly and parallel to the West line of said Lot 11. 76.50 feet: thence Westerly and parallel to the South line and the Westerly prolongation of the South line of said Lot 11. 283.68 feet. to the point of beginning. SECTION FOUR: The property herein annexed is dOGlared to be a part of Ward I, and the boundaries of Ward I, are hereby altered to include said annexed territory; and said property is placed and declared to be in Zone C~M Commercial Manufacturing. SECTION FIVE: The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published three consecutive times in the San Bernardino Evening Telegram, a daily newspaper designated for that purpose.
