ORDINANCE NO~~ AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BER- NARDINO, APPROVING THE ANNEXATION OF DIstRICT NO. 89. WHEREAS, heretofore a petition was filed with the Common Council of the City of San Bernardino requesting that certain uninha~ited territory conti- guous to said City be annexed to the City of San Bernardino and which said peti- tion described said territory and the boundaries thereof proposed to be annexed to the City; and WHEREAS, said petition was filed by the owners of not less than one- fourth of the area of land in such territory and representing not less than one- fourth of the assessed value of such territory according to the last preceding equalized assessment roll of the County of San Bernardino, in which said County the City of San Bernardino is situated; and WHEREAS, the said petition requested the said territory to be annexed sions of the Government Code, Section 35300, et seq., and perty and WHEREAS, all and each of the owners of all of each and ever~parcel contained therein have consented in writing and filed with the City Clerk of the City of San Bernardino, who acts as Clerk for said Common Council, their consent and agreement that all of the property in eluded in the aforesaid territory shall be taxed equally with the other property within the said City to pay the bonded indebtedness and any and all general in- debtedness and liability of the City of San Bernardino contracted prior to or following or outstanding at the time the aforesaid petition of the annexation wa~ , ! filed and subsequent thereto, as provided in said Government Code, and I WHEREAS, on the 9th day of January..1956, a Resolution was adopted by I the aforesaid Common Council of the City of San Bernardino, California, propos- ing the annexation of the aforesaid uninhabited territory to be generally known as the ANNEXATION DIstRICT NO.89 to the City of San Bernardino, and tha(~aid Resolution provided therein that the proposed annexation should be generally known and identified as the ANNEXATION DISTRICT NO. 89; and WHEREA,S, said Resolution set forth therein that all the property in- 1 2 3 4 5 6 7 8 9 10 11 12 13 141 151 161 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 . . . . .... cluded in the aforesaid territory should be taxed equally with the other proper~ ty within the said City to pay the bonded indebtedness and any and all general indebtedness and liability of the City of San Bernardino, contracted prior to or existing or outstanding at the time of the aforesaid proposed annexation of the aforesaid property, as provided in the hereinbefore mentioned Government Code; and WHEREAS, the said Resolution did fix, determine and declare that a hearing be held on the 20th day of February, 1956, at the hour of 7:,aO o'clock P,M., in the Council Chambers of the City Hall. in'the City of San Bernardino, and the same was the day, hour and place designated where any person owning real estate within such territory so proposed to be annexed and having any objection to the proposed annexation might object before the Common Council and show cause why such territory should not be annexed, and furthermore, the said Resolution , I provided that at any time not later than the said hour set, as mentioned herein~ I before for the said hearing, any owner of property within the said territory ! I proposed to be annexed might file written protest with the City of San Bernardin against such annexation; and WHEREAS, no objection or protests of any kind or nature whatsoever were made, or filed, either written or oral, with the said City of San Bernardin. - ! and no protests or objections of any nature whatsoever were made, either written I I or oral, at the meeting of the Common Council on the 20th day of February, 1956,! ! as mentioned hereinbefore, at which said meeting the said Common Council pub- licly announced that any person, firm or corporation desiring to protest or ob~ ject to said annexation might do so at said meeting; and WHEREAS, it appears to the Common Council of the City of San Bernar- dino that the aforesaid annexation proceedings have been completed and every thin performed at this time, in accordance with said Government Code, and mentioned hereinbefore, and any and all other laws in any way connected with the said annexation procedure, having been complied with; and WHEREAS, the Common Council of the City of San Bernardino desire to approve at this time the annexation of the aforesaid territ~ry, l'<<lW. '- 'c 1 HERffiY ORDAIN AS FOu..oWS: 2 SECTION O~~: That said territory as herein described as Annexation 3 District No. 89 is hereby annexed and incorporated in and made a part of the 4 City of San Bernardino. 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 SECTION TWO: The territory herein referred to as being annexed to the City of San Bernardino is particularly described as follows, to wit: All that portion of the North one-half of Section 16 and South one- half of Section 9, Township 1 North, Range 4 West, San Bernardino Base and Meridian, unsurveyed, lying within the Muscupiabe Rancho, as per plat recorded in Book I, page 24, of maps, records of San Bernardino County, State of California, described as follows: BEGINNING at a point in the present corporate limits of the City of San Bernardino, said point being the intersection of the North- erly prolongation of the West line of *F" Street, 40 feet wide, delin- eated as First Avenue on the Map of Arrowhead Suburban Farms Tract "A". Recorded in Book 21, page 2, of Maps records of San Bernardino County, with the center line of forty-second street, 60 feet wide, delineated as "A" Street on said map of Arrowhead Suburban Farms Tract "A": thence Westerly along the centerline of said forty- second Street to an intersection with the centerline of North "E" Street, 40 feet wide, delineated as Second Avenue on Map of Arrow- head Suburban Farms Tract "CHi recorded in Book 23, on Page 23, of Maps, records of San Bernardino County; thence Northerly along the centerline of said North "E" Street to an intersection with the centerline of Hill Drive 80 feet wide; thence Westerly along the centerline of said Hill Drive, said centerline being also the North line of said Arrowhead Suburban Farms Tract "C", and also the North line of Tract 1748, Arrowhead Suburban Farms Tract "E", recorded in Book 25, page 59, Records of San Bernardino County, to an intersection with the West line of .the aforesaid Section 16; thence ~ortherly along the West line of said Section 16 and said Section 9 to a point which is 702.98 feet North of the South line of said Section 9; thence North 89032' 30" East, a distance of 2103.92 feet: thence South 87002'30" East, a distance of 1597.35 feet; thence South 20014' East, a distance of 636.74 feet to a point on the South line of said Section 9, said point being 40 feet West of the Northerly prolongation of the centerline of said North "E" Street; thence North 89025' East, a distance of 1375 feet, more or less, to the Northeast corner of said Section 16, said corner being a point in the present corporate limits of the City of San Bernardino; thence Southerly along the East line of said Section 16, being also along the present corporate limits of the City of San Bernardino, to an intersection with the North right of way line of said forty-second Street; thence Westerly along the North line of said Forty-second Street, being also along the present corporate limits of the City of San Bernardino, to an intersection with the Northerly prolongation of the West line of said "F" Street: thence Southerly along the Northerly prolongation, of the West line of said "F" Street, being also along the present corporate limits of the City of San Bernardino, to the point of beginning, Basis of bearing is the North line of said Tract No. 1748, Arrowhead Suburban Farms Tract "E", being North 89025' East (recorded North 89036' East). SECTION THREE: That the above described property will be subject to - 3 . . . " . . '- 1 taxation equally with the property within such municipal corporation, to pay its 2 proportion of the following bonded indebtedness of the City of San Bernardino, 3 which said bonded indebtedness was outstanding at the time of filing said peti- 4 tion or theretofore authorized and is outstanding at the time of said annexation, 5 to wit: 6 A bonded indebtedness of $200,000.00 incurred for the construction and 7 completion of a convention hall, the outstanding indebtedness thereon being 8 $35,000.00, bearing interest at the rate of 5% per annum; 9 A ponded indebtedness of $215,000.00, incurred for the acquisition and 10 construction of water works, including "Devil Canyon Water Works," water rights, 11 rights of way, pipe lines, wells and pumping plants, the outstanding indebtedness 12 thereon being $68,150.00, bearing interest at the rate of 5% per annum; 13 A bonded indebtedness of $650,000.00 incurred for the acquisition of 14 real property, and construction of a sewage disposal plant, inverted siphon 16 sewer lines and intercepting sewers, the outstanding indebtedness thereon being 16 $86,666.64, bearing interest at the rate of ~ per annum. 17 SECTION FOUR: The property herein annexed is declared to be a part of 18 Ward 4, and the boundaries of Ward 4, are hereby altered to include said annexed 19 territory; and said property is placed and declared to be in Zone R-I Single 20 Family Residential. 21 SECTION FIVE: The City Clerk shall certify to the passage of this 22 ordinance and shall cause the same to be published three consecutive times in 23 the San Bernardino Evening Telegram, a daily newspaper designated for that 24 purpose. 25 26 27 28 29 30 31 I HEREBY CERTIFY that the foregoing ordinance was duly adopted by the Mayor and Common Council of the City of San Bernardino at a 12e.~~) meeting thereof, held .on the~ day of ~-{,t!~ ,t{'956, by the following vote., to. wit: - , ~.
