HomeMy WebLinkAbout2100 . .. . > ~ . 1 ORDINANCE NO.-& /~ 2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO REGULATING ESCORT BURBAUS. 3 , ., THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 4 00 ORDAIN AS FOLLOWS: 5 SECTION ONE: ''Escort Bureau" shall mean any business or 6 agency which, for a fee, commission, hire, reward or profit. ? furnishes, or offers to furnish escorts or persons who, for hire 8 or- reward, accompany others to or about social affairs, entertain- 9 ments or places of amusement, or who consort with others, for hire 10 11 12 13 14 16- 16 I I I I I . I i I I i or reward, about any place of public resort or within any private quarters. SECTION TWO: No person shall conduct, manage or carry on any escort bureau without a permit therefor from the Chief of Police. No such permit shall be issued by the Chief of Police except upon the verified application in writing of the individual to be in control of, and responsible for. the operation and con- 17 duct of the business. The application shall be upon a form fur- 18 nished by the City Clerk and shall set forth such information . 19 concerning the applicant. and the proposed business as the Chief 20 of Police may require and must be accompanied by a fee in the 21 sum of $200.00. Each permit issued. shall expire on December 31st 22 next following the date of issuance, and each application for the 23 annual renewal thereof shall be accompanied by a renewal fee in 24 the sum of $7 5.00. No ]Jre rmit under this section shall be issued 25 to, or in the name of, any organization, group, corporation,' ., 26 27 28 29 30 31 32 partner,sb.ip, or any other entity than an individual person; but the business may be advertised and carried on by the permittee un- I I' I I I I I I I i I der a fictitious name in the manner permitted by law, provided such fictitious name is first approved by the Chief of Police. and SECTION THREE: Each app1icatitn must state the names addresses of all escorts intended to be employed by the applicant and, if a permit be granted, the permittee must notify -1- . . . . . - . 1 the Chief of Police in writing. within twenty-four hours, of any 2 change in personnel. All such escorts shall be registered by the 3 Police Department and shall be photographed and finger printed. 4 No escor t shall be registered unless there be furnished to the 5 Chief of Police satisfactory evidence of the good moral character 6 of such escort. The registration of any escort may be cancelled 7 for cause by the Chief of Police and thereafter no escort bureau 8 shall employ, engage, or deal with such escort. 9 cSECTION POUR:" If the Chief of Police. 'after investiga- 10 tion, shall find that the applicant for the permit is of good moral 11 character and reputation, and that the business iscto be conducted ' - 12, at a: suitable and prGpet:place,andis not calculated or intended 13 to be operated as a subterfuge for the conduct of any unlawful or 14 immoral business or practice, then a permit shall be granted. 15 Otherwise the application shall be denied. 16 SECTION FIVE: The permittee shall conduct the business 17 only at the address shown on the permit. Each additional place 18 of business shall require a separate permit. Upon the abandon- 19 ment of the designated place of business, a change of address may 20 be granted by the Chief of Police upon the payment of a special 21 fee of $25.00, and the new address shall be endorsed upon the per- 22 mite 23 SECTION SIXt A record shall be kept by each permittee 24 showing every transaction whereby any escort is employed, furnish- 25 ed or arranged for on behalf of any patron or customer, the date 26 and approximate hour of the transaction, the name, address and 27 telephone number of the patron or customer. the name of each 28 escort involved and such other information as the Chief of Police 29 may reasonably require by rule or regulation. Such record shall 30 be kept available and open to the inspection of any police officer 31 at any time during business hours and shall be presented before 32 the Chief of Police at any time upon written request therefor. -2- . . . . - . 1 SECTION SEVEN: The Mayor and Common Council shall have 2 the power to suspend or revoke any permit. or to deny a renewal 3 after notice and an opportunity for a hearing has been given to 4 the permittee upon any of the following grounds: 5 a. That the permittee has, in the course of the business, 6 committed, or caused, permitted, encouraged or condoned the com- 7 mission of. any act in violation of this section. or any lewd and 8 immoral ast. or any act of prostitution; 9 b. That the business has been conducted, in whole or in 10 part, as a subterfuge to facilitate or to conceal the conduct of 11 any unlawful or immoral business or practice. 12 I SECTION EIGHT: Nothing in this section shall apply to 131 the lawful business of any employment agency licensed under the I 14 i laws of this State. , 15 i 1& 17 181 191 , 20 I 21 22 231 I 24 i 25 26 27 28 29 30 31 32 ' I SECTION NINE: No permittee hereunder shall employ, as an escort, any person under 21 years of age. SECTION TEN: No permittee shall furnish any escort to, or accept employment from, any patron, customer, or person to be escorted who is under 21 years of age, except at the special instance and request of the parent, guardian or other person in lawful custody of the person upon whose behalf the escort service is engaged. SECTION ELEVEN: PENALTIES. Any person who violates any provision of this ordinance shall be deemed guilty of a misde- meanor and upon conviction thereof shall be fined not exceeding $500.00,. or by imprisonment for not more than 180 days, or by both S!lid fine and said imprisonment.
