AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO, A!'PROVING TiJE ANNEXATION OF DISTRICT NO. 91.
WHEREAS, heretofore a petition was filed with the Common Council of
the City of San Bernardino requesting that certain uninhabited territory conti-
guous to said City be annexed to the City of San Bernardino and which said peti-
tion described said territory and the boundaries thereof proposed to be annexed
to the City; and
WHEREAS, said petition was filed by the owners of not less than one-
fourth of the area of land in such territory and representing not less than
one-fourth of the assessed value of such territory according to the last pre-
ceding equalized assessment roll of the County of San Bernardino, in which said
County the City of San Bernardino is situated; and
WHEREAS, the said petition requested the said territory to be annexed
to and included in the said municipal corporation, in accordance with the provi-
sions of the Government Code, Section 35300, et seq., and
WHEREAS, all and each of the owners of all of the aforesaid real pro-
perty and of each and every parcel contained therein have consented in writing
and filed with the City Clerk of the City of San Bernardino, who acts as Clerk
for said Common Council, their consent and agreement that all of the property
included in the aforesaid territory shall be taxed equally with the other pro-
perty within the said City to pay the bonded indebtedness and any and all gen-
eral indebtedness and liability of the City of San Bernardino contracted prior
to or following or outstanding at the time the aforesaid petition of the annexa-
tion was filed and subsequent thereto, as provided in said Government Code, and
WHEREAS, on the 2nd day of April, 1956, a Resolution was adopted by
the aforesaid Common Council of the City of San Bernardino, California, propos-
ing the annexation of the aforesaid uninhabited territory to be generally known
as the ANNEXATION DlSTRICT NO. 91 to the City of San Bernardino, and that said
Resolution provided therein that the proposed annexation should be generally
known and identified as the ANNEXATION DIStRICT NO. 91; and
WHEREAS, sa~d Resolution set forth therein that all the property in-

1 eluded in the aforesaid territory should be taxed equally with the other property
a within the said City to pay the bonded indebtedness and any and all general in-
3 debtedness and liability of the City of San Bernardino, contracted prior to or
4 existing or outstanding at the time of the aforesaid proposed annexation of the
5 aforesaid property, as provided in the hereinbefore mentioned Government Code;and
6 WHEREAS, the said Resolution did fix, determine and declare that a
7 hearing be held on the 7th day of May, 1956, at the hour of 7:30 o'clock P.M.,
8 in the Council Chambers of the City Hall, in the City of San Bernardino, and the
9 same was the day, hour and place designated where any person owning real estate
10 within such territory so proposed to be annexed and having any objection to the
11 proposed annexation might object before the Common Council and show cause why
12 such territory should not be annexed, and furthermore, the said Resolution pro-
13 vided that at any time not later than the said hour set, as mentioned hereinbefor
14 for the said hearing, any owner of property within the said territory proposed
15 to be annexed might file written protest with the City of San Bernardino against
16 such annexation; and
17 WHEREAS, no objection or protests of any kind or nature whatsoever
18 were made, or filed, either written or oral, with the said City of San Bernardino
19 and no protests or objections of any nature whatsoever were made, either written
20 or oral, at the meeting of the Common Council on the 7th day of May, 1956, as
21 mentioned hereinbefore, at which said meeting the said Common Council publicly
22 announced that any person, firm or corporation desiring to protest or object to
23 said annexation might do so at said meeting; and
24 WHEREAS, it appears to the Common Council of the City of San Bernardino
25 that the aforesaid annexation proceedings have been completed and everything per-
26 formed at this time, in accordance with said Government Code, and mentioned here-
27 inbefore, and any and all other laws in any way connected with the said annexa-
28 tion procedure, having been complied with; and
29 WH~EAS, the Co~on Council 'bf the City of San Bernardino desire to
30 approve at this time the annexation of the aforesaid territory.
31 ' NOW, THEREFORE, THE COMMON COUl'lClL OF THE CITY OF SAN BERNARDINO DOES

1 SECTION ONE; That said territory as herein described as Annexation
a District No. 91 is hereby annexed and incorporated in and made a part of the
3 City of San Bernardino.
SECTION TWO: The territory ~erein .referred to as being annexed to the
City of San Bernardino is particularly described as follows, to wit:
ParC;e1s l, 2, 3, 4 and 5 being a portion of Government lot 3 of the
Norihwest Quarter of Section 14, Township 1 North, Range 4 west, San
Bernardino Base and Meridian, in the County of San Bernardino, State
of California according to Government Township Plat, approved December
13, 1900, described as follows:
Beginning at the intersection of the west line of said Section 14 with
the southerly right of way line of the Pacific Electric Railroad, said
point being S 00 19' E 451.11 feet from the northwest corner of said
Section 14; thence S 180 30' E 159.34 feet; thence along a curve to th
left of radius 2939.93 feet and central angle of 100 46' 32" a dis-
tance of 552.91 feet; thence S 260 58' 59" W 230.53 feet to a po~nt on
the northerly right of way line of the state highway; thence along
said right of way line S 840 09' 55" W 96.44 feet; thence along a
curve to the left of radius 645 feet and a central angle of 55 38'08"
a distance of 626.31 feet: thence N 00 19' W 639.54 feet to the point
of beginning.
Except therefrom any portion thereof lying within the Pacific Electric
Right of Way and also except therefrom all state and County roads.
SECTION THREE: That the above described property will be subject to
taxation equally with the property within such municipal corporation, to pay
its proportion of the following bonded indebtedness of the City of San Bernardin
which said bonded indebtedness was outstanding at the time of filing said peti-
tion or theretofore authorized and is outstanding at the time of said annexa-
tion, to wit:

A bonded indebtedness of $200,000.00 incurred for the construction and:
completion of a convention hall, the outstanding indebtedness thereon being
$30,000.00, bearing interest at the rate of 5% per annum;
A bonded indebtedness of $215,000.00, incurred for the acquisition and
construction of water works, including "Devil Canyon Water Works," water rights,
rights of way, pipe lines, wells and pumping plants, the outstanding indebted-
ness thereon being $61,815.00, bearing interest at the rate of 5% per annum;
A bonded indebtedness of $650,000.00 incurred for the acquisition of
real property, and construction of a sewage disposal plant, inverted siphon
sewer lines and intercepting sewers, the outstanding indebtedness thereon ~ing
$43,333.32, bearing interest at the rate of ~ per annum.

1 SECTION FOUR: The property herein annexed is declared to be a part of
2 Ward 4. and the boundaries of Ward 4. are hereby altered to inelude said annexed
3 territory; and said property is placed and declared to be in Zone R-l Single
4 Family Residential.

SECTION FIVE: The City Clerk shall certify to the passage of this
ordinance and shall cause the same to be published three consecutive times in
the San Bernardino Evening Telegram. a daily newspaper designated for that
purpose.
I HEREBY CERTIFY that the foregoing ordinanee was duly adopted by the
Mayor an~'C~onCouncil of the City of San Bernardino at a regular meeting
