AN ORDINANCE OF TIlE ijAYOR AND COMMON COUNCIL OF TIIE CITY
OF SAN BERNARDINO PROVIDING FOR nIE KEEPING AND SALE OF UNCLAIMED
PROPERTY IN THE POSSESSION OF THE POLICE DEPARTMENT OF SAID CITY,
AND REPEALING ORDINANCE NO. 1836.
THE ijAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
5 00 ORDAIN AS FOLLOWS:

SECTION ONE: That any and all unclaimed property now or
7 hereafter coming into the possession of the Police Department
8 ,shall be inventoried at least every three (3) months by the Chief
9 of Police and a full and complete list thereof shall be transmit-
10 ted to the City Administrative Officer.

SECTION TWO: That the City Administrative Officer, upon
12 receipt of said list of unclaime4 property shall determine there-
13 from the unclaimed property that has been held by the Police De-
14 partment for a periOd of at ieast six (6) 1Il0nths, whereupon said
15 Administrative Officer shall cause said unclaimed property so
16 held for a period'of at. l:.~t'six (6)moilths to be appropriated
17 for the use of the City "of San' Bernardino or ~old, at public auction
18 as follows:
(a) That notice of such'sll1e, describing the property in
sufficient detail for its ,identification, shall be prepared by the
City Administrative Officer, and said notice signed by the Chief
of Police, which said notice of said sale shall be given at least
five (5) days before 'the time fixed therefor by publication once
in a newspaper of general circulation published in the City of San
Bernardino.
(b) That no city officer, elected or appointed, or em-
ployee shall directlY Or in.directly submit a bid for the purchase
of said unclaimed property at said sale.
(c) Thatsaidpropel:"ty so offered for sale shall be sold
to the highest bidder for cash, provided that the Administrative
Officer may, in his discretion, fix a minimum sale price and may
refuse to sell un.less said minimum price is offered.

SECTION THREE: Any articles of property to be appropr iated
2 to the use of the city shall be made available to the division in
3 need thereof upon approval of such appropriation by the Admini-
4 strative Officer.

SECTION FOUR: That the proceeds of said auction sale or
6 sales shall immediately be deposited with the Treasurer of the
7 City of San Bernardin!> and placed in the General Fund thereof.

SECTION FIVE: That it shal~ be the duty and responsibil-
9 ity of the Police Department to safely keep any and all unclaimfid
10 properties subject to the right of said Administrative Officer to
11 s.ell said properties at public auction as .herein provided, where-
12 upon said property shall then be delivered to the purchaser upon
13 payment of the purChase price.

SECTION SIX~ Whenever in this Ordinance the following
words and phrases set forth in this Section are used, they shall,
. for the purpose of this Ordinance have the meanings respectively
ascribed to them in this Section:
"Unclaimed Property" shall include any and all lost.
abandoned or unclaimed personal property of .whatsoever kind or
character, but shall not include such property which is specific-
ally ordered to be destroyed by the provisions of the law nor to
the disposal of dogs, cats or livestock.
SECTION SBVEN: . Ordinance No. 1836 of the City of San
Bernardino and all other ordinances in conflict herewith are here-
by repealed.
I HEREBY CERTIFY that the foregeing Ordinance was duly
