WHEREAS, heretofore a petition was filed with the Common Council of the City of San Bernardino requesting that certain uninhabited territory conti- guous to said City be annexed to the City of San Bernardino and which said peti- tion described said territory and the boundaries thereof proposed to be annexed to the City; and WHEREAS, said petition was filed by the owners of not less than one- fourth of the area of land in such territory and representing,not less than one-fourth of the assessed value of such territory according to the last pre- ceding equalized assessment roll of the County of San Bernardino, in which said County the City of San Bernardino is situated; and WHEREAS, the said petition requested the said territory to be annexed to and included in the said municipal corporation, in accordance with the provi- sions of the Government Code, Section 35300, et seq., and WHEREAS, all and each of the owners of all of the aforesaid real pro- perty and of each and every parcel contained therein have consented in writing and filed with the City Clerk of the City of San Bernardino, who acts as Clerk for said Common Council, their consent and agreement that all of the property included in the aforesaid territory shall be taxed equally with the other proper- ty within the said City to pay the bonded indebtedness and any and all general indebtedness and liability of the City of San Bernardino contracted prior to or following or outstanding at the time the aforesaid petition of the annexation was filed and subsequent thereto, as provided in said Government Code, and WHEREAS, on the 21st day of May, 1956, a Resolution was adopted by the aforesaid,Common Council of the City of San B~rnardino, California, proposing 28' the annexation of the aforesaidul)inhabite<l territory to be generally known as 29 the ANNEXATION DISTRICT NO. 94 to the City of San Bernardino, and that said Reso- 30 lution provided therein that the proposed annexation should be generally known 31 and identified as the ANNEXATION DISTRICT NO. 94; and 32 WHEREAS, said Resolution set forth therein that all the property in- 1 ~ 3 4 5 6 7 8 9 10 11 12 13 .14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29. 30 I 31 32 . - .. . cluded in the aforesaid territory should be taxed equally with the other property within the said City to pay the bonded indebtedness and any and all general in- debtedness and liability of the City of San Bernardino, contracted prior to or existing or outstanding at the time of the aforesaid proposed annexation of the aforesaid.. property,a~ provided in the. hereinbefore mentioned Government Code; and WHEREAS, the said Resolution did fix, determine and declare that a hearing be held on the 2nd day of July, 1956, at the hour of 7:30 o'cJock P.M., in the Council Chambers of the City Hall, in the City of San Bernardino, and the same was the day, hour and place designated where any person owning real estate within such territory so proposed to be annexed and having any objection to the proposed annexation might object before the Common Council and show cause why such territory should not be annexed, and furthermore, the said Reso- lution provided that at any time not later than the said hour set,as mentioned hereinbefore for the said hearing, any owner of property within the said t.erri- tory proposed to be annexed might file written protest with the City of San Bernardino against such annexation; and WHEREAS, no objection or protests of any kind'or nature whatsoever were made, or filed, either written or oral, with the said City of San Bernar- dino, and no protests or objections of any nature whatsoever were made, either written or oral, at the meeting of the Common Council on the 2nd day of July, 1956, as mentioned hereinbefore, at which said meeting the said Common Council publicly announced that any person, firm or corporation desiring to protest or object to said annexation might do so at said meeting; and WHEREAS, it appears to the Common Council of the City of San Bernar- dino, that the aforesaid annexation proceedings have been completed and every- thing performed at this time, in accordance with said Government Code, and men- tioned hereinbefore, and any and all other laws in any way connected with the said annexation procedure, having been complied with; and WHEREAS, the Common Council of the City of San Bernardino desire to approve at this time the annexation of the aforesaid territory. NOW, THEREFORE, THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DOES - 2 - 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 . .. ,.. . 1 2 HEREBY ORDAIN AS FOlU)WS: SECTION ONE: That said territory as herein described as Annexation 3 District No. 94 is hereby annexed and incorporated in and made a part of the 4 City of San Bernardino. 5 SECTION TWO: The territory herein referred to as being annexed to the 6 City of San Bernardino is particularly described as follows, to wit: 7 All that portion of Government Lot 5, Section 6, Township 1 South, Range 4 West, San Bernardino Meridian, described as follows: BEGINNING at a point on the present corporate limits of the City of San Bernardino, said point being on the West line of Meridian Avenue, 60 feet wide, as delineated on the map of the Town of Rialto and Adjoining Subdivisions as per plat recorded in Book 4 of Maps at page 11, records of the County Recorder of San Bernardino County, said point being 150 feet North of the North line of Etiwanda Avenue, 60 feet wide, as delineated on said map of the Town of Rialto and Adjoining Subdivisions; thence Northerly along the West line of said Meridian Avenue to a point whieh is 10.04 chains North of the:WesterlyprglonyatiQn of the South line of said Govern- ment LotS, said pOInt being on the present corporate limits of the City of Rialto; thence Easterly along a line parallel to the Westerly prolongation of the South line and the South line of said GovernmentLo); 5 to a point on the East line of .aid Government Lot 5; thence Sou~erly along the East line of said Government Lot 5 to apoirit in the ,North line of Annexation District No. 10 of the City of San Bernardino, said point being on the present corporate limits of the City of San."~!!rn8rdino; thence Westerly along the North line of said Annexation being along the present corporate limits of the City of San Bernardino, to the point of beginning. SECTION THREE: That the above described property will be subject to taxation equally with the property within such municipal corporation, to pay its . proportion of the following bonded indebtedness of the City of San Bernardino which said bonded indebtedness was outstanding at the time of filing said peti- 27 26 to wit: tion or theretofore authorized and is outstanding at the time of said annexation, A bonded indebtedness of $200,000.00 incurred for the construction and 28 completion of a convention hall, the outstanding indebtedness thereon being 29 $30,000.00, bearing interest at the rate of 5% per annum; 30 A bonded indebtedness of $275,000.00, incurred for the acquisition and 31 construct ion of water works, including "Devil Canyon Water Works," water rights, 32 rights of way, pipe lines, wells and pumping plants, the outstanding indebtedness - 3 - 16 vote, 17 18 19 80 21 82 23 . ~ .~ .. . 1 thereon being ~61,875.oo, bearing interest at the rate of 5% per annum; 2 A bonded indebtedness of $650,000.00 incurred for the acquisition of 3 real property, and construction of a sewage disposal plant, inverted siphon 4 sewer lines and intercepting sewers, the outstanding indebtedness thereon being 5 $43,333.32, bearing interest at the rate of ~ per cent per annum. 6 7 8 9 SECTION FOUR: The property herein annexed is declared to be a part of Ward 3, and the boundaries of Ward 3 are hereby altered to include said annexed territory; and said property is placed and declared to be in Zone R-l Single Family Residential. 10 I 11 SECTION FIVE: The City Clerk shall certify to the passage of this ord- inance and shall cause the same to be published three conSecutive times in the 12 13 14 15 San Bernardino Evening Telegram, a daily newspaper designated for that purpose.
