GIVING NOTICE OF A SPECIAL.ELECTION TO BE HELD IN THE CITY OF SAN BERNARDINO ON THE 19th DAY OF MARCH, 1957, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY PROPOSITIONS TO INCUR BONDED INDEBTEDNESS. BY SAID CITY FOR CERTAIN MUNICIPAL IMPROVEMENTS~ AND CONSOLIDATING.SAID ELECTION WITH THE PRIMARY ELECTION TO BE HELD ON SAID DATE. WHEREAS, the Mayor and Common Council of the City of San Bernardino, california, did on the ~/~ day of January. 1957. by a vote of more than two-thirds of the members of said Common Council, adopt Resolution No. 4;l- 5' 'I entitled "A resolution of the Mayor and Common Council of the City of San Bernardino. california, determining that the public interest and necessity demand the acquisition and construction of certain municipal improvements, and making findings relating thereto", which said resolution was duly signed and approved by the Mayor of said city and attested and certified by the City Clerk of said city; The Mayor and Common Council of the City of San Bernardino DO ORDAIN as follows: Section 1. That a special election be held, and the same is hereby called to be held. in the City of San Bernardino, california. on the 19th day of March, 1957, for . . the purpose of submitting to the qualified voters of said city five propositions of incurring indebtedness and issu- ing bonds of said city therefor, in the amounts hereinafter set forth, and for the objects and purposes set forth in said resolution and hereinafter stated. Section 2. That the object and purpose for which each of said indebtednesses is to be incurred and bonds issued therefore are as follows: PROPOSITION NO. 2 - SEWER BONDS: The acquisition and construction by the City of San Bernardino of a certain municipal improvement, to wit: additions to and improve- ments (other than repairs) of the sewage collec- ~ tion, treatment and disposal system of said city, consisting of a new sewage treatment plant, trunk, interceptor and outfall sewers, a sewer ventilating system, pumping stations, effluent reclamation works with pumping stations, pipelines and spreading grounds, and including the acquisition of all land, easements, pipe, pumps, machinery, equipment and other property necessary for any of the foregoing. PROPOSITION NO. 3 - GRADE SEPARATION BONDS: The acquisition and construction by the City of San Bernardino of a certain municipal improvement, to wit: a street improvement in the city consisting of a grade separation on 2. . . Rialto Avenue over the Atchison, Topeka & Santa Fe Railway Company main-line tracks and siding at Public utilities Commission Crossing No. 2B-O.3 and over the Lytle Creek Channel and the realignment of Rialto Avenue west of said tracks and siding, with appurtenances and appurtenant work and including the acquisition of land, ease- ments, rights of way, apparatus, equipment and other property necessary therefor? PROPOSITION NO. 4 - FIRE FIGHTING SYSTEM BONDS: The acquisition and construction by the City of San Bernardino of a certain municipal improvement, to wit: additions to, relocations of and replacements of the fire fighting system of said city as follows: $22,000 for additions to the Central Fire Station consist- ing of automobile storage sheds and a fire alarm system; $36,000 for additions to Fire Station No.4 on North "E" Street consisting of building additions and an equipment garage; $67,400 for the relocation and replacement of Fire Station No.2 (now on North Mt. Vernon Avenue) consisting of a new building with furniture, fixtures and furnishings necessary therefor and a fire alarm system; $97,600 for a new fire station west of Lytle Creek (to be known as "Terrace Station") consisting of a new building with furniture, fixtures and 3. J . . furnishings necessary therefor, a fire alarm system and fire fighting apparatus necessary therefor; and $77,000 for fire fighting trucks, apparatus and equipment. PROPOSITION NO.5 - LIBRARY BONDS: The acquisition and construction by the City of San Bernardino of a certain municipal improvement, to wit: a new main library build- ing with vehicle parking therefor and the planting and landscaping of grounds, to be located at the Southeast corner of Fifth Street and Arrowhead Avenue, including the acquisition of all land, furniture, fixtures, furnishings and other property necessary therefor. PROPOSITION NO. 6 - COMMUNITY CENTER BUILDING. BONDS ~ The acquisition and construction by the City of San Bernardino of a certain municipal improvement, to wit: a community center build- ing in Pioneer Park (to be known as "Pioneer Memorial Hall")~ including the acquisition of all furniture, fixtures, furnishings and other property necessary therefor. Section 3. That the estimated cost of the munici- pal improvement described in Proposition No. 2 in Seotion 2 hereof is the sum' of $4,900,000, and 'that the amount of the principal of the indebtedness to be incurred therefor is the sum of $4,900,000. 4. . . That the estimated cost of the municipal improve- ment described in Proposition No. 3 in Section 2 hereof is the sum of $ ~. s- 0, CJ C> 0 , and that the amount of the , principal of the indebtedness to be incurred therefor is the sum of $270,000. That the estimated cost of the municipal improve- ment described in proposition No.4 in Section 2 hereof is the sum of $300,000, and that the amount of the principal of the indebtedness to be incurred therefor is the sum of $300,000. That the estimated cost of the municipal improve- ment described in Proposition No.5 in Section 2 hereof is the sum of $800,000, and that the amount of the principal of the indebtedness to be incurred therefor is the sum of $800,000. That the estimated cost of the municipal improve- ment described in Proposition No.6 in Section 2 hereof is the sum of $125,000, and that the amount of the principal of the indebtedness to be incurred therefor is the sum of $125,000 ' That tpe maximum rate of interest to be paid on any indebtedness incurred for any of the purposes stated in this ordinance shall not exceed the maximum rate permitted by law, to wit, six per cent (6%) per annum, payable annually the first year and semiannually thereafter, the actual rate or rates of interest on said bonds to be determined at or prior to the time of the sale or sales thereof. That if any proposition for the incurring of bonded 5. . . indebtedness so submitted receives the requisite number of votes, to wit: two-thirds of the votes of the qualified electors voting on said proposition, bonds of said city in not exceeding the principal amount stated in such proposition shall be issued and sold for the object and purpose set forth in said proposition. Section 4. That the polls for said election shall be opened at seven o'clock A.M. of the day of said election and shall remain open continuously from said time until seven o'clock P.M. of the same day, when said polls shall be closed, except as provided in Section 5734 of the. Elee- tions Code of the State of California. Section 5. That on the ballots to be used at said special election, in addition to any other matters required by law, there shall be printed substantially the following: MARK CROSSES (+) ON BALLOT ONLY WITH RUBBER STAMP; NEVER WITH PEN OR PENCIL. (ABSENTEE BALLOTS MAY BE MARKED WITH PEN AND INK ORPENCIL.)-- . _ INSTRUCTIONS TO VOTERS To vote on any measure, stamp a cross (+) in the voting square after the word "YES" or after the wOrd "NO". All marks, except the cross (+) are forbidden. All distinguishing marks Qr erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the inspector of elec- tion and obtain another. On absent voter's ballots mark a cross (+) with pen or pencil. 6. . . Section 6. A cross (+) placed in the voting square after the word "YES" in the manner hereinbefore . . provided shall be counted in favor of the adoption of a proposition. A cross (+) plaoed in the voting square after the word "NO" in the manner hereinbefore provided . . shall be counted against the adoption of a proposition. Section 7. That the special election hereby called shall be and is hereby ordered consolidated with the primary election to be held in said city on Tuesday, the 19th day of March, 1957, and such elections shall be held in all respects as if there were only one elec- tion, and only one form of ballot shall be used thereat. The precincts, polling places and officers of election for this special election shall be the same as those provided for said primary election, and said precincts, polling places and officers of election are set forth in the resolution providing for said primary election, /f).~7 adoptetl~ ;4. to wit: Resolution No. 1911. 9. . . Section 8. That except as otherwise provided in this ordinance, the election hereby called shall be conducted as provided by law for other municipal elec- tions in said city. Section 9. That the Mayor and Common Council of said city shall meet at its usual plaoe of meeting in the City Hall on Thursday, the 21st day of March, 1957, at 7:30 o'clock P.M. of said day, and prooeed to canvass the eleotion returns and declare the result of said eleotion. Section 10. That the City Clerk shall certify to the passage and adoption of this ordinanoe by the Common Counoil of said oity by a vote of more than two- thirds of all of its members, and shall oause this ordinanoe to be published onoe a day for at least seven (7) days prior to the time appointed for the holding of said eleotion in the SAN BERNARDINO EVENING TELEGRAM, a newspaper printed and published seven days a week in said oity. No other notioe of such election need be given. Seotion 11. This ordinance shall take effect upon the completion of publication for three (3) consecu- tive days, exclusive of holidays, in the SAN BERNARDINO EVENING TELEGRAM, a daily newspaper printed and published in the City of San Bernardino. 10. . .
